Why do I get the feeling that this is more about [REDACTED] accidentally burning Andrew Hussey's breakfast burrito and they've been salty about it ever since, like that one dude from Half-Life 2, than it is about covering up how they treated their employees?
Hey, @hbomberguy, how long until you get sued by Moffat for the Sherlock video? As I mean... if what What Pumpkin says is totes how it goes... you've clearly got a lot of stuff from Moffat coming your way
As a non-Homestuck I'm glad to have an answer to the question "why is Homestuck so long?" - the answer being "Hussie is physically incapable of being brief"
I was suspecting as much at that part but complaining that they got together to discuss their all being simultaneously fired confirmed it for me. No need to demonise ex-employees for meeting up for drinks otherwise really.
yeah no wonder undertale stole the throne out from under them at least toby foxxes sentences dont run longer then a marathon and know how to tell a coherent story
honestly hussie played this all wrong from the start - they should have offered to make emily and sarah's trollsonas canon within homestuck in exchange for deleting the video
See, that's the insane part, you're describing an act of like... Mild respect, in the most minor way. Instead: They just basically said 'LISTEN UP LITTLE GIRL' like a drunk 50 year old man trying to boss around a 35 year old woman.
I'm pretty sure there's a rule in journalism roughly paraphrased as "If your investigation leads to harassment and legal threats, you're usually onto something."
If I had a dime for whenever a youtuber got a legal threat from an out-of-touch lawyer, I would have 2 dime. While it's not much, it weird that it happened twice..
From what I understand of American labor law, it can often be the safest way to fire someone to not give any reason at all. This is because if you GIVE a reason, it might be that firing someone for that reason is illegal. To then turn around and complain that the employee who doesn't know the reason does not know the reason is...uh...certainly an interesting move.
@@blackbot7113 After a quick google search it appears it doesn't really make much difference safety wise for the employer. My assumption is that if they fire you without reason, you can report them for firing you for an illegal reason, and it'll be investigated. For example if you fire without reason someone who has a good work history and no documented issues, then you risk being accused of firing them for some illegal reason. If they're older, or pregnant, etc than in court it could very easily look like that's the reason you fired them. Assuming they say anything, which is definitely more likely if you give them no reason.
My favorite part is when WP said that they understand Sarah is young and inexperienced, and therefore prone to mistakes but they know she wasn't acting with malicious intent. That undermines their ENTIRE libel case. In order to convict someone of libel, you have to prove that they intentionally wrote false statements with the purpose of damaging you.
My mission is successful. I ended homestuck, gave people something to live for and brought hussies antics to the attention of God and he was punished. I'm glad I can rest easy now, knowing I can smoke weed without hussies presence in the back of my mind, knowing my stories were unfinished. Now that they are finished I can move on with my life to other better things.
“I needed the extra time to respond to your condescending, and in my opinion, defamatory email with the appropriate professional tone” GOD DAMN DAVE HOLY SHIT
@@AlletaLady You said it, but really before reading your comment I got myself thinking that if I ran into Dave, I would so buy a coffee for him! And for Sarah and Emily as well of course.
My mind doesn't go directly to trying to create an official and NLRB-recognized union, but it does definitely feel like there was a person who wanted to make some kind of demands of the management, who was able to convince many of the other employees to back them up (the group who was "poisoned").
Maybe not a “union” per say, but folks definitely wanted/deserved better for the hard work they did, and there seems to be, if I had to put it politely, an or many “rotten apples” either in management positions or positions that had sway in decisions made that was making it hard for lower level employees. 🤷♀️ I’ve seen it happen in the workplace; one or many bad managers come into the work space, and when underlings or second in commands raise complaints, they’re either moved to another area, driven to quit through the bad working conditions going unchanged, or being outright terminated.
okay okay ive thought about it and here's my two cents from the fact that sarah seems to empathize with the situation WP was in with said former employee i doubt that WP's explanation of what happened had anything to do with unionizing. I'm 90% certain that if they gave any indication that the former employee was making demands about better working conditions sarah would have mentioned it in this video same thing with the other people that contacted her. if she had heard form any former employees that they had been trying to advocate for themselves, collectively or individually, before getting shut down then she almost certainly would have noted that here. all of this would indicate that this wasn't the case. Like, if they had shut down the branch bc of worker action we very likely would have seen some evidence left behind (in the form of testimonies mentioning that fact for instance). However, "a mismanaged, litigious, and shady company with very questionable work practices fires a whole department suddenly and screws them all over because a 'vindictive' ex employee has convinced all the others that the company is bad & trying to screw them over" is such textbook union busting that i cant fully dismiss the possibility that it happened here
There is no way in heaven or hell that was ever written by a lawyer. I would bet that the lawyer handed them something reasonable, and someone decided to 'punch it up' a bit.
@@KatieCunningham I would be absolutely shocked if WP has a communications lawyer on retainer, especially since the intimidation letter was literally signed by the company's CFO. when this sort of thing is done right, it's usually "hello, I am a lawyer representing ______," not "Hello, I literally run _____, and if you don't do ______ I'll have to hire a lawyer"
As others have pointed out, it's a real winner move to open up potential libel proceedings by admitting that your opposition both behaved in good faith and couldn't even have not done so.
If you had one vindictive former employee, you had one vindictive former employee. If all of your former employees are vindictive, then you are the problem.
I know, right. I tell incels the same thing. If you can't become friends with ANYONE, you are the asshole. Not the rest of the world. Introspection is a virtue that seems to be hard for a lot of people these days.
“I am sorry it took so long to get back to you. I needed the extra time to respond to your condescending and, in my opinion, defamatory email with the appropriate professional tone.” Holy. SHIT. That is probably the most incredibly passive yet violently aggressive slam I have ever seen. As a Brit who runs on tea and sarcasm, this brought a tear to my eye. It’s beautiful.

