    If Constantino thinks the sinking hurt his company's reputation...then this lawsuit creates a new low. What a despicable lawsuit so shortly after loss of life on the Bayesian.

    The damage to their reputation was the head of the company placing blame on the crew before all the bodies were recovered. He damaged his own reputation by being an AH. No one wants to do business with someone who screams "not us, not us, we are not responsible" before any investigation has been completed. He showed they won't stand beyond their product. The company only has himself to blame.

    So now yacht owners not only need to worry their Italian Sea Group vessel will sink, they are risking being sued for the sinking by the manufacturer on top of it. This was a ridiculous move on ISG’s part , not to mention insensitive to all the families involved.

    My advice to Italian Yacht Group is to fire your top most management as they are doing irreparable damage to your company's integrity thru statements and actions. Now is the time to support surviving families not blame and point fingers which denigrates your corporate image.

    Constantino is straight up evil. To sue a grieving widow so soon after the loss of her husband is despicable. Add to that the fact that she also just lost her precious child…there are no words adequate to express how terrible this is. That man has no shame and no heart. If his company’s reputation is irreparably destroyed, it will be no one’s fault but his.

    So far, Mr Constantino has done more damage to the company's reputation than anyone or anything else. Sure, there is internet speculation but, if he kept his mouth shut, it would fizzle out at least until and IF the investigation conclude design flaws helped the sinking.
    Even the news of a forthcoming lawsuit only intensifies the Streisand Effect.

    I would never trust a company with a ceo blaming the client or the client's crew before even knowing the circunstances of the accident. He can sue whoever he wants, its damaging the company even further.

    If the company wants to play hard ball and sue they further open themselves up to a counter suit claiming a 45 degree down flood angle makes the design not fit for purpose and should never have passed the standards required for a seaworthy vessel.

    Constantino has completely lost his mind if he thinks that any loss of reputation is due to anything other than his own _unwarranted, egotistical & inadvisable media appearances..._ imagine if Porche's CEO was all over international media the day after Paul Walker's death, accusing Walker & his mechanic of causing the crash of his car before accident investigators had even started going over the wreckage. There's _no way_ TISG's lawyers are out there filing legal papers without Constantino & his buddies signing off on it... lawyers act on _client instructions,_ not general releases to do whatever they want. TISG were probably hoping to sneak those papers in before the investigation found out how dodgy their builds are... any claim that they "didn't authorise" the legal filings are just another lie from a bunch of people who in their hubris seem bound & determined to scupper their own sinking corporate ship.

    I worked on a perini navi 45m sailboat, did an atlantic crossing, and i can confirm that the main doors do, in fact, not hold tight, and we also had to tie the doors shut for the whole crossing .

    The "Italian Sea Group" is begging to be sued into bankruptcy. Their suit is truly shameful.
    There is a reason why such tragedies are investigated by the independent authorities, and suits between those involved wait until the authorities draw their conclusions.
    The lesson that is to be learned is that as a yacht constructor, you do NOT compromise on safety, even when the customer asks for it.

    The only thing/person causing any publicity damage is the CEO of the sailing company. His public appearance berating the crew, immediately following this disaster, and claiming his ship was unsinkable, made people see that he is a heartless and uncaring. Instead of coming out and saying that his thoughts and prayers were with the family of those lost. You know, normal thoughts of sane people.
    Had he simply done that, and then waited to make comments after a lawsuit was brought, people would maybe be more likely to stay with his company. And then, to bring a lawsuit against the yacht crew and widow???? INSANE!!
    Nobody is going to go with them now.

    I think that potential buyers are leaning away from the yacht company due to Constantino's blaming the Bayesian passengers and crew for the accident. Constantino has to look in the mirror for this one.

    If I was Capt Cutfield, I would seriously consider suing Constantino for defamation. Until Bayesian, there was not a yacht crew anywhere in the world that a feared that a sailboat with a ballasted keel - without sails up - would simply get blown over and not come back upright.

      They lost their mind when they built a sailing yacht that would remain capsized once blown onto its side. They doubly lost their minds when they didn't post placards all over the yacht warning of this danger.

    The builder should have fixed the salon door issues on all of the vessels produced as soon as it became known; one expects that all "design flaws" have been addressed when one pays that amount of money . Better check out the computer of the builder for emails from customers complaining about the the door issue and other flaws.

