What should I do? I'm 100% there was no red light and the photo doesn't show red either, just feels unfair to be forced to pay it and the 3 points hurts as well, would you fight it?
I was in exactly the same situation as you. I got fined in December. They initially rejected my review request, so I chose to go to court. After a couple of weeks, I received a letter stating that there was no action against me.
They knew there was something wrong with their camera.
I'm from Perth. If the photo doesn't show a red light, they can't prove you ran one. Fight it

It is clear that you entered the intersection on a green light leaving you 100% in the right and them without an argument.
Applying to have this proceed to court will force it higher up the chain of command. They will look at it closer and withdraw the fine rather than defend this injustice before then court.

So did you fight this? Did TCO withdraw their infringement? Keen to know as I have a similar situation for a person i know who is going to court too.
I applied to go to court, literally yesterday I received a letter saying the infringement was withdrawn! Took about 2 weeks. They are just trying to bully people into paying, disgraceful
I just got the same fine and all the lights are green as well. What was the process for appealing ? Can i just threaten them with going to court if they reject the review.

I was exactly the same. My review appears to be have not been a proper review. I would recommend applying to go to court, I would also submit a freedom of information request for the maintenance records and all the details of the traffic light (costs $30). What I found was that 2 weeks later my fine was withdrawn and I was offered a full refund on my freedom of information request 👍

I agree that it looks green in the photo, but the colour balance is really bad. Even if it was red, I don’t think it would be very visible in that crappy picture.

Fines and demerit points can have a real impact on people’s lives. IF it was red (it clearly isn’t), they should be providing indisputable evidence.

Amazing how they cannot provide a 100% clear photograph of this supposed red light in the first place. Also when you questioned the infringement how they couldn’t downgrade the matter to a cautionary notice given your alleged incident was only 0.6 of a second after the light change anyway.
Seems like they just want to raise revenue.
They were very nice to me on the phone when I first called but then their attitude completely changed when they realised the intersection. I think there is something fishy going on here… time to fight the fine

Jeez, it's bloody criminal that you get a record for contesting, they have you by the goolies. I hope you fight it and with a competent lawyer you will win.

Unlikely that you'll end up with a criminal record if you lose. Most magistrates appreciate that a criminal record is an undue penalty for otherwise well behaved citizens.
Fight it in court
In January I drove from Corowa to Melbourne and couldn't believe the proliferation of cameras. It seemed that that revolting weasel Chairman Dan had put a camera up every 5 km on the freeway. It's bad enough at home in Sydney, but after my Victorian experience, I'm sure glad I'm here and not there. Fight it brother and hopefully add your bit to the task of making the 'state' more reasonable. It really is disgusting. Cheers - Dave

We moved outta Melbourne a few years ago now. Lived in Richmond but way too busy too many people cars too many cars and too many cameras. Much less out here in the country and much better driving and biking roads. Melbourne’s nice to visit but man it’s nice to drive outta there again

I think going to court really puts people off, I’d imagine most people pay which isn’t a fair process, it’s just driven by fear and threats.

💯 amazing how strange they got on the phone when I questioned the review and asked for the review feedback and how the review had come to the conclusion, got rude with me very quick and just said go to court, so off I go to court!
I'm guessing you didnt have a dashcam to support your claim. Either way, I would dispute it. The magistrate will almost certainly take your side given the evidence.

Not sure if it’s in your favour. We can at least see there is no green arrow on both traffic lights. That’s not a good starting point for a defence
It sucks that it happened but I don’t think the effort you would have to put in is worth the return you would get if you fought it and won.

If the infringement is for running a red light as the bottom of their photo states "...When vehicle entered intersection 0.6 seconds had elapsed since light turned red.", then there is clearly no red light to obey. Case closed.
Laws aren't suggestions. You're not above the law, who do you think you are, Donald trump?
But the photo shows I didn’t break the law and I’m 💯 sure there was no red or amber light, 💯