SZ: Ok, what did I say in the video that he lied about? WP: Well, we haven't actually watched the video, we just know you sited a guy we don't like! So it must be wrong! SZ: Ok, watch the video and tell me which parts are wrong so I can fix them. WP: Well, I finally watched it, and let me just say, that when we did the things that guy accused us of, it's only because people were being jerks! SZ: So you did do those things? Nothing in the video was wrong? WP: Look, it's late and I'm tired! Let's just drop this whole thing! SZ: But you messaged me!

Like the kind of guy you meet in a club and he pretends to be sooo deep and acts like he’s above everyone else there and after a while you realise he’s not deep or intelligent at all he’s just condescending and scummy and when you realise this he turns into a r/niceguy and spams you with novel length nasty messages about what you’re missing out on and how stupid you are. Or he cheats on you and then tries to explain it away in some fake-philosophical bs that makes your head hurt so much that you can’t even remember what tf you’re actually confronting him about. Anyway that’s the vibez I get.
"HOW DARE YOU SPREAD THIS MISINFORMATION!!!" "what misinformation" "look, trying to dispell this misinformation has been really hard on us, so we'd appreciate if you just work with us here"
Throughout these correspondences, I noticed (although Andrew uses "misinformation"), they usually liked to use the term "disinformation", which is worse than "misinformation" because it implies intent, not just a mistake.
I haven't seen the original video and, frankly, I'm not even interested in seeing it. I don't even know who the people or things in question here are. I guess this is about some webcomic, etc. That said, either this is basically a criminal-level good-faith mismanagement of and incompetence on the issue, basically a master-class of how not to handle situations and not get caught up in conspiracy theories, especially in ones of your own making... ...or they are a bunch of assholes acting in bad faith, threatening and gaslighting, in which case should there be any kind of illegality on their part, they should be prosecuted and punished to the fullest extent of the law and deserve every bad thing coming their way. Frankly, the most charitable *realistic* interpretation would seem to be that bad shit happened that wasn't their fault, there was serious mismanagement that more or less *was* their fault, and although nothing is actionable, they are unwilling to make the basic good-faith gestures to right some wrongs, because they're spineless morons. For some reason, this reminds me of every case ever, where the people who didn't suffer tell the ones who did that there's no need to find out what happened or punish the guilty, because it's all in the past -- usually in very recent past. Guilty or not, this certainly makes them look guilty and I don't even know what it is they would be guilty of.
@Margaret Gibbs How dare you slander us with your totally true statements! Your statements have caused us to take irreperable damages and spend THOUSANDS of dollars as we spastically flail about with vague and misdirected allegations with no weight to them! my favourite thing about companies threatening youtubers is that they think they're scaring them but they are literally just giving youtubers free content to post
@Jaquan Kelsor That's why a lot of RUclipsrs have patreons and get sponsors, so they don't have to rely on the RUclips money, so if that did happen they wouldn't be going anywhere.
Actually the threats usually work. That's why they're a good calculated risk. We get a skewed sample because we only see the ones where RUclipsrs could afford to be pissy about it. How often do you see a RUclipsr take exception to corporate lawyers, the community fails to rally, and then the channel fades away with its tail between it's legs? It isn't that that can't happen, it's that those without backing and a slamdunk case decide employment is the better part of valor and take down the damn video. What's one vid compared to the good you're doing with your entire platform? So why don't we get the snarky follow-ups from those guys? Because the Hold Harmless includes a Shut Up clause.
Imagine if Jenny Nicholson's My Little Pony video had resulted in Jenny getting into a series of emails with Lauren Faust that made Jenny lose any respect she ever had for Lauren. This is one of the most surreal things I've ever seen, and I'd somehow never even heard of Homestuck until I stumbled onto these two videos.
Oh, I’m so sorry you were part of that day’s unlucky 10,000… (Referencing the popular statistic that 10,000 people on average learn about any given thing for the first time on any given day.)
Neither had I. Granted I'm 19 but apparently I was also already very much online in the early 2010s (as the existence of this very RUclips account proves). I think it must have been what I've decided to term as my "tech coma" for various reasons that I won't get into now.
I remember finding Hussie's overly verbose writing style in Homestuck kind of amusing and charming, like someone being humorously pretentious. I didn't think he *actually* wrote like that. It's like he's permanently in HS narrator mode, which is kind of terrifying.
