Hi Samfiru. Thank you for all the information you provided regarding the Maternity/Paternity leave. I have couple of questions:
My wife is going on extended parental leave. As a husband I want to take off few weeks/months as well. I have my 2 weeks paid vacation and I think by law I am entitled to 2 weeks paid parental leave that is a total of paid 4 paid weeks. Now, I am planning to add few weeks(maybe months) unpaid paternity leave to go outside CANADA with my family.
1-By law, can I ask my employer to have them all together at once (the total of paid and unpaid weeks)? And do I need to take them right after my baby is born or I can take them later?
2-the weeks/months that I 'll take would be deducted from My wife's paternity leave?
3-Do I need to fill up a separate paternity application?
4- Do we need to inform the E.I we are going outside Canada and Would my wife will get paid if she stayed the whole paternity leave period outside Canada?
Thanks for your help in advance.
    Ray/ Ontario/ Canada

Can you take pregnancy and Parental leave if you are on probation? My friend has worked with the company 1 year as a contract worker, and just became permanent at 6.5 months pregnant.

If you are returning from mat leave do you have to sign a new employment contract upon returning? The company has not changed hands but have made new changes within the company but my job title has not changed.

No, your employer can't force you to sign or accept a new employment contract if you are already employed with the company. And in order to make any new contract you sign legally binding and valid, you must be given something in return, such as a bonus or additional vacation time. If you are fired for refusing to sign the new contract, you would be owed FULL severance pay. Be wary of new employment contracts, as they may contain language allowing your employer to add more duties to your job, or reduce your ability to get full severance pay if they fire you in the future.
If you need your contract reviewed, and work in Ontario, Alberta or B.C., contact our team at 1-855-821-5900 or Help@EmploymentLawyer.ca for a thorough examination of the agreement and what your rights are.

What is the salary % that is being paid during the maternity leave?

      Hello Ankit,
In Ontario, somebody on Maternity Leave would be entitled to claim EI (Employment Insurance), which would provide them with 55% for the duration of the pregnancy and mat/parental leave.
Any additional amounts received would have to be through a policy or agreement with the employer.
