      I was walking back home one night from an eye appointment at the hospital - I threw up in the gutter - didn't know then but it was the beginning of a serious illness that would see me staying in hospital for a week. Drunken vomiting yes - as it's self inflicted but sometimes sickness happens.

      Massively disagree. Even if you're drunk, you can hold a piss until you find a toilet or get home, people who just piss in the street are either disrespectful or lazy. Vomiting can't be held in. If you're drunk, it's often vital that you're sick to get the toxins out, plus some people might be genuinely ill. Either way, you can't hold vomit back for nearly as long as you can urine.

      Kids can be at the hospital and be discharged at that time and the mother could put them in car strap them in and he hits her car
      Or the kid could be coming home from maybe grandmas home , maybe mom was working late and could only pick them up at that time etc
      It ain’t wise to get behind a wheel pissed is it
      He can’t even walk he’s like bambi on ice he needs the police to help hold him straight

      The driver who'd been caught driving whilst WAY over the relevant drink-drive limit, probably knowing the evidence would be strong against him, wisely pleaded guilty to what he'd done, with a well-deserved months-long driving ban given the seriousness of what he'd done.

    In the mall I work in as security, the amount of people you see drive in.
    Park up.
    Then come back at 10pm, 2am, 4am trying to get back in their car is crazy!
    (I should add….people who are completely out of it and can barely stand up and attempt to get in the car).

      1st offence, the 12month ban should be enough. 2nd offence should be 24months in prison & 24 month ban.
      3rd offence should be 5yrs in prison and banned for 10. You gotta have a light at the end of the tunnel else you have nothing to lose anyway. That’s why lifers are dangerous, they got nought to lose.

    I remember watching a video shot in 1967, the reporter gave back the man his keys. The attitude back then was shocking. This was just before drink driving was illegal, but became it the same year. At least we are more aware of what alcohol does to us. It speeds up/releases other senses but syphons ur energy off the driving side. Drink further ur senses bash each other about and you are out cold.

      Depending on how drunk they are and their overall behaviour, they can be arrested for being drunk and disorderly. Usually though given the limited amounts of police resources and cells, if someone isn’t being overly aggressive or being so drunk they’re incapable of looking after themselves safely, chances are they’ll simply end up getting herded into a taxi or told to go home.

    One thing I would like to see everywhere for drink driving, is a ban from drinking as well. If they can't stick to the drinking ban then don't bother giving that person back their license, they will drink and drive again. They just can't help themselves. And alcohol is responsible for more than 2 times the amount that heroin and cocaine added together cause, that's pretty dangerous and it is a drug. It's just taken too lightly.

    Drink driving should be a lifet8me driving ban and £20,000 fine.
    Similarly for other crimes, the sentencing is way too soft.
    Make the sentence the deterrent and only the absolutely hard of thinking will commit crimes. No sentence is an absolute deterrent but really harsh sentences make most people think twice.

    .. and he has to go to a doctor of DVLAs choice the cost of which he has to meet , and then reapply for his licence , if he wishes he could get his licence back a bit earlier if he completes a drink drug driving awareness course. Nobody will insure him and if they do it’ll cost him brewsters. He probably lost his job too..

    My brother had his last car smashed to pieces last year by a drunk driver, who was well over the limit - he was parked and inside his flat when it happened. A witnessing neighbour called the police and they informed my brother about this. The drunk reversed into my brother's car, smashed and repeated again, but this time, smashed my brother's car into another car before driving off over the mini roundabout and being caught by the police. He was then arrested and disqualified from driving for a long time.

    Busch NA still has alcohol in it, a very low amount close to 0.4% but still alcohol. Honestly could probably still get a DUI with an open container charge. I don’t know for sure but just assuming If it was pushed you could definitely be screwed.

      Exactly they tried banning alcohol in the US in the olden days and it created all kinds of illegal activities and funded crime. If they can manage to make strong alcohol in prison with next to nothing then the average person with the right ingredients and access to google could probably make some really good stuff.     My cousin was killed by a drink driver she was only 25 her daughter was injured and after the funreal we went for the wake and all the men sat at the bar drinking lots of pints,, they were all saying what thed like to do to this driver. They then got in there own cars, well over the limit and drove home themselves. I never once drunk and drove. After this I decided never to drink ever again. This was 25 years ago and not one drop of Alcohol has touched my lips. I think the legal limit should be zero and I also think pubs should play apart and if you prove your the driver all soft drinks should be free.

    One of the police officers said that most of her work is caused by alcohol and that if it was taken off the market she would be out of a job. Wrong. It would give her and her colleagues time to investigate, may be even prevent, other crimes such as robbery, shoplifting, mugging, vandalism, . . . . . . The police will never be short of work.

      I was friends with a woman who was caught out on the morning after a big drinking session. She was still drunk at 8am. She lost her license for 12 months. (Quite rightly, it was a stupid thing to do.) Depending on where you live, losing your license can be an absolute nightmare. If you live fairly rural, as we did, with not a great deal of public transport options, your life becomes a nightmare of begging lifts, using taxis when you can afford it, walking long distances when you can't. 14 months is an incredibly long time for most people to be completely immobile and I think is absolutely fine as a punishment.

      No such thing as an "Arrest warrant" for drink drive. It's arrest without warrant. Warrants for arrest are issued by courts. Offences that police officers come across on patrol are usually nothing to do with a warrant and one is not needed for their arrest. Sometimes you do stop people in the street acting disorderly, obtain their details and perform a PNC check which reveals they are wanted on a warrant or on recall to prison though.

I'd hate to work for a shitty corrupt government and not having the ability to discipline people physically in my ways who ask for it, is very annoying. Getting punished as an officer for giving someone something they deserve is ridiculous so I can understand they're stress. They're underpaid on top of all that so its not even worth it.