Same. I used to look up to it, I'd write my damn English essays from middle school in the style, pff. Homestuck made me a verbose kid and later I realize that it was pretty insufferable and unnecessary to adopt even in academic contexts. Now I just laugh at it, reading the exchanges in this video is a really odd, half-nostalgia, half-cringe packed retrospective on a big part of my life at the time. I think his writing style would be more charming if he did...exist outside of it? Haha
Put like that, it reminds me of Sherlock where what seemed to be clever writing actually wasn't. EDIT: Actually, what this REALLY reminds me of is things like Sonichu and Empress Theresa. You know, terrible works made by people who actually do write like that in real life and take criticism about as well as a slug can handle salt.
I still managed to get a 3.7 GPA while mostly stoned out of my mind and drinking like a fish. Like my mama always says, fake it till you make it. (BTW I do NOT recommend my old college lifestyle, do not follow my example. I was an anthropology major for fucks sake, DONT BE ME!!!)
When I heard “eighteen thousand words.” I knew this was going to be a ride. My first ever novella was 25 thousand words, barely more than Hussies drawn out messages.
What I find impressive is the level of narcissism it must take for Hussie to have been totally unaware of what an unprofessional, paranoid, vindictive, petty, duplicitous, manipulative and condescending tyrant they made themselves out to be when corresponding with Sarah. To think that was legitimately their best attempt at portraying their company in the most positive possible light is genuinely entertaining to me. I love how Sarah Z reacted with the poise and emotional restraint needed to draw information out of a frustrating person like Andrew Hussie. I wonder how all those Kickstarter contributors will feel when they learn the true nature of who they gave their money to.
Knowing Sarah was a homestuck fan as a younger teen and knowing from personal experience that that group used to Idolize hussie back in the day as some sort of god of comedic and dramatic writing, I can’t imagine how it must have felt to receive these patronizing, condescending, roundabout emails from someone you used to love as a creator and realize “oh, they suck actually”.
Somebody should really tell companies that have an online presence that it's not the early 2010s anymore: most RUclipsrs have an attorney who handle crap like this and even if they don't, this kind of tactic NEVER goes well for the instigator. The irony of a company that handles a popular webcomic not knowing better than to try this is palpable.
Y’all really think most youtubers have an attorney on retainer 😐 I think most of you guys are forgetting that having an attorney on retainer isn’t free, costs money, and a lot of youtubers do not make the money it takes to have an attorney on retainer while still living a comfortable life Consulting with an attorney is NOT retaining one.
I love when companies write stuff without running it past an attorney first. "I told them - in a letter I signed and sent from my email - that we weren't seeking financial compensation and that I understood that they were young, ignorant and weren't trying to intentionally hurt us". "You did what now?"
“I told them also that we already had a response ready for our backers and it was not a big deal.” “You mean to say that you just invalided the case we tried to set up?”
the theory that the wine glass is actually Sarah and that the glass is possessing this random woman to make videos has been debunked. i cannot believe this
That emails SCREAMS "I'm not an attorney, but I'm going to try and word my email in a way that I think an attorney would word their emails because I want to scare someone into compliance" Actual attorneys (okay, competent ones who get the job done) don't send catty, passive aggressive emails like this. They send formal letters of demand that straight say "LETTER OF DEMAND" on the letterhead that outline exactly how badly they'll spank you in court based on all the causes of action they have already set up which they will dogpile onto you. This lady's scared.
@@k.morningstar7983 -- Lawyers have decorum, they will word a letter that gets straight to the point. They already have tight schedules career wise, so the letter will be clear, and not fuck around. In other words, it will be dictated by a professional, and will damn well present as such.
apparently some of the early convos between the four original kids are in part taken from conversations he had with his friends (esp ones involving dave) so... yeah it tracks
Coming back to this video 2 years later, and nothing has changed! Act 3 still isn't out. We've gotten yearly art asset updates twice in a row from an online fan convention. Homestuck 2 is still MIA. We finally learned what Homestuck 2.0 is because of a James Roach livestream from the previously mentioned convention. A Tumblr post from someone who worked at WP (Unsure if they still do) "revealed" that WP is out of cash. Hardly much of a reveal. Hussie and WP have gone back to radio silence. They've confirmed a majority of Gio's second article while still labeling him as a stalker. Gio is one of the people actively preserving Homestuck through the Unofficial Collection. WP's business now almost relies on his work, as the official sources are either deleted or in an awful way. These legal threats and email exchanges are almost entirely the last bit of PR the company has done. Clearly, all is well. See you all in 50 years for Act 4's release. Edit: Homestuck 2 has returned, though it is no longer Homestuck 2 and just Homestuck: Beyond Canon. OG HS2 is canned for good. New team lead by James Roach.
