      from malaysiaa! a law student here, malaysia adopted duty to diagnose and treatment in bolam, combined with principle under rogers v whitaker ( duty to advise risks)

    Can l ask about point 3. What if no harm has done (outside of things like stress/anxiety). Example abnormal results with possible deadly consequences that should have been investigated are not. When this comes to light patient then has months worth of tests and investigations, luckily all ok but could easily been otherwise?

      Hi Nena,
      The science regarding reducing the transmission of Covid-19 is constantly changing. Hence why countries around the globe are utilising different tactics to prevent a second wave of cases. (E.g. initially advising to avoid mask usage to now advocating it)
      I do not believe that I could put together any substantial advice on how to avoid lawsuits given there are so many unknowns. I would suggest following the public health advice of your country / state.
      With regards to doctors in the UK we have been assured that special consideration will be given by our indemities given many of us are working outside of our usual scope of practice.

    I'm living through systematic abuse and negligence but, because it all started 20 plus years ago, they get away with it scott free. I'm 43 now and will probably be dead before I'm 50 but still they won't acknowledge their failings. It's at the point I've been stonewalled from local GP practices. To summarise I was pulled from a 70mph car wreck in 2001 and to this day they haven't found any injury caused in that accident. They blame it on age related illnesses at this point. I even posted a video 8 years ago to my RUclips channel clearly showing my issues in my back and shoulder.

    Maryland U.S.A. home study. Before you see a doctor here you need two things a better understanding of medical care and treatment then the doctor, And a understanding of law concerning medical malpractice. If not you better have nothing more than a comman cold. Otherwise your in for a long, long journey.

      Great question. There isn't only one. Bolam, bolitho and montgomery are all key in the uk but not exclusive.
