False allegations of child abuse are unfortunately common in child custody cases. Most importantly, these false allegations of abuse can lead to long term, negative consequences if not addressed properly.
Therefore, it’s essential for parents who find themselves facing these types of charges to take the appropriate steps to protect their rights and ensure that any false claims are properly addressed.
First, notice the warning signs that false allegations of child abuse are looming. In this regard, is a child custody case on the horizon? Moreover, is your ex the type person that would raise false claims? If so, be on the alert. In doing so, proactively avoid actions that can harm your child custody case.
For instance, document cuts and bruises in your care. Keep your communications civil and appropriate.
Next, document inappropriate comments or sexualized behavior in your home. Doing so helps you to fight false allegations of child abuse in child custody cases.
Third, gather your evidence to win your case against false child abuse allegations. For example, consider if CYFD has been involved. If so, what was the outcome. Next, have the police been involved? Finally, do you have any pictures, videos, or communications that show the child abuse allegations are bogus?
Finally, false allegations of child abuse commonly involve CYFD. In this respect, CYFD often conducts a home visit and gathers information. As a result, the claims of abuse are either substantiated or unsubstantiated. In most cases, CYFD unsubstantiates claims of child abuse.
It is essential to speak with an experienced New Mexico child custody attorney. An experienced attorney can help you better understand false allegations of child abuse during child custody cases in NM.

My ex is sitting in a jail cell right knw for the past 1.5 months for his second daughter accusing him of sexual assault. So pending to see right knw if it’s false but from what I heard all allegations are true sadly.
Best wishes to you and your family!
My daughter was told she would lose free time by the school counselors if she didn’t didnt “tell the truth” and wouldn’t let her leave the room and harassed her. its so sad because she came home crying saying she doesn’t want to ever go back to school.
I heard of one resource lady who works in elementary she will close the door with the kids in there and question after questions and say you will not get recess if you don't answer me. She has a reputation of calling cyfd on parents if she suspects a child is being abused or neglected in some way she doesn't care if the family could be just taking in their grandkids or nephew etc from their relative if the family has a fight or something going on and just assumes. So terrible how she does this and nothing really is going on with the kids, he or she could have a disability and the child hasn't had a diagnosis and she just plain evil.
This issue needs more attention. Kids are ruining peoples lives over these made up lies. It is discrediting to all other real abuse cases. Currently dealing with this terrible nightmare. Thank you for the video
Thanks for your response. Happy to provide needed information. Best wishes to you and your family!

Usually the best way for grandparents to assume parental rights is to file for Kinship Guardianship. Check out my video on the Kinship Guardianship Act in New Mexico. Best wishes!

Stay up and best wishes!
Hello, I'm currently undergoing a modification the father is a police officer, in an effort to throw dirt, he has filed a false allegation of child abuse, it was closed as been unfounded, but will the judge consider this in a child custody modification.
Generally speak, unsubstantiated claims of abuse/neglect have minimal impact, if any. This is because CYFD ultimately unsubstantiated the claims and found that abuse/neglect did not occur. With that said the issue can be considered. Sometimes, however, repeated false allegations of abuse, which are ultimately unsubstantiated, can be a sign of parental alienation. In other words, repeatedly file false claims that are unsubstantiated can backfire. Best wishes!