All the "former employee clearly has a grudge and is spreading vicious lies about the company" stuff is really giving me "wow ALL your ex-girlfriends are crazy, huh?" energy
I think the funniest part of this is that Sarah has noticed a running pattern w/ her videos where people who were involved in the fandom she's talking about will hear about the video, not watch it b/c it's "too long" or they just don't care for her, and then proceed to talk shit about her based on what they ASSUME is in the video and it is so wild to me that this phenomenon is common enough to extend to ANDREW F/CKING HUSSIE
Any respect I could have had about Hussy died the literal second they said they haven't watched the video. What an absolute joke that person is and they come of as ridiculouslu unprofessional .... Edited for unintentional misgendering.
@@eneyavorodecky my thoughts on it is that they're just completely done with Homestuck and just wanna do their thing. And now there's an hour long video they have to watch and everyone is freaking out. I think the line about wanting to sidestep facts and being intentionally nontransparent shows a desire to avoid any sort of drama/criticism that they haven't learned to ignore.
"Your honor, we're suing her because she said bad things about us." "She personally did?" "Well technically, she reported that other people said bad stuff about us but that's the same thing." "Was any of what she reported false?" "Yeah!" "Okay, which parts were false and what evidence do you have that it was?" "Like... stuff. And because we say it was."
“Your honor, we still may or may not have actually watched the video in which we presume she reported things that portray us in a bad light. Therefore, we would like to make a motion to stick our foot in our mouth and chew vigorously until the end of time.”
And FWIW, even the first step by itself is enough to defeat a defamation claim. You can't be sued for saying true things, including "other person X said bad things about What Pumpkin that I have no method of confirming or denying". That's undeniably true, irrespective of what actually other person X said and whether those things themselves are true.
I mean, those hussie-grams sounded like so much "you can't handle the truth" that it's WAY, WAY into self-parody here. Dave Strider would be either golf clapping or, what was the phrase, doing some sort of acrobatic f***ing PIROUETTE off the handle and winning like a medal or some shit.
Every RUclipsr needs to find their specific niche. Sarah's niche is terrible, badly researched videos that are full of malicious - dare I say libellous - lies, that are actively harming small creators in fandoms that she isn't even part of and never has been. I know this, based on the numerous videos by her that I haven't watched.
It's weird that "disgruntled former employee" is used so often as a discrediting description when the literal meaning is "this is a person that I once had power and authority over and they now hate me." In isolation that information in itself reflects badly on the former employer for anyone who isn't reflexively authoritarian.
Call me a softie but I think they're just a nervous wreck and doesn't know what the fuck to do to keep things from imploding. I think that's why they're scared to see what Sarah actually had to say. Reminds me of when my anxiety was at its worst... in middle school.
There's a reason I now exclusively refer to him as "Andrew Cuntie," and not just because I'm with the Australians on calling the idea that "cunt" is a hideously vile word is sexist as all hell.
I'm still obsessed with "no one cared about the funding/development" comments. I donated money to this kickstarter as a young teenager, and am now an adult with still no full game released, and my parents are honestly still giving me a hard time about "getting scammed by that webcomic game or whatever" so yeah, knowing where my money went would've been great to know all those years ago
but just look at all the "content" they're barfing out in the form of exhaustingly long emails! Surely by sheer volume you must admit it was a bargain.
@@NeroLeMorte There wouldn't really be any grounds for doing that, IIRC. Lots of people make the mistake of assuming being a backer on Kickstarter is the same as pre-ordering, when the reality is that you're an investor helping it get off the ground in the first place with no guarantees of its success. It's why I've almost never backed anything on Kickstarter, because there's a good chance it can fail and you can't technically do anything about it.
"If you had approached anyone at What Pumpkin to get the right information, then maybe your reporting would be accurate!" IF WHAT PUMPKIN COMMUNICATED EFFECTIVELY ENOUGH, THE REPORTING WOULDN'T HAVE BEEN NECESSARY.
Oh, it's gonna be the Evermore Park people. That's Jenny's next video and those people already tried to sue Taylor Swift just for naming her last album Evermore.
I'm only a few minutes in and I already want to see the rest based on this comment alone. And also because of the intro to the video. And also because, Sarah Z.
@@danielleverdant1100 "Ignorant" is such an odd insult to use when the information that would alleviate said ignorance has been intentionally kept under wraps by the person talking.

