Of course I do take notice that the interview here is for judgeship candidacy with the ConCourt. In the case of Hlophe it was for the High Court On an objective principle, this does not detract from the fact. Isn’t this, therefore, a classical case of what’s good for the goose should be good for the gander?

The Concourt needs a variety of experiences of which academia can be one. It doesn't currently have academics on the court. The apex court has not clothed itself with glory in relation to socio-economic issues and Prof Biltchitz represents a breath of fresh air and he has a much needed critical approach to ensure these rights are realized and justiciable. We need a higher level of judicial activism in realizing and concretising socio-economic rights, as opposed to more judicial deference. Prof Biltchitz, in my view, was hands down the most articulate and impressive candidate for appointment. I'm rather disappointed with the questions put by the majority of commissioners, which seem to elevate form over substance, and which do not appreciate the nature of apex court cases and adjudication. The Apex court needs fresh and radical new judges to improve rights delivery, not more of the same.
