    Are you planning to buy a real property- a lot, a house & lot, a condo unit, a commercial property, or a farm or agricultural lot? Are you wondering what to look into and what to do? This video is for you.
    In this video, Your_Lawyer discusses some practical tips on buying a real property and the step-by-step process from pre-purchase dealings up to the transfer of title to the buyer.
    On the first part of the video, Your_Lawyer discusses the need for due diligence before you make up your mind to purchase the real property. This includes ensuring the identity of the person you are dealing with - the owner-seller or the agent of the owner-seller - and ensuring the existence, location and condition of the property.
    Ensuring the existence, location and condition of the property means conducting ocular inspection and documents verification. You need to make sure that you know what you are buying. You need to make sure that the documents are regular and in good order, such as the Original Certificate of Title or Transfer Certificate of Title (or Condominium Certificate of Title for condominium units).
    The 2nd part is dedicated to the discussion on the documents that you need to have prepared for the purchase of the real property, which include the Deed of Absolute Sale, Acknowledgment Receipt and the Special Power of Attorney. Your_Lawyer also discusses what you need to spell out in the Deed of Absolute Sale, such as the price or consideration, the obligation to pay the capital gains tax, documentary stamp tax, transfer tax and registration fees, the warranties, “as-is, where-is” arrangements, etc.
    The 3rd part deals with the the step-by-step process in the transfer of the title to the buyer - the documents required and the taxes and fees to be paid. It touches on the requirements of the Bureau of Internal Revenue (BIR) for the payment of Capital Gains Tax (CGT) and Documentary Stamp Tax (DST), of the Local Assessor’s Office for the payment of Transfer Tax, Real Property Tax (if due), and Tax Clearance Certificate, and the Register of Deeds for the eventual transfer of the Title. Your_Lawyer reminds you, however, that when the property purchased is an agricultural land, it will require a clearance from the Department Agrarian Reform (DAR). There is also a need to transfer the Tax Declaration to the name of the buyer, so you need to go back to the Assessor’s Office.

    Sana po mapansin, good timing na from Canada po kayo dahil yung tinitirahan namin for 20yrs na sa Pinas binebenta na samin. Owner is from Canada at ang binigyan nya ng SPA is kaptid nya na nakatira din sa Canada. I asked if they have somebody in Ph na may SPA wala daw po. The guy with SPA sent us a draft of Deed of sale pansin ko wala tax declaration info is that even valid at pwede ba sila mag execute ng DS kahit nsa Canada sila at basta lang ipanotarized dyan. Btw po ang SPA was notarized in Canada, they just sent us a copy thru messenger.

    Ask. Lang po, im the buyer, may deed of sales na po kami ng seller, na ang dapat ay extra judicial settlement of estate with sale ang ginamit namin (dahil patay na yung asawa nya)
    Using Deed of sales, may tatak na po sa BIR at sa Assessor's office already settled all taxes. CGT at doc stamp, Released narin ang CAR.
    Kung magpapagawa po kami ng Extrajudicial settlement of estate with sale
    Magbabayad ba ulit kami sa BIR ng mga taxes, cgt, doc stamp using EXTRA JUDICIAL SETTLEMENT OF ESTATE WITH ABSOLUTE SALE. (kahit processed na sa bir yung deed of sale namin)
