Bryan Kohberger's Fiery Hearing, "Not TODAY Judge!"

    Bryan Kohberger had a hearing on potential juror surveys. The hearing escalated quickly as the lawyers and witness felt very strongly about their positions. The TikTok Psychic was mentioned by the survey expert, Bryan Edelman, as part of misinformation that is floating around about the case. A video of the prosecutor, Bill, was used as an example of disseminating information. Bill accused Edelman of tainting the jury pool and Edelman said he was so angry it made him cry. The judge didn't make a ruling but did push back the Change the Venue Hearing to June 27, 2024 and kept the May 14, 2024 Hearing to go over a Motion to Compel.

    If all they did was ask about things that came from the media, then how could that be violating the non-dissemination order? Makes no sense.

      i believe it’s because the judge defines “public information” as information that is revealed in the legal documents from the court. neither the prosecution nor defense have filed anything that accuses kohlberger of stalking, only the media has made those allegations. the media’s allegations aren’t “public information” under the judge’s interpretation, thus the non-dissemination order was violated. like in most legal disputes, the definition of a word is the crux of the issue.

      It was presented as an open an shut case by the prosecutor but the more we learn about it, it seems they do not have a single shred of evidence.

    Bill Thompson just admitted that BK didn’t stalk the victims, contradicting everything said about the case since the arrest. It will be interesting if this case goes to trial.

      @@kgrachjudges are held to a higher standard because they are referees, the defense is supposed to be an zealous advocate for their client which entails doing literally everything they possibly can to ensure their client’s constitutional rights are protected. you might not like AT but she’s doing her job, the judge is not. he needs to schedule the damn hearing already!

      @@disco.heaventhey are actually allowed to have feelings, crazy right? Judges are humans! They can’t just schedule the trial when the defense is filing a bunch of motions that create delays. This trial will take place when all the details are hammered out and not a minute before that.

    I grew up in a town 1 square mile in NJ, graduated high school with apx 38 others. There are very little secrets. If i messed up in school, my mom usually found out at the grocery store or local bank that same week.
    This case should be moved.

    The problem with the news is that in today’s world we get news everywhere through lots of media. There’s no real place to go to get away from it. So if if people people have heard it in Moscow, they will also know it in Rooster Rock, Idaho. You can’t find a place that wouldn’t know.

      Latah County has 39,876 residents 1/4 are either under 18 or over 65 and we can subtract out police, court staff, medical personnel (because real communities are whoafully understaffed) and educators with two colleges as well as primary and secondary schools (once again substitute teachers are in short supply), how pray tell will they find enough unbiased citizens to fill a jury and alternates? If they hold the trial in the summer another good portion of eligible adults from the 11,000 college students will have gone home. With only three counties having populations over 100,000would it seem wiser to reserve a court room in one before they start jury selection?

      @gothgammyboo I think law and crime individuals know about it….but lots of people don’t follow this kind of news. None of my friends or family know about this case (California). I’d probably have to keep adding details about it to jog their memory, if it even gets jogged at all. Most people in my life don’t even know about it. Maybe one coworker who is into true crime?

      Exactly. I don’t see the issue, especially since the objection from the prosecution had made it clear these types of polls are matter of standard practice

      I originally had an issue with it because of some of the false questions. But that is what they have to prove for a change of venue. So the expert got me on his side with this one. Also he was willing to tweak the intro to indicate some of these things I ask may be true or untrue. That is only issue I had. Move on and let them do their work.

    A county with only 30,000 adults who could possibly sit on a jury and the existing survey showing 80% of those having extensive knowledge and strong opinions about the case would argue for a change of venue to one of the three Idaho counties with populations over 100 thousand. 💜

    I love you so much for calling the prosecutor Santa!😂😂😂 I have never heard a prosecutor speak to a judge in this way. Judge Judge is going on the naughty list 4 sure! If I was called and asked about something I hadn’t heard about- I would Run to google and find out what they were talking about. I personally would be immediately poisoned by a survey about the case.

