Dewayne, this is a great informative video. Can you make a video on what to do if you do spot an error in what the VA is paying you??? I was granted 70% with spouse only in 2021 and did not realize until 2023 that I never recieved the COLA increases for both 2022 and 2023. I had to search around and a VSO on a Facebook group told me to do a audit request. The first attempt the VA did not catch it. The 2nd attempt I submitted a personal statement and broke everything down to the simplest terms and boom the VA caught the error and corrected it. 2 months later after the standard audit with DFAS I got $10K in back pay.

You can understand policy and procedures all you want. The issue then becomes even the DRO basically saying, "this is my decision and, if you disagree, here are your appeal options." I've submitted three pages of specific questions about my claim and HLR to the head coach at the St. Petersburg DROC and have gotten the same boilerplate response about my appeal options. 90+ pages of lay evidence submitted with the original claim that were deemed "not to be competent or credible" with not explanation about what or why. Some of these pages were directly from VBA decisions. Have a VERA call for the end of the month and will be INSISTING to speak with the director of the DROC to let them know what caliber of work product their office is putting and, effectively, signing their name to.
90+ pages is a lot to review and VA employees are on production every day. Sometime, less is more and direct and to the point. Good luck going forward and check out my videos on how to win your HLR if the conditions fall under the five ways of service connection.

The giant behemoth that is the VA is to big, mismanaged and many employees are not properly trained. Ex. Passage of the pact act unleashed hundreds of of thousands of new claims with out hiring enough trained staff. That’s why there is such a huge backlog. Average wait time more than 8 months. Total disgrace.

Dewayne, I've noticed they keep using the terms "policies and procedures". As most veterans are still unaware that the procedures and policies are null and void if they violate statutory requirements for processing and evaluating claims it would be awesome if you could explain to everyone how the VHA and VBA have violated statutes repeatedly in processing and evaluating claims for disabilities and health care throughout the VA. One good example is the internal policy giving the claimant 90 days to get an appointment for evaluation of the need for caregiver support/compensation. These policies are "enforced" by social workers which can lead to a denial letter based on the opinion of the social worker before evidence is ever even gathered. If this happens or has happened in any claim, filing a supplemental claim helps in as much as the opinion of a social worker has no bearing as the denial must be based on a medical opinion not a personal or professional opinion. Peace brother, keep up the good work.
I have for VBA, I've never worked on the VHA side and don't keep up with their regulations. I've talked about the caregiver program but I'm sure there are some VA employees not following regulations based on what veterans have told me why their caregiver application was denied. Keep this in mind, there are VA employees that are not advocates for veterans, I've seen it as a previous VA employee. We have to continue to educate each other. Thanks for the support. Dewayne, This was very informative. Right now I'm on an NSC pension while waiting for an appointment to verify ptsd. It seems like everytime I try to file for a claim, they gotta deny it for any number of "convenient" reasons. Which I believe is adding to my ptsd. I have about 6 months left on my intent to file, and am still waiting for the appointment to get checked out. Anything to help push things along?

Contact the call center to ensure the claim is still active. It shouldn't take that long to get an answer.
