My husband was humiliated and his car searched but their watch commander his officers were in the right. Two days later I called the watch commander and he was so rude and upset that I questioned him that he got rude and dismissive. My husband promptly quit being an officer and I can say that he regretted that he didn’t bring up anything to reveal that he was an officer. I don’t trust Police Officers as far as I can throw them. Just saying!

They did this exact thing to me. Worded it so it was tricky. I was 16 yo and I was driving a car with no tags. It was snowing so they asked me to sit in their police car. So I said okay. I was in the back and the 2 officers were up front. Already intimidating. They said do you mind if we search your vehicle? I said no. They said so no you don’t mind? I said very clearly “no you can not search my car.”. I was pretty smart to stand up for myself so young. They even tried to intimidate me with “okay then since you won’t let us search your vehicle we are automatically going to write you a ticket for no tags” I said OKAY!👍🏻

I got stopped by a Washington State Patrol for having a bent front license plate and he asked if he could search my car. I said no. He then asked, "Why? What are you hiding?" I replied, "Nothing, but you have no reason to search my vehicle and I'm not going to allow that." He made a couple of other tries but I stuck to my decision and he ended up giving me a warning to straighten out my license plate and watch my speed. I took the latter as a veiled threat, especially since he followed me down I-5 for several miles until I got off the freeway in Chehalis and went into a convenience store. That was maybe 15 years ago.

Now my son has a physical disability and doesn't walk normally. While handcuffed and police were searching his truck, my son fell over, injured his shoulder and the cops laughed at him, helped him up and went back to searching his truck. Once the search was over they told him they found marijuana in tin foil smaller than the size of a dime, which was BS because my son doesn't use any type of drugs. Gave him a ticket and impounded his truck and the car he was towing.
I would ask why. If they have no valid reason, I would tell them that I do mind. I would think it would be the same as appearing at your house without a Search Warrant.

They tore up everything only to find the dog was alerting to an empty baggy that held milkbone treats, as I was a pizza delivery driver and homes with dogs seemed to tip better if I have their pup a treat. Also frees us up for the transaction. In any case, my laptop that was in the backseat was trampled and scratched to all hell by the dog's paws. Because I didn't consent the search, the department had to replace my laptop as well as detail my interior. If I had said yes, I would have been liable for all that damage.
Now we’ve learned that the dog handlers can simply signal the dog to alert on anything. So, even the dog alerts can be completely false. As much as I want to support the police, they aren’t doing their part by policing themselves. They’re supposed not be the good guys, but to many times they’re just racking up arrest and ticket numbers to pad their own resumes or meet quotas.
Always be respectful and always say NO to any search of your private property! Police are fishermen. Don't allow them to fish on or in your property! Never! Be nice but say NO!

SCOTUS has ruled that they can only hold you at roadside for 45 minutes. If they hold you for 1 minute past that, it’s kidnapping. The clock starts when they initiate the traffic stop, which means the instant they put on their lights, the clock starts ticking. If you have to wait for a drug dog past the 45 minute mark, inform the officer that you are now leaving as the time that SCOTUS has set for a traffic stop has expired. Then leave. It’s best if you have a camera or simply start recording the officer with your phone.

The language is ""must be temporary and last no longer than is necessary to effectuate the purpose of the stop". You can record, and should. I know that it's illegal for a cop to search your personal property without a search warrant but one day for some strange reason I allowed two to do so since I always hear the term, "if you have nothing to hide let them go ahead. I was accused of a drug dealer with no evidence of such. I was taken to the station and searched from top to bottom and every penny taken from my pocket. After spending 5 hours in the lock up a superior officer intervened so I was eventually let go but had to appear in court. The long and short of the story is that I almost lost my job as it showed up on my records when my ID had to be renewed. Thanks to my boss I was allowed to work in a different department until everything was cleared. Since then, I have hated every single police officer. Absolutely no exception. We'll, at least I live to tell the tale. By the way, one of my Son is training to be a cop. I'm not too pleased with his decision but it's not my life.
I was stopped once just because I was driving a corolla that was a beater, they asked me if they could search or look through my car. I said no, they pressed and said why. my response was "Seems like the right thing to do" and they just accepted that, sent me on my way.