    Bill sounded like he didn't understand. I have a doc level edu in same areaas eexpert & he was accurate. State sounded a little liike "rubes".If JJ does his reseach hopefully he learns this is normal & they look backwards actiing like this is unusual (ot is for them, not across US).

      Linda...there are no members on this channel, only my live channel. Seeing something isn't the issue, it's more about how much they have seen and if they've made up their mind or can be fair. The Depp case found jurors who weren't paying attention to the case. There are news stories I pay little attention too even if they are big stories.

    The fact that people ran to the Prosecution with news of the survey is very disturbing. The community is perhaps overly invested in every little thing. While they are horribly affected, a fair trial is not likely IMO. “Not today Judge” seems to be Judge Judge’s modus operandi.

    This would go a lot easier if they took the death penalty off and just did life in prison. Quite frankly, life in prison would be a lot worse for me. Rip the bandaid off quickly. But I'm extremely neurdivergent. However, Ann Taylor is right - it's so difficult to get all the things they need on time or at all. And then she has to go thru them. Then, experts are hard to come by because the world is watching this case. It seems like it is so much more difficult for this case than others. However, I am surprised by how unprofessional law enforcement investigations are in other states. CA is so litigious that law enforcement and courts need to be exacting. At least EDB gets the CA thing. Oftentimes, others are wondering why we're so careful here. Having friends and family in law enforcement, we know everyone gets sued for everything. We also know that everyone has a portable camera in their hands.

    IMHO the judge is acting reasonably. I apologize in advance if I misunderstood anything. The defense was told to provide a copy of the questionnaire to the prosecution and the Judge Judge (gotta love the name) for review. Prosecution only found about the questionnaire dissemination after they were contacted by people receiving calls.
    Some questions were were based on Reddit and other forums that contain speculation (theories, leaked information, rumors, speculation and conjecture) which could taint the jury pool.

    It was one of two best days in court for BK so far w/o saying a word so far. So, this is what we know - BK wasn’t stalking and is not the stalker, no connections found between BK and victims, no physical evidence of victims found in any of BK’s realms, can’t prove any of the suspect vehicles were BK’s or they were at the crime scene or BK was in them, the County has a biased jury pool. It keeps getting a steeper climb for this so-called “slam dunk” case…. So, is there a secret CI witness ready to testify against BK for a better outcome for themselves? And, even if so, how could anything that CI be proved or believed?

    I’m exhausted by both sides in this case. It’s gross sometimes.
    That being said, I always try, emphasis on try….. to take a breath and remind myself that these things are important, and that the American justice system system while flawed is amazing.
    But my lord the victims circle of friends and family. I feel for them more and more as this drags on.

      I feel for them being lied by Santa and now they look like they on purpose spread a false narratieve. They got a document of Santa where it got implied BK stalked 1 of the girls so they said that in interviews. To hear Santa admit that bk never stalked them. This case is a mess thanks to Bill Thompson. And I'm not convinced BK did it but if he did and walks it's only Santa to blame

    The expert works with opinions every day but he sure doesn’t like negative opinions about himself. I found him thin skinned- he should allow his impressive resume and experience to speak for itself.

    It seems to me that the people surveyed who weren’t all that familiar in the beginning, are now. I mean realistically speaking, if I got a phone call, I’d be on the computer as soon as I hung up. It’s a betrayal and the Judge is pissed. He may feel backed into a corner and have to grant the defenses motion in order to avoid a mistrial.

      Did you not even listen to the hearing? Bill T stated BK did not stalk the victims. You must have a rock for a brain. How many ways does it have to be repeated before you understand? The phone pings mean nothing by LE's own admission as BK wasn't stalking anyone at the King Rd house. Their "evidence" is dwindling as more facts come out. Even after clarifying that BK didn't stalk the victims you proceed to state the exact opposite and it's because of people like you who no matter what believe MSM misinformation and why the venue needs to change. Double Duh.

