    I've worked with charity telethons similar to Indieland or AGDQ, and we recently ditched one of our charitable partners after we started hearing concerns about their organization. It took us about six weeks to find a replacement, and most of that time was just trying to schedule staff meetings to go over our options. In six weeks, we found half a dozen potential charities that matched our mission, researched their financials, reviewed our options in a series of staff meetings, made a selection, had a call with charity we selected, and put out a press release about the new partnership. We definitely never held a fundraiser for no-one while we were looking and we didn't pretend we were partnered with people we weren't.
    Ten years and they couldn't find a charity? Three years and Jirard never checked where the money was going? And then another TWO YEARS after he was made aware of the issue where he couldn't move anything forward? That strains credulity to the breaking point.

      It's sad, but I think he mightve done it because of her. Some people can dilude themselves into thinking "She would want me to have this money, she my mom of course". 10 years of that, and I can totally see him justifying it. That's one of my theories lol

      I think the worst part is inflation, because it's a non-profit they don't gain any interest on the money in the account AND it's been losing value for more than a decade now with 0 merits to offset the losses.

    The money needs to be donated now, simply to confirm that there is money to donate. The donors need proof that the money hasn’t been embezzled.

      In Muta's video, Muta shows more of the call they had with Jirard. Jirard says that he was about to donate it. But wants to know what Muta and Karl think he should do. They both say that at the very least it needs to be donated and preferably to the places Jirard had been saying they would.
      That was a week ago. Still nothing. The longer this goes on, the more likely it seems that the money is not actually there. Or they're trying to put back whatever money is gone before they donate.
      Also the Privacy Complaint from Open Hand against Karl's video just makes everything look even more suspicious.

      It doesn't even have to be donated to simply prove it's still there. All it takes is a simple document that details the account balance, it's extremely easy to do. Even just open a bank account page and snap a photo of the screen with the total amount of cash. It should take them less than 5 minutes to produce compelling evidence they still have the money. The fact they didn't bother to do this much after so long is enough for me to believe they stole at least some of it.

      He can't do that. If he gets the money dumped now, then his brother is going to prison. Someone by now has contacted the IRS. If they dump it now that means they could have done it years ago. Jihaird said something that ruined his own legal defense, and he can't commit to doing what he said he would.

    So I'll boil it down.
    They raised $780,915 for charity, but only $655,520 is left in the account. $0 was given to charity and 15% was taken for "misc" expenses. Open hand is family owned and isn't a large charity, so $0 went to employees or equipment according to the filings. Jirard said directly that he only found out in 2021/22, and that they were looking for an organization to give the money to. Between 2014 and 2023 Open hand has said via events and website that the money will go to "UCSF Memory and Aging Center". So even after Jirard supposedly found out he still told audiences "every cent" would go to UCSF.
    As the director at the very best Jirard would be guilty of gross negligence. Having no knowledge or care about the money he was himself raising for charity to honor his dead mom. At the very worst the entire thing was an outright scam to build a nest egg they can either pull money from, or it is all actually gone.

      That amount being spent on operating costs is actually very low for any foundation, so that's not a particularly big deal. Something they don't state in this video is that Jirard was actually listed as the person who would be searching for where the money is to be donated to when the foundation was first created. Even if he was actually negligent in checking where the money was going to until he was informed it was just sitting in a bank account in 2022, he still had over half a year to buckle down and find somewhere to donate it to, and lying that it was going somewhere just weeks ago is just wrong. There's more info out on the newer videos that shows hundreds of thousands that were supposed to go into the open hands foundation just vanishing before it did, so it really looks like they were pocketing a ton of money.

      @@Domar7431 No that isn't a low amount at all. $125K for a glorified fundraiser is very high. You can't compare it to a giant charity organization. Open hand had no employees to pay, and on stream said the equipment and space was given to them so every cent can go to UCSF. My OP is 11 days old so I didn't factor in the golf charity here. To which yes probably another $600K is missing/unreported. and I'm not just making that number up either. The golf charity events tell you their sponsors and prices. Just this year Open Hand reported to have raised $144K on the golf charity alone.

