    The 14th Amendment guarantees equal protection under the law.
    Technically, lesbians and gays who live in states where same gender marriage isn't legal can get married out of state and return home with legal marriage protection all thanks to the 14th amendment.
    I can't see the supreme court reversing the constitution. That would be unprecedented.

      Frank D Has SCOTUS ever ruled that the 14th permits those out of state to get recognition in their home state when it isn't legal?

      Frank D Ya but the problem with that is those state's governments will not follow the Full Faith and Credit Clause because they would argue since they live in their state state they don't have to recognize the marriage licences from the other state because the state they live in has banned it.

      jamesbo506​ To deny recognition of those marriages would be unconstitutional under the 'Equal Protection' clause of the 14th Amendment.
      With the Defense of Marriage Act struck down, states would be bound by the Full Faith and Credit Clause (Article IV, Section 1) of the U.S. Constitution.
      _I'll have you know I had to double check that one just to be sure._
      I think the Supreme Court played this one right. As opposed to Roe V Wade, where the court handed down the decision, in the case of same gender marriage the decision is coming from the people. Enough States have granted marriage rights to same gender couples that it's pretty much a done deal.