    I say, that's all Brian's idea about the survey. Do you all remember when we first heard about him? And when he was attending his criminal Justice classes or teaching off. Whatever he was doing at that time he had sent out or wanted to send out a survey to prisoners and have them answer questions about how they Felt about committing the crime and getting ready to go commit the crime and all sorts of silly questions and I believe it was stopped. But it was supposed to be answered by people in jail and I just think this is all in his head and that attorney he's got. We'll go along with anything. She may have even said. Didn't you prepare survey before? Let's do another one. If I were the parents of those 4 kids, I would be furious at what this defense attorney is doing with this case.She's a disgrace

      @@EmilyDBakerQuickBits I truly don't wish to be a troll, but I watch a lot of true crime channels and I think it is unusual for the commentator to make sounds in the background while the clip is playing. It reminds me of the two guys talking in the wings of The Voice while someone is performing. It is distracting and unprofessional. Just some honest feedback, well intended, honestly. I would respectfully disagree that it is best practice. Play the clip, let us watch it, then comment on it. That's my preference.

    There’s something about this “expert” witness I don’t like, and I can’t put my finger on it. Might have to do with the fact that he doesn’t seem to see how his survey question about BK **allegedly** stalking the victims could very well taint the jury pool if in fact the people questioned had NOT heard that allegation or that it may or may not be true.

    I don’t like the questions. Because if they know something about the case then they do hear all 9 questions. There is still a way to write them open. “What, if anything, have you read, seen or heard related to DNA in this case?” You aren’t feeding bad info but still promoting further discussion and things for potential jurors to expand on to show prejudice. I don’t understand how this is currently an accepted practice.

    I can’t believe the attitude some people are having towards the Judge, um I hope they never serve on a jury nor have to be in a courtroom for any reason. The Judge is the King of his courtroom unequivocally and without question. I know most people aren’t used to dealing with that level of authority as adults. The defense is going to be stuck with shady experts it sounds like. Also the Judge doesn’t need to rule on the same day. We all understand this even if it’s frustrating.
    There is absolutely NO VENUE that hasn’t had a crapload of pre trial publicity!

    I believe that the defense team deliberately misinterpreted the statements made by the judge and prosecutor. It is evident to me that they have a specific venue in mind and are willing to go to any extent to get there. They made false claims by vehemently stating that there was no information in the questionnaire that was not present in The Probable Cause Affidavit, whereas they knew that the problem was with the questions that were not related to the affidavit.

    I think Ann Taylor was far more strident, disrespectful, and obnoxious than the prosecutor. I think she is a whiny, sneaky lawyer who is doing everything she can to delay this trial. Her statement about believing in her client's innocence and his rights being "most important" makes me sick. Yes, he deserves a fair trial, but THE RIGHTS OF THE VICTIMS ARE EQUALLY SO and right now, this judge isn't even setting a trial date. I am sick of seeing this defense constantly bending over backwards for BK! Also, this judge need to stop stammering, stop delaying, and set a trial date once and for all. JUSTICE FOR THE VICTIMS.

      I totally agree with you. I absolutely think Bryan Kohberger is responsible for the murders but if evidence came out that shows me differently then I would change my mind. I can still be fair and I don’t see Ann Taylor as a trustworthy person. She is very sneaky and she is so disrespectful to the judge. She has a job to do but she doesn’t have to throw her morals out to do the job. I want him to have a fair trial with proper representation. I don’t want anyone to be able to say that he didn’t get a fair trial. Bill Taylor is getting tired of the defense antics and he is starting to get very upset. I’m glad to see that he is fighting for the victims in this case. Bryan Kohberger is lucky to have Judge Judge because he is trying to make this a fair trial. I look forward to the evidence coming out that’s going to prove his guilt without a doubt.