As a retired cop you should always politely refuse an officer’s request to search your vehicle. Don’t argue, maintain your composure and get an attorney if the police search your car absent your permission.
I'm a former LEO. One trick I was taught by my FTO in the 80s, was to find a reason to tow your vehicle. They then have to do an "inventory" of the vehicle to ensure that your property is safe. This allows them to pretty much check anywhere.
I was with someone and got pulled over. And I quote "I am going to search your vehicle." I asked, was it a question or statement. My passanger looked at me with those (just let him) eyes. He said..."Well, I am asking." So I says, then ask. "May I search your vehicle." No. "If you dont have anything to worry about then..." I interrupted. "Probable cause, reasonable suspicion, or my consent. You are never getting consent, so do you believe I am coming from or going to commit a crime?" Easy peasy

I turned off the HWY and stopped in the trailer park in front of the laundromat. It was night. I heard gun shots close to where I live, A man ran in front of me branding a rifle. He was gone like a flash. (My older son got home before me). A officer knocked on my door I rolled my window part way. He wanted to search my pick up/camper shell. For weapons. I told him No. I told him there was a man branding a rifle who ran past in front of me. I told him I was in the city getting groceries and showed him and needed to stop and rest a bit as I live down the 2nd road. I kept the doors locked. He hee hated about it. I told him to get a warrent. He left. As I went home (he left). The road below me was a police brigade. They arrested someone too dark to see who etc. I get home and bringing in the groceries (a few trips of this) the phone was ringing it was the jail my son was who they arrested! for shooting off a rifle ( police claimed my son through out the rifle in the sage brush.) And they couldn't find it. He went to court and was dismissed. I called his boss he wouldn't be into work Monday.😮
They will call for a K-9 Unit to come sniff around your car if you deny the search. After waiting hours for the K-9 unit, if they get a whiff of ANYTHING in your car then the Police then have PC to search your vehicle.

Well true. The people that say yes go ahead I have nothing to hide are those that never get in trouble. They are law abiding citizens. Actually, the question "Do you mind if I take a look in your vehicle? The answer should be"Yes, I do mind" because if your answer is "No", you are saying"No, I don't mind if you look in my vehicle" which in essence is you are giving them permission to look in your vehicle. So, answering "No" means you are okay with cop searching your vehicle rather than refusing to give them permission. (I learned this from a lawyer)
Do NOT just say “No”… that can be construed as “No, I don’t mind”… Be respectfully clear & concise; “You may NOT search my vehicle, Officer… [I do not give permission].
Politely say "NO" and stick to it. Furthermore don't help cops with any investigation. Politely ask if you can leave now. DON'T answer ANY QUESTIONS. Even if you have done nothing wrong, this is a police proceeding. Get legal counsel BEFORE talking to them. They could lie, place evidence it could be very bad

Ok in many cases if you say no they bring a dog. Some how the dog hits most of the time, or sometimes they just Escalade it just by you saying no then your stuck there for an hour or more while they fish for something what do you do in that type of situation. That's not how this works - that's not how any of this works. They can only hold you as long as the traffic stop is supposed to last. If they hold you any longer file a complaint. They don't hold you longer because you (wisely) did not give consent. That is also a slam dunk evidence suppression when your lawyer requests it. Do you mind telling me which department? In Illinois, after you say no to the officer, they can call out a drug sniffing dog and another officer. This action allows them to take you to the police station. Once they have established that they are taking you to the station. They are allowed to search your car without your consent.

I was stopped once just because I was driving a corolla that was a beater, they asked me if they could search or look through my car. I said no, they pressed and said why. my response was "Seems like the right thing to do" and they just accepted that, sent me on my way.

As a retired cop you should always politely refuse an officer’s request to search your vehicle. Don’t argue, maintain your composure and get an attorney if the police search your car absent your permission.
Great advice, cops have done a great job of making out that ppl who exercise their rights have something to hide.
I'm a former LEO. One trick I was taught by my FTO in the 80s, was to find a reason to tow your vehicle. They then have to do an "inventory" of the vehicle to ensure that your property is safe. This allows them to pretty much check anywhere.