sarah: asks a question andrew: Did you ever hear the tragedy of Darth Plagueis The Wise? I thought not. It’s not a story the Jedi would tell you. It’s a Sith legend. Darth Plagueis was a Dark Lord of the Sith, so powerful and so wise he could use the Force to influence the midichlorians to create life… He had such a knowledge of the dark side that he could even keep the ones he cared about from dying. The dark side of the Force is a pathway to many abilities some consider to be unnatural. He became so powerful… the only thing he was afraid of was losing his power, which eventually, of course, he did. Unfortunately, he taught his apprentice everything he knew, then his apprentice killed him in his sleep. Ironic. He could save others from death, but not himself.

It is great information that totally makes us look great and destroys all that bad information because our information is the most true information and I can give you that information at any time that I want because I have lots of information to give. Too bad you did not ask for information first, because if you had asked for information I could have given you all the real information at that point instead of giving you that information now from our massive store of information that exonerates us from the bad information. I cant believe you did not do your due diligence with that information, because as you can see the information I am giving you now is the real information and this information would have made the video I did not watch much better because it is the information I have and not the malicious information from a bad source of information. Andrew Hussie and What Pumpkin in response don’t even watch the video, but jump to threaten legal action and lie about having to deal with (nonexistent) extreme and irreparable damages to their brand because of the video they didn’t even watch; when Sarah asks what misinformation needs correcting, never clarify what this misinformation supposedly is, because again, they didn’t even watch the video. I just have to laugh. How are you gonna sit there as a company and be like “We know you did tons of research to explain this topic, but you didn’t do the kind of research we specifically would have liked, and even though we didn’t watch your video, we don’t like what you said in it.”