    I can totally see a world where someone, either his brother, father or a third party, told Jirard to be the face of the project while they'd manage everything in the background for him so he could focus on his own channel, etc. And I can believe Jirard when he says he wasn't aware that no donations had been made prior to being told.
    But even then, according to his own words, he had two years to set this right, yet continued to talk about all these contributions the charity made while no money was handed out to anyone. Even if his first instinct might have been to protect, say, his brother, he should have realized this was a terrible mistake and would eventually come to a head.

      I believe this is what happened. He was used by his family members, and then after he found out, he made the (very wrong) choice to protect them, by keeping the narrative. The reason why the money was not donated since he found out its because the money is not there, either partially or entirely gone.
      Jirard needs to come clean, soon, as things are just getting worse for him with time.

      @@RedLuigiGames I hope this is the case, personally-- Jirard has always come across as a pretty genuine and caring person, would suck if that was just a fake persona for so long. At least if it was a family member I can understand why he stayed quiet-- nobody wants to get their family members locked up for fraud, even if you know it was wrong of them. I sure as hell wouldn't, and I'm glad I'm not in a position where I'd have to make that choice and get lambasted by the internet over it.
      If he's complicit in it though, that'll be rough.

      @@opo3628 Possible. What gives me pause is not any trust on his character, but how miopic this is. He does not need this amount of money, and just stealing the money is something that can be easily caught by someone looking at the right place. Why risk what he has going on for 500k? Why not actually donate the money, use it for content, get more donations next time, and raise administrative fees to 30 or 40% and get both money and praise for it? Even taking Jirard as a bad person, if does not make sense to me that he would risk his career for an amount of money he can make himself.
      But if the career you are risking is not yours? It makes more sense to me.
      But maybe he is just short sighted. That happens too.

    The frustration for me is if you said that you are unable to find a reputable charity to donate to, and after 9 years no money has been donated because “none meet the standard”, then why continuously take people’s money? Why not be transparent? This could have been completely avoided which leads to gross negligence or knowingly committing fraud.

    All of this smells so bad... There are already multiple layers of lies regarding what they did with the money. When you understand that a tax filing is just that.... a filing.... This could get way, waaaaay worse. The IRS is not omnipotent, you can lie on your tax return and never get found out, they can ask the bank to check your account but if you don't raise any suspicion or they are otherwise too busy, they simply won't.
    The account could very well be empty is what I'm saying.

      Those 2 things are not the same. We are not talking about evidences here, we are speculating.

      Not just complicit, he's actively involved, he's had charity streams since finding out (by his own words) and in those streams he's lied about the money.
      It's not just that he hasn't said anything it's that he's actively participated in it.

    If he really didn't know that the money was being hoarded until 2021, then he's had two years to say or do something that he spent doing sweet fuck all - except he did keep lying about donating the money, which absolutely makes it look like he knew all along. He could have said something publicly, or just had all the money donated to UCSF since it's the only benefactor listed on the foundation's website. Of course, he didn't do that, because Jirard has been siphoning away thosuands of dollars of donated money as "expenses" that personally benefit him and his family.

      Let's be real, if anybody is "siphoning" money from the charity it would probably be a family member since Jirard makes plenty from content creation. Regardless the expenses make sense given they have put on yearly fundraisers which also satisfy the expenditure rule required to be a non-profit. Absolutely should be raking them over the coals for this but it's dumb to make wild and unsupported assumptions.