    The poor families having to deal with this crap now. From day 1 Constantino blamed everyone but himself.. Now even tho he says he didnt initiate the law suit its out there and cant be unseen.. He is the problem his customers are backing out. Had he kept his mouth shut till all the info was in and then said any flaws that arose would be addressed his business would have doubled..

    Sueing ahead of the results of the enquiry could be held as trying to influence its outcome, by paralleling the enquiry in one in an Italian court. The idea would be to get a civil damages award in a friendly court against the crew and the owner before the enquiry could conclude, prejudicing the enquiry.

    To answer your question "does someone stop buying "that car" because someone crashes it and dies?", no. Not even close to the same scale in any way (cost of car vs cost of vessel), Constantino et al made the claim it is "unsinkable". No door interlock should be able to be defeated, and if the door closes when the vessel is leaning over that much, it is a defective design.

    Poor woman. Just lost her husband and her daughter and now she has to deal with this. My heart goes out for her.
    This is not going to end up well, in my opinion. This is going to turn against him. If anything the builders may be one of the responsible for the sinking. This isn't going to age well.....

    Escape hatches would be a Classification Society requirement. If Class don’t specify it, then it doesn’t need to be built into the vessel. In hindsight yes it may have saved lives. I have worked military, commercial and superyacht as an engineer and still do commercially. I have questioned many times design faults that get signed off by Class. The Yacht designer will build to spec but at the end of the day it’s got to be given the green light by Class. This is something that is not being talked about much at the moment.

      Even on the inland waters of the Norfolk Broads, every sleeping cabin has to have a 'viable secondary means of escape', whether a hatch or a removeable window. The same 'viable secondary means of escape' is a requirement under the Recreational Craft Directive, which covers all offshore yachts built since 1996. Yet it seems that oceangoing yachts over the 24m limit of the RCD can legally be designed to a lower standard.

    Due to the center of gravity problems with the silly mast length, the heavy doors mentioned, the lack of escape hatches, the low area at the rear with the stairs down to that area so close to the outer railing, the unsecured keel banging around driving the decision to raise the keel when parked in deep water, IMO these are design issues that contributed to the sinking.

    How can he possibly do this when the investigation has not been completed and lets face it, the yacht was only unsinkable until it wasnt!!! How can you ever say something is unsinkable unless it passes the test of time in various situations. The court should throw this out. Is it not enough for the survivors to suffer those deaths without being responsible for a designers reputation? Im appalled that someone could even think of doing this. Even if all the people survived the boat still sank. A few more moments and those people could have escaped. The owner should 'counter sue' that there was obviously a design fault. The jury in court would have such a difficult time reaching a verdict.

    I'm pretty sure the car was Paul's but his friend was driving like a pissed off teenager. It was a full tragedy. Even Jay Leno testified the GT was safe when driven as intended.

      The original company was founded by Sig Perini, of the famous paper making company.. The Perini family then sold the company to …I think.. a hedge fund..in about 2015.. They then promptly bankrupted the company that failed in 2020/21. TISG only acquired it in about 2020.. Amongst the assets were a couple of hulls under construction at a sub contractors yard in Turkey, as I understand it.. Quite why Constantino didn’t simply and truthfully distance himself from the sinking, by explaining that TISG had only recently bought the company and had therefore no involvement in the design or construction of Bayesian.. defeats me!..That would have been the most sensible course of action in my opinion..

    The denial from the Italian Yacht Group sounds like a "non-denial denial": "We haven't sued yet but we have attorneys on standby!" From the looks of it, the Italian Yacht Group is trying really hard to find a scapegoat (including a Italian TV show blaming the crew). They are worried themselves about a lawsuit (fully warranted IMO) and want to make as much noise as possible before it happens: "We sued first..."
    With the 40-45° downflooding angle, even if all the hatches & vents were closed, there is a gap (with stairs) at deck level that would have flooded the cockpit and the saloon through the saloon doors. Such a low downflooding angle is unacceptable on a sailing yacht.

    Constantino only has himself to blame. Instead of doing what he should have done which would have been to support the victims, wait for the report and commit ISG to making any safety changes if they were deemed necessary. He chose to engage in a very crass and public blame game and I don’t think anyone in the industry is buying it. He’s created the impression of a very toxic company and I can only see that changing with him loosing his job for starters.