Honestly? Iconic. He makes me feel so much better about not being able to shut the fuck up. 😂
I've read Problem Sleuth twice, and yeah, pretty much.
So "toxic employees poisoning other employees oppinions" is code for "unionising", right?
Oh, definitely
Yeah, that's pretty much the only reason why a company would immediately shut down the entire office instead of firing the "toxic" employee.
I was suspecting as much at that part but complaining that they got together to discuss their all being simultaneously fired confirmed it for me. No need to demonise ex-employees for meeting up for drinks otherwise really.
Dude keeping that, that's hysterical
So they were trying to unionized and everyone got fired?

“The only reason my employees think I fired them for no reason is because they don’t know why I fired them”
incredible
It's more like "The only reason my employees think I fired them for no reason, because I didn't tell them the reason why I fired them" xD
The cognitive dissonance is outstanding.
And for some reason they believe the outrageous lying lier who is trying to defame my company by saying that no one knows why they were fired! Absurd!
Underrated comment because fuck I didn't even think of that!
As a law student, this checks out. The people at WP are mad stupid lmao
“We know you didn’t intend to ruin our reputation, but we’re suing you for trying to ruin our reputation unless you take it back”

You're talking about actual malice, which relates to public figures.
Defamation, including libel, does not ordinarily require proof of actual malice.
You can’t “but I’m a little guy. You’re really gonna be mad at me when I’m just a little guy?” your way out of this one, Hussie.

... so... is anyone else getting "we closed the office because they wanted to unionize" vibes from the story of the NYC office?
My mind doesn't go directly to trying to create an official and NLRB-recognized union, but it does definitely feel like there was a person who wanted to make some kind of demands of the management, who was able to convince many of the other employees to back them up (the group who was "poisoned").
yes, it really does.
Maybe not a “union” per say, but folks definitely wanted/deserved better for the hard work they did, and there seems to be, if I had to put it politely, an or many “rotten apples” either in management positions or positions that had sway in decisions made that was making it hard for lower level employees. 🤷♀️
I’ve seen it happen in the workplace; one or many bad managers come into the work space, and when underlings or second in commands raise complaints, they’re either moved to another area, driven to quit through the bad working conditions going unchanged, or being outright terminated.
okay okay ive thought about it and here's my two cents
from the fact that sarah seems to empathize with the situation WP was in with said former employee i doubt that WP's explanation of what happened had anything to do with unionizing. I'm 90% certain that if they gave any indication that the former employee was making demands about better working conditions sarah would have mentioned it in this video
same thing with the other people that contacted her. if she had heard form any former employees that they had been trying to advocate for themselves, collectively or individually, before getting shut down then she almost certainly would have noted that here.
all of this would indicate that this wasn't the case. Like, if they had shut down the branch bc of worker action we very likely would have seen some evidence left behind (in the form of testimonies mentioning that fact for instance). However, "a mismanaged, litigious, and shady company with very questionable work practices fires a whole department suddenly and screws them all over because a 'vindictive' ex employee has convinced all the others that the company is bad & trying to screw them over" is such textbook union busting that i cant fully dismiss the possibility that it happened here
"We understand your client is a stupid little baby" Is probably not the best way to open communications.
@@m1k3y48 That may be why Lindsay doesn't believe T. Watson is a "lawyer."

"look, trying to dispell this misinformation has been really hard on us, so we'd appreciate if you just work with us here"

Me, having just watched Matt McMuscles' "Whu Happun" video on Lords of Shadow 2: Hmm, wow that's so interesting.

"Yeah!"
"Okay, which parts were false and what evidence do you have that it was?"
"Like... stuff. And because we say it was."
"Your honor, I still haven't actually reviewed the defendant's defamatory statements myself..."
“Your honor, we still may or may not have actually watched the video in which we presume she reported things that portray us in a bad light. Therefore, we would like to make a motion to stick our foot in our mouth and chew vigorously until the end of time.”
"Again, which parts were false?"
"Uhhh... POISON. POISONOUS PERSON. POISON."