    The thing is: we actually have no idea if the money is there. Tax filings are not proof of the state of whatever bank account this money is on.
    Also here's some food for thought: if you were in their situation and you indeed still had the money, what would be one of the first things you'd do to save some face? That's right, you would provide undeniable proof you still have the money, to instantly quell all speculation that you stole it. Jirard already said so, he said they still have the money, so why not provide some evidence that this is true? Should be very simple if it's true, and it would be a no brainer move to stop wild speculation and prove you're not lying. But... they did not do that. And the fact they did not is VERY alarming.

    as someone who had to live with my beloved grandma degrading from dementia and to know others who have the same thing happen get their money Stolen basically on a scam pisses me off to no end. The pain of seeing someone you love or admired become a shadow of their former self is beyond heartbreaking and to think this mf used his own mothers demise for this sham of a charity.

    One of the other ways a charity could defraud is not just in their expense side of account, but their income/donations sent to them. Its quite possible that donations could be even higher than what was filled. I think both sides of their books should be audited.

    I don't know what to make of it. I have theories, from the best case scenario to worst would go something like:
    1) Sheer incompetence, he actually didn't know. Well, someone did fill IRS forms each year, so someone must have known!
    Best case here is he's covering for his brother who was the one who f-ed up.
    2) He has some weird mental thing going on or a trauma from his mom passing. For example "I can only donate when I'm sure they cure dementia 100%.". And since no one can promise that - he holds onto the money, waiting for a golden goose.
    3) laziness.
    4) goes downhill from there into a malicious territory.
    I'm afraid he really risks going to jail right now, because somebody is bound to investigate and the CEO will be the one to answer.

    Infuriating… the time sitting doing nothing, the fans who gave in good faith, the money just sitting there uninvested and not contributed to any claimed charity. What a waste and a scam, with no reasonable excuse to give over this length of time.

    I've seen enough streamers and youtubers seem to fail at basic business/common sense that I'm not that surprised. Stuff like this is why I prefer to donate directly to charities I've researched.

      @@furicuri3Because people are more willing to listen to people they like. If people you follow and admire (celebrities, politicians, religious figures, etc) are sounding the bell for donations for a specific cause, you’re much more likely to listen and take it into consideration. A lot of charities reach out to influential people because of this. They NEED the advertisement so that the public is made aware of the organization. This isn’t new to RUclips or anything, this has always been the case.

    Its hard to think of a better case for fraud charges than what's here. I'm sure there is. But I'm at a loss to think of one. It's not incompetence. They're claiming "expenses" against this money. Thousands of dollars in "expenses" on money that is never, ever getting used.

    You can see by the money, they haven't really increased their fundraising either, to Preach's point, maybe having some photos or stories related directly to the proceeds of last year's charity program would help raise even more money.
    Instead they just run another back and just use the same script, raise the same money and it goes into the bank to waste away. It really makes no sense unless someone is taking that money.
    As we've all learned since 2016, it's clearly possible to run a charity for decades in the US that just keeps the money or spends it poorly and the IRS doesn't care. Unfortunately these charities are caught be reporting, not the authorities.

    Actually no cuz there is a 5% rule where atlest 5% of the funds have to go to help the community every year you can't just bank it for 10 years like they have been doing ... also saying the money is going somewhere that it isn't isn't legal either

    Many charities have what is call "Restricted contribution" meaning the donor can dictate where the money goes, medical staff, research, ect. and they can exclude admin. overhead...it literally looks like you made more progress in 30 sec. in finding a charity than he did in 3 years...and you can also find all the stats on overhead percentages with each charity with a google search...does he expect us to think he must inspect the labs in order to decide if a charity is "Effective"?...and then after he knew, he didn't stop saying they were donating to the two foundations he mentioned...

    So dissappointed and just appauled by the shear negligence at best of this whole situation. I've donated to this in the past myself and there is no way I would have done so if the money wasn't ear marked for an event/chearity. Goes to show just donate to the charity directly instead of thru some youtuber.

      It's not even negligence. It can't be when Jirard knew that the money was just sitting there for over a year, while still doing fund raisers for it, while also saying it was actually going to good organizations, even though he said that they couldn't find a good place to send it too. Not to mention someone at Open Hand tried to get Karl's video taken down despite it being nothing but facts.
      It's just fraud. Not negligence.

