    The whole theory behind Smith’s charges that Trump was deliberately trying to stay in power unlawfully or mount a coup is bizarre. As an ordinary citizen I don’t see anything like this in his conduct. No, this is sheer politics and banana republic.

      you're joking. trump incited the riot, and has lied about the election ever since. tried to get Georgia's AG to "find 11,780 votes, you can say you recounted," please remember that Trump's AG, Barr investigated the fraud claims and said that they were "BULLSHIT." this is the same Barr who wrote a summary of the Muller report, exonerating trump before he finished reading it.

    If they vote for immunity, why must it necessarily have to be grandfathered? If they vote for immunity, shouldn't that presidential status be applied only to future presidents and not past ones? Especially given the stance taken by some of these justices that this is about changing the status of presidents and not necessarily about Trump (Alito). Not considering it as something that would take effect AFTER the ruling (instead of winding it back four years ago) strikes me as specious and ridiculous. The elephant in the room, an orange one, is being strategically ignored even though the entire thing is about the protection of that very elephant who brought it before them. If they vote for immunity and Biden wins,, Biden could hypothetically have the military poison Trump or throw him in the slammer indefinitely and be immune from any wrongdoing. Not that he'd do that, but think where such a ruling might lead us in this country in its current state.

    CONSIDER THE FOLLOWING: Concerning Presidential Immunity: Kind of like a choose your own adventure. In a system of 'self governance' what do we, individually and as a society of individuals choose?
    a. A single person who has possibly the most power and authority on this Earth and is completely immune from all prosecution. If so, that is the path the nation would go down.
    b. No person is above the law, not even a sitting US President. A law in a small town is just as valid as the US Constitution. The law is the law. A sitting US President violates even a small town's law, the US President is held accountable for their crime. If so, that is the path the nation would go down.
    c. Some line in between the 2 extremes. Whatever and wherever that line is, that would be the path the nation would go down.
    * So, what path do we, individually and as a society of individuals, want to go down? Only 1 single path is allowed. Not choosing and one is automatically chosen for us, whatever system we have is the system we have. If we choose, what path do we choose? How exactly do we, individually and as a society of individuals, want to exist while we do exist? We do have choices especially in a system of 'self governance'.

      QUESTIONS: US President acting within being President:
      a. A terrorist is in a foreign city, and there are even American citizens in that foreign city, and the US President bombs that city to take out the terrorist, BUT many American citizens and Foreign citizens are no longer with the living. That would be okay? And sure, the foreign nation would most probably want to retaliate. But okay from the US President's perspective?
      b. Now another hypothetical: A terrorist is in a domestic US city filled with many American citizens, no other foreign citizens are in that city. The US President bombs that city to take out the terrorist but many American citizens are no longer with the living. That would be okay?
      Is there a magic number as to how many American citizens can be taken out so as to take out even a single terrorist? And even if there is, would it matter to a US President who was just 'acting within their job description' of taking out terrorists?

      The reason the founders chose impeachment over prosecution was because they foresaw it being used on every president and then down to the common man. The founders felt this would hinder the government and make it accountable to the common person who had the most money or power such as George soros.     I like this professor. No matter how many times the interviewer tried to make the conversation political and tried to smear the court, he kept it very neutral and discussed the law and facts impartially. A rarity these days from academia.

    No crimes were committed! Both commenters need to read Scalia on what an originality IS. Originalism is plain, normal interpretation. For instance, in a recent case the word “otherwise” was clearly abused by the prosecution and the attorney was “pinned” by the actual meaning in context. Obstruct, impede etc. At least the legal mind made an extraordinary effort to be fair- “alleged”….

    Help me out here. We had a president that lost the presidential election, this same president hired/asked a right winged militant group to force their way into the Capitol to overturn the electoral college vote by force and if need be causing bodily harm to the VP and SPOTH.
    A congressional hearing was convened, the result of this hearing found the president’s and his staff responsible for the attack on the Capitol. The federal prosecutor’s office proceeded with the indictment of this same president. This same president then filled an appeal for immunity for the attack on the Capitol, the 11th DC circuit court of appeals denied the appeal for immunity.
    Now this same president sent this appeal to the SCOTUS, and now the SCOTUS is going to determine if this same president is either innocent or guilty without hearing any evidence in this case? Is this what’s going on here?

      For many years I watched FOX 24 hrs a day, until Trump came on scene, When the Democrats started to say stuff about Trump, I couldn't believe the lies I was hearing. Trump couldn't be that f@$ked up. I live in Wyoming, and when Liz Cheney voted to impeach Trump I didn't vote for her reelection. So I did my own research, read books, watched the congressional hearings, downloaded the transcripts, read all the indictments, I managed to watch the opposing networks.
      What made me so upset I was so loyal to FOX I only believed what FOX was putting out, I knew nothing of Trump. Now that I learned the Truth, Trump needs to be locked up, like right now.
      If you have not watched the congressional hearings, don't bother replying. I know FOX and Trump were saying its nothing but lies put out by the democrats, "witch hunt" I believed is what they called it. But the truth is every witness that testified in the Congressional hearing were Trump followers, every one of the witnesses voted for Trump. Please find the truth yourself

Every witness that testified against trump were republicans that voted for Trump. In these hearings you will find the truth if the elections were stolen or not.     235 years it’s been fine. Leave it alone. Our presidents should have immunity in or and after they leave office of things they did while in office. Can’t punish somebody after the fact, and make up laws as you go.

      235 years presidents have always knew they could be held accountable for their actions. Why is this a problem for only Trump? Is he better than you? Whether you think he commited crimes or not, let's say he did. He orders someone to kill someone. If you did it, your ass goes to prison or death penalty.