I was with someone and got pulled over. And I quote "I am going to search your vehicle." I asked, was it a question or statement. My passanger looked at me with those (just let him) eyes. He said..."Well, I am asking." So I says, then ask. "May I search your vehicle."

I interrupted. "Probable cause, reasonable suspicion, or my consent. You are never getting consent, so do you believe I am coming from or going to commit a crime?"

All they have to say is "i smelled weed or alcohol " .
They will just get a dog to come, it will alert no matter what. Which gives them probable cause. Then what?

I've been searched so many times for no reason bc they always call a k9 unit. They never find anything bc I don't do anything but they'll still make false claims to do so and lie about the dog "alerting"

I turned off the HWY and stopped in the trailer park in front of the laundromat. It was night. I heard gun shots close to where I live, A man ran in front of me branding a rifle. He was gone like a flash. (My older son got home before me).
A officer knocked on my door I rolled my window part way. He wanted to search my pick up/camper shell. For weapons. I told him No. I told him there was a man branding a rifle who ran past in front of me. I told him I was in the city getting groceries and showed him and needed to stop and rest a bit as I live down the 2nd road. I kept the doors locked. He hee hated about it. I told him to get a warrent. He left. As I went home (he left). The road below me was a police brigade. They arrested someone too dark to see who etc. I get home and bringing in the groceries (a few trips of this) the phone was ringing it was the jail my son was who they arrested! for shooting off a rifle ( police claimed my son through out the rifle in the sage brush.) And they couldn't find it. He went to court and was dismissed. I called his boss he wouldn't be into work Monday.😮

They will call for a K-9 Unit to come sniff around your car if you deny the search. After waiting hours for the K-9 unit, if they get a whiff of ANYTHING in your car then the Police then have PC to search your vehicle.

Well true. The people that say yes go ahead I have nothing to hide are those that never get in trouble. They are law abiding citizens. Thise that worey about this are those that get into trouble or have been in the past. Usually those that do have something to hide or are unsure if they left something or not.
Actually, the question "Do you mind if I take a look in your vehicle? The answer should be"Yes, I do mind" because if your answer is "No", you are saying"No, I don't mind if you look in my vehicle" which in essence is you are giving them permission to look in your vehicle. So, answering "No" means you are okay with cop searching your vehicle rather than refusing to give them permission. (I learned this from a lawyer)

Politely say "NO" and stick to it. Furthermore don't help cops with any investigation. Politely ask if you can leave now. DON'T answer ANY QUESTIONS. Even if you have done nothing wrong, this is a police proceeding. Get legal counsel BEFORE talking to them. They could lie, place evidence it could be very bad
If they ask if I mind, my reply is Yes, I DO mind. I don't want you to search. A former FBI agent once told a relative of mine that people that agree to let officers look through their vehicles are fools.

Ok in many cases if you say no they bring a dog. Some how the dog hits most of the time, or sometimes they just Escalade it just by you saying no then your stuck there for an hour or more while they fish for something what do you do in that type of situation. From my experiences with local police they don't like no for an answer unfortunately no always leads to them trying to get something anything

Yea keep saying no since you're driving dirty and your attorney may be able to suppress the search some of those times versus never if you consent while driving dirty and the dog sniffs you out. I'm assuming the dog isn't alerting and your clean each of those times. Stop driving dirty-you keep getting caught. You're a criminal attorney's dream client with endless cases putting food on their table by paying those attorney fees.
That's not how this works - that's not how any of this works. They can only hold you as long as the traffic stop is supposed to last. If they hold you any longer file a complaint. They don't hold you longer because you (wisely) did not give consent. That is also a slam dunk evidence suppression when your lawyer requests it. Do you mind telling me which department? In Illinois, after you say no to the officer, they can call out a drug sniffing dog and another officer. This action allows them to take you to the police station. Once they have established that they are taking you to the station. They are allowed to search your car without your consent.