    The think that makes me wonder is as Preach said, you make a big deal when you actually donate to a charity, especially one that is supposedly close to your heart and has affected your lives. Pics, big cheques, news events, all in fact great exposure for your foundation and business.
    Why has it taken nearly 10 years for this lack of any activity to be noticed? I know most regular Joes might donate a few quid and not give it a second thought, but surely people like Jamie Lee Curtis has people who check up on things like this, or all those massive companies involved in the charity golf events. Are you telling me Pepsi, Monster etc just chuck money at random events and don't make sure that event isn't just stealing the money?

    Going to guess what happened:
    Brother dealt with the financial side of the charity.
    Brother stole a great deal of money from it.
    This guy only found out about it in 2022 (was probably given the run-around by the brother).
    They kept the issue hidden while trying to figure out a way so the brother and possibly himself don't wind up in jail.
    The issue is revealed to the public.

However, them spending 110k on admin costs that does not benefit research in any way, just fine. Doesn't seem like very sound logic, in my opinion. As little as that is worth.

    You know... this makes the situation him being involved with giveaways a bit... skeptical. I remember a few times where he was in another stream and he said something about that streamer's donations and if the goal is met, he'll throw in Nintendo Switches for grabs for a chance for people to win. Like I'm pretty sure that's the money he earned from him being a partner, but this isn't a good feeling at all when he has something EXTREMELY SUSPICIOUS.
    What I don't get is... why not get in touch with an organization like Preach mentioned earlier in the video? Once you make a connection, find a common ground and acceptance, then do the whole charity thing. Like... I'm not sure, but... isn't that... simple? Yet, he hasn't done it for more than 10 years? Like... 10 years... People have gone through school, graduated, look for jobs, and all of that, yet he can't find an organization for the donation to go to in honor to his mom. I have this feeling that if his mother saw all of this, she'd be turning her grave right now x.x
    Also, couldn't people ask for the money back with inflation seeing as Jirard failed to do his part? It's their money, so... I don't know...

    I can see Gerard being completely in the dark in the severity of the issue if he relied and trusted his brother and family. Its really easy for someone who had close ties to their family, to buy the excuse, it's fine. Don't worry. We're good bro. Family can be such a blind spot for people and you rationalize alot for them.
    And then when you do come to your senses, you're in deep and have no idea how to get out.
    He's still 100% responsible for this mess, and he deserve the consequences of his action/inaction. I just can see how he got here.

      I agree insofar as a number of smaller bad decisions which maybe don’t seem major in isolation can add up to both look, and be, incredibly bad. I don’t know how much that applies here given his admission that he found out a year or two ago. At that point, even if he had no prior knowledge or involvement, how does it not realize that the situation is a catastrophe from a moral, PR, and potentially legal standpoint?

The people running that foundation couldn’t be bothered to even donate $10k or $100k just to pretend like they care. Any donation would’ve diffused the time bomb somewhat.     Ive always liked Jirard but his silence is damning. It doesn’t only affect him either. The FPS podcast that he used to be a part of probably had a real difficult time putting out their response but they did as good a job I think was possible to be completely transparent but respectful.

    One thing to consider is that while the majority of the money is still in the bank, or appears to be, the charity still paid operating costs. What are these operating costs? Do they include a salary for employees, most of whom appear to be family members? Without a breakdown of the operating costs there could be some money being used inappropriately from that column and we'd never know. A steady job or supplemental income from a charity that's holding onto the money it gets sounds like a nice and easy way to commit charity fraud over a number of years. Unless we get a 3rd party to audit them we may never know if this was intentional or not though.