      @@Chonoryokusha What she is saying is that they want police to retaliate, and are trying to escalate situations or get 'clips' of an incident which takes things out of context. For example, lets say the police taser someone, and it's being filmed by a member of the public - they might only show the part where the guy gets tased and scream about police brutality - but what you don't see is that the person who got tased might have been attacking a police officer and left them with a bloody nose or something. This is the danger police face and why they have bodycams these days. I remember one episode of traffic cops several years ago where a suspect goes berserk on the police after they stop him and put him in the car, he gets out and starts wailing on the officers, to the point one officer is left on the ground, unconscious and bleeding from being keyed in the face. The officer's partner even thought he had punched the suspect during the melee and was in absolute shock in the aftermath (film evidence proves he didn't hit the suspect but heat of the moment things do happen).

      The approach to the imposition of a custodial sentence should be as follows:
      1) Has the custody threshold been passed?
      A custodial sentence must not be imposed unless the offence or the combination of the offence and one or more offences associated with it was so serious that neither a fine alone nor a community sentence can be justified for the offence.
      There is no general definition of where the custody threshold lies. The circumstances of the individual offence and the factors assessed by offence-specific guidelines will determine whether an offence is so serious that neither a fine alone nor a community sentence can be justified. Where no offence specific guideline is available to determine seriousness, the harm caused by the offence, the culpability of the offender and any previous convictions will be relevant to the assessment.
      The clear intention of the threshold test is to reserve prison as a punishment for the most serious offences.
      2) Is it unavoidable that a sentence of imprisonment be imposed?
      Passing the custody threshold does not mean that a custodial sentence should be deemed inevitable. Custody should not be imposed where a community order could provide sufficient restriction on an offender’s liberty (by way of punishment) while addressing the rehabilitation of the offender to prevent future crime.
      For offenders on the cusp of custody, imprisonment should not be imposed where there would be an impact on dependants which would make a custodial sentence disproportionate to achieving the aims of sentencing.
      3) What is the shortest term commensurate with the seriousness of the offence?
      In considering this the court must NOT consider any licence or post sentence supervision requirements which may subsequently be imposed upon the offender’s release.
      4) Can the sentence be suspended?
      A suspended sentence MUST NOT be imposed as a more severe form of community order. A suspended sentence is a custodial sentence. Sentencers should be clear that they would impose an immediate custodial sentence if the power to suspend were not available. If not, a non-custodial sentence should be imposed.
      The following factors should be weighed in considering whether it is possible to suspend the sentence:
      courts do not consider whether there is room at the gaol available, if custody ordered then so be it

      @@johnpaulcawley4079 Not true. Doesn't work. Had someone try it with me at the roadside 3 and a half years ago, he blew 45 (legal limit being 35) at the roadside. Arrested. Put on evidential breath machine at custody and blew 57, in other words he was "on the way up" and had not yet reached the peak point of alcohol in the body. Sent to court and was banned from driving for 12 months, took a driver education course and got his ban reduced to 9 months, had to pay a fine of £500 and costs of about £250.

    Interesting. The 442 pounds payment seems to be very low. Also, the police in the U.K. seem to be far more lenient and patient than the police of the U.S.
    If the drunk friends behaved and were as belligerent and threatening as they did on this video, they likely would be arrested as well, taken to the ground by force.

      he was double the limit ie 60 to 89 in breath this equates to 17 to 22 months ban. you can reduce the ban by 25% if the bench offer the drink driving awareness course which they have pay for and costs about £300. seems getting 14 months the tv have discounted it already for the programme as i would be very surprised the court would move down a grade to 12 to 16 month ban. For me in court I view it as a range 60 to 89 and 17 to 22 months, so 70ish is about 20mths. also need to note length of time driven drunk and time of day and other aggravating factors. fines are wage based and this attracts a C band which is 150% of wage less 33% if plead Guilty early. then court costs £85 for guilty plea and a surcharge of 10% of the fine minimum £34 at the mo. this charge is paid to a fund which helps victims and witnesses in the system and nearly all fines attract it. if unemployed £120 weekly wage assumed and if not declared then £440 pw used. if it is a second offence in 10 years then its a minimum 3 year disq.

      At least in the UK it’s a minimum 12 month ban and disqualified driving us enforced. In the US you get a ticket for driving on a suspended license.

      The issue there is reacting that way to every drunk very quickly leaves no Police out on the streets. All queuing to book prisoners into custody, which in the best of circumstances (compliant prisoner) takes 20mins, and with an awkward customer can be 90.

Where I police even a compliant prisoner with MINIMAL property (i.e phone, wallet, keys and nothing else) AND assuming you are first in the custody door and not stood outside or in a holding cell, still takes probably closer to 45 minutes, they spend 10+ minutes just doing the rights & entitlements and risk assessment questions.
      Worst i've seen our custody recently was a 5 hour wait, 7 people waiting to be booked in and the queue going out the door and down the bottom of the station yard not far from the entrance/exit gate for job vehicles. That's a 5 hour wait JUST to get into custody and start presenting your detainee to the custody skipper, and doesn't include explaining everything or booking in the million and one items they decided to bring with them to custody.
      Longest i've personally ever had to wait was nearly 3 hours.

    this punishment is a joke comparing to LATVIA. Here you would get Something like 1000 Eur fine, something like 14 days in jail, your vehicle confiscated for good, and 4 years driving ban. After that 4 years you can reapply for driving exam and get new drivers licence, but you receive it with 8 points on it and after getting it you have 2 months time to attend safe driving school, that costs something like 200-500 Eur. If you dont. You get additional 2 points on your drivers licence. If you reach 12 points on your licence, it gets taken away again.... So basically, if you get caught, you're literally FUCKED :D