    Honestly this is shocking, it's the design of the boat, of course they will deny that it's not. It's obviously the design, it's not rocket science.
    Well everything was against this boat, own up to all the flaws and I hope someone can stand up to the Italians who are trying to save their reputation, and not even think for one minute what they have done or said to the sad situation which has arisen of people dying. No one will want to do business with this company who are thinking of money than people lives, for god's sake own up and pay the dues, simple.

      In my opinion only very few sea vessels are truly unsinkable. Some Coast guard rescue vessels are. They will automatically right themselves. I'm sure there are other unsinkable vessels, but this one was not.

    40° degrees doesn't seem like very much . I have buried the rail on several large sail boats to the point of the keel breaking water and recoverd with out incident.

    If this is true, then the only trouble came is from the big mouth person coming out to say that the sailboat was unsinkable after it sunk. If he had said nothing other than condolences to the crew and family would have been the best thing to say.
    Kraken yachts make there's can go around 150 degrees and be able to recover. It's not uncommon for a mono haul to get knocked down that is around 90 degrees and be able to recover really bad weather and rough seas. If everything is good then the mast will still be there.
    You probably will have damage to sail's and or other damage. But you will not become sinking boat.

      The yacht was built in 2008 and I believe it was classified by ABS, so it possibly wasn’t a requirement under their classification..

      Even on the inland waters of the Norfolk Broads, every sleeping cabin has to have a 'viable secondary means of escape', whether a hatch or a removeable window. Yet it seems that oceangoing yachts over the 24m limit of the RCD can legally be designed to a lower standard.

    Gerneral-Motors owning Opel, the German car brand gave Opel a complete van with the name Sintra. The first European crashtest proved the car deadly for the driver and was the first car that lost a star in the crash rating for that. Afterwards the car was not sellable anymore in Germany. The car was withdrawn from the market. PN has now a similar problem, but worse.

    Mr. Constantino appears to have single-handedly sabotaged his own company from within. While they deny that a formal report has been logged, the mere admission that they drafted one and began apportioning blame before the inquiry is quite telling.
    In my opinion, instead of trying to assign blame so soon after the tragedy, Mr. Constantino should have issued a statement saying they would work closely with the authorities to determine what went wrong. In the meantime, he could have announced that all models currently under construction would be reviewed to see if safety measures could be improved based on the information available so far.

    I think I am going to short TISG (The Italian Sea Group ) stock first thing tomorrow morning. The stock was at 11 dollars in april of this year.....but has been falling ever since. It is currently at 8.44 .........with this news out I can see it going to 4.00 dollars or lower. Let's watch and see what happens.

    I think the lesson from this is that sloops and katches are not good starting points to design a super yacht. You want a super yacht to have maximum stability, luxury and safety and you just can not get that with high masts and low freeboard. If you want big masts and sails you are going to be compromising on safety.

      The problem is that the design criteria for a sailing yacht and a floating 5-star hotel are incompatible. You can have one but not the other. I would argue, however, that if you ditched the 5-star nonsense and wanted to design a 56 metre sailing yacht, then a ketch rig is viable, but not a sloop rig.

      @@digitaurus If you really want the biggest mast in town you might need a surgeon not a naval architect. Sailing ships have survived knock-downs often before, for some odd reason bigger ships tend to have more masts [get a clue about righting moment ''naval architect']. Consider center line hatches to reduce flooding possibility. Being unstable beyond 40-45 degrees makes you a poorly designed motor-sail contraption not a sailing yacht. Then sue your victim - brilliant publicity move. In the end consider function not status symbol. This might just be greedy people taking advantage of the super rich who may know a great deal about something but not much of anything about boats. If you want a flying car you just end up with a very expensive lousy airplane that is a really second rate car.

    Any owner of an Italian Sea Group vessel would be insane not formulate a plan to divest themselves of it. It might not be wise to jump to a sale now but if they sense a lull in the coverage of this topic, I imagine they will pounce on the opportunity.

    Great job with the update. They have ruined their own reputation by how they have acted . Boosting the boat was unsinkable is ridiculous. Suing the crew and owners before the loved ones have been buried. The cause of the sinking is still a unknown. It was hit by a waterspout / tornado, and you blame the crew. Really? WOW I would cancel my contract on that basis alone. What are they thinking? They really need a new PR person.

    *Paul Walker* : I believe Mr. Walker was a passenger in the Porsche when it crashed. It was driven by the owner, who was a respected racer. He was speeding, and the tyres were old.

      Correct. The state of the tires on that Porsche was definitely a large contributing factor to the accident. Excessive speed for conditions was another one.