    Alot of people are talking about this but Jirard has been very very quiet since all this started. Definately some shady stuff happening, if this was just incompetetence then Jirard would and should be able to fix this QUICK but he hasnt which means he is hiding something and trying to cover his tracks.

      i disagree, i think he knew EXACTLY what he was doing, why? because if he was convinced what he did was right, why did he lie about supporting SPECIFIC charities when he didnt? if you think youre doing the right thing you dont lie about it, he wouldve been "hey we dont have a specific charity yet but all donations will be saved until we find a suitable charity to support" but you know why he didnt do that? because then people wouldnt donate and he couldnt pay himself via "expenses"

      Having watched him through the FPS podcast the past year or so, this is my takeaway with the evidence we have now. I don't think Jirard intended to do anything malicious (no idea about his brother) but he definitely was negligent. As you said, I think he was in way over his head. I'm curious to see how this unfolds as more information comes to light because I suspect there is more going on behind the scenes with his family.

That's usually the kind of work you'd delegate especially if you need to work many hours on recordings in multiple channels, actually playing the games and managing an entire brand.
      Still if this is the case he still should've paid more attention to it and if he couldn't handle the workload to at least keep close tabs on it he shouldn't have been the main name on it. So if this is the case it's clearly gross negligence.

    I'm not saying anything shady is or isn't going on. I don't know enough about the situation or care enough about the completionist to render judgement.
    The difference between Mike raising money and them raising it is fairly simple though. Mike raises money for specific organizations, they raise it for the foundation. Both Mike and Indieland then hand over the money to who they say they will. What the foundation then does or doesn't do with it, is a different thing.
    As a gut feeling, I think that there is someone in the foundation who has completely unrealistic standards. It doesn't seem ill-intended, just overly anal. Finding a charity and vetting it are 2 different processes and if you have someone in crontrol of the money who has unrealistic standards, the money won't get handed out because you can always find SOMETHING wrong with any given charity.

    another thing that i don't think was in Karl's video on the matter but was in Mutah's version was how Jirard responded to these things on that discord call.
    it might be a bit off but it went along the lines of "i wanted to donate this, but when we received the email about this i knew this was coming and it would look bad to us if we donated it then"
    then later on went on about how Karl and Mutah are only doing this to gain fame (fairly sure both Karl and Mutah are bigger than Jirard at this point) and how this will just make Jirard look like an asshole.
    basically constantly stating that no matter what he does, he will still be the asshole in this situation.
    to top it off, he "knew" this was going on supposedly for atleast 1+ year, enough time to find a sponsor and take over since your brother can't be trusted, why not donate to that charity he mentioned literally every stream?
    Mutah made a follow up video on some of the criticisms they were both receiving following their videos going live.
    for example that both Karl and Mutah ambushed Jirard with that discord call, so Mutah posted a screenshot if Mutah and Jirard talking in DMs about hopping into a discord call to explain himself, which Jirard agreed to and wanted some time to prepare himself, Mutah wanted the same thing so it worked out.
    Mutah actually didn't even expect Jirard to show up, but he did to his credit (although a very stupid move)
    this story gets really weird all around, like what is going on in the background, because everytime they file their taxes, they put gifts etc to 0, apparently Jirard (the 1 raising the money) knew nothing and at best only knew it for 1 year, but still proceeded to do nothing.
    I wonder all the others involved are thinking, think i've seen some people already pulling out and be like "yeah, not dealing with this hot mess"
    but as Preach said, why not donate it and then show the check on the next event.
    racking up 100k a year for charity is very good, why not show it off and garner more donations from that, people tend to hold on for a bit to their money, but once they see some donate they'll slowly open their wallets.
    once they see that their money is going to the cause they were donating for, they'll gladly donate again or more and even inspire others to do the same.

      That's what it seems like. Holding up enough and waiting to cash it all out at some point and ditch everyone.
      Even if you believe there's plenty of untrustworthy charities out there, which there definitely are, you wouldn't take 10 years searching and NEVER find a single one. Or hell at least be able to donate some of it to hospitals in need! You don't even HAVE to donate it to a charity specifically.
      It's definitely them wanting to hold it for themselves.
