We know from the successful appeal process that a miscarriage of justice took place in prosecuting many SPMs. In order for that to occur individuals had to be responsible for perverting that course of justice. Why one has been arrested is amazing when it is quite obvious who were complicit in perverting the course of justice. (Perverting the course of justice is a serious criminal offence that can carry a sentence of up to life in prison and whilst life imprisonment is unlikely, it is unusual for the court to impose a penalty other than a prison sentence). Meanwhile SPMs should receive every penny that was illegally stolen from them including interest from the time the money was stolen. This would include the sale of any of their property including homes to finance the fines paid to the PO. Compensation should then be paid over & above what they were due as previously stated. All the PO investigators should be prosecuted as there was not an investigation into the shortfalls. It was decided before hand the SPMs were guilty. That branch of the PO should be shut down & the "investigators" fired. Fujitsu must be held to be liable to have to pay compensation as they did not deliver a system fit for purpose which is similar to the supply of duff PPE during the pandemic. They should be banned from providing any further Govt contracts. The whole board of the PO who did nothing to stop this malicious prosecution should be fired & any bonuses they accrued during that time should have to be paid back. Any Govt ministers who did nothing especially the board member(s) representing the Govt should be named & shamed. Prosecuting lawyers should also be investigated to determine if they perverted the course of justice & debarred if found guilty. Criminal proceedings should be held against all individuals who were instrumental in prosecuting the SPM falsely starting with the CEOs & directors of Fujitsu & POL. It has come to light auditors Ernst & Young approved the PO’s accounts during the time that the PO was stealing SPM money & using it to boost PO profits enabling PO executives to earn large bonuses. They must be investigated for not reporting this activity that they were paid handsomely to discover.

Surely by now the PO realises that they and Fujitsu own and run the software. When it goes wrong they need to trawl through the logs until they understand exactly where it went wrong.

So many similarities with the way the Child Maintenance Service is run, demands for money which can't be proved to be owed, threats of legal action to get you to pay up, and if you don't pay what they demand they have the power to take money straight from your wages or your bank account. They told me that I owed £11,600 from 25 years ago, refused to prove it, refused all my evidence, ignored my ex when she asked them to close the case and froze my bank account for two years. In a letter to my MP they said that they couldn't prove that I owed anything as they had destroyed the records, that they had all my evidence of payments made but hadn't conformed them with my ex, that I would simply have to accept that I still owed it and they were going to take it from my bank account whether I liked t or not! At no time was I able to put my evidence before a judge, they don't need to go through a court to take your money. Having watched Mr Bates vs the Post Office I can definitely sympathise for the stress caused to the 'little person' when pursued by a Government department who are not prepared to listen.

@@mewel1234 The main complaint though was... With... the use of the screens and the transactions done on it. The screens are aligned with the computer under the counter and that is aligned with the main computer. With a lot of stuff in-between the last two. If the screen goes Blue, it's recorded. If the transaction is On the screen but fails to record, the transaction is recorded on the camera. Companies, here in the US use them for just that too.

@@maria.and2265I think you are missing the point. It's not about what evidence can be given . It's about how evidence is manipulated or disregarded. The system was and is known to have bugs. It was presented as robust and reliable. This is about criminal intent by post office and abusing power to get what they want. Not about a subpostmaster being careful . It is likely to make no difference to the outcome.

The Post Office should get rid of Fujitsu computing absolutely. It is a flawed system which has and is ruining peoples lives. And it’s about time that the Post Office put an end to the continual torture it has put those innocent Post Masters through. It is shameful the way they have treated them for many years, even though they were aware of the flawed system.

In Australia I noticed that only a few years ago the local Post Offices still used a DOS system on their Computers. ( I haven’t checked recently). Which was the basic system on all Microsoft Computers prior to Windows and still runs in the background. Maybe they knew, if it works why change it.

Here is the thing, apart from all the other aspects of this affair the role of Lord Neuberger in the Recusal seems to have escaped attention.
I have therefore pasted the following ‘The role of Lord Neuberger in the recusal fiasco (Justice Fraser) should be investigated’ on as many RUclips articles as I could, about ten, but when I checked to see if there was any response I discovered they had all been taken down.
This Kafkaesque episode staggers one at every turn, even when Big brother has been outed he seems to be still working away!
I really want to know why Lord Neuberger interfered , if the recusal had succeeded the whole noble attempt at taking on the stinking system would have failed

The thing that winds me up most is that the ‘Horizon’ system can’t cost more than a few thousand to engineer and code for.
I’ve been in SE for 7+ years, as has my partner. It’s such a shame the Government outsourced this sort of thing for Billions, causing all this chaos, when there are perfectly good software engineers in this country who get overlooked.
Such a shame. My thoughts are with those caught up in all of this.

Horizon, and the PO in general are clearly a shambles, but there are two things I don’t understand:
    1. The Subpostmasters can set a video camera on the till to document failures. Why has nobody done this? Ive not heard of a single post office where that’s been done.
    2. If the subpostmasters are losing money, why aren’t they leaving for a better paying and less stressful job?
I’m not saying this to be facetious or mean, I am honestly wondering why and if anyone can suggest the reasons, please do!

    • @mewel1234
      @mewel1234 3 месяца назад +3

The subpostmasters had to invest money to provide premises for the Post Office. They can’t just leave for another job without getting their substantial investment back. They were entitled to redundancy payments if their office was closed because of reduced number of offices needed because of computerisation. Average redundancy payments are £64000
Also all transaction are not through the till, so it’s not worth video a till. Stock and cash received as stock, don’t go through the till.

The question is! can the software industry be trusted? In 2016 I had mobile freemium game that was just barely 2 years old became faulty after a software update cause by common flaw when downloadable content(DLC) that is not configured properly that can cause new software bugs to form on the existing software! the customer support with third party developer was beyond appalling they accused me of my devices not being in the correct operating condition. I consider that claim to be false and misleading as the condition of my devices were working correctly and perfectly fine and that it was part of the cause and it was not at fault. It changed my trust forever with online gaming and digital services tech giants like Google don't actually care and treat the Australian consumer law like if its optional, disposable and dosen't apply to digital services or software.

While the post office itself prosecuted hundreds of post office operators based on faulty horizon IT system it has emerged from official reviews that at least 10 cases taken by the cps resulted in convictions 3 occurred while starmer was DPP starmer was in charge.
283 cases were brought by other bodies including cps many of those convicted went to prison for false accounting and theft cps said they were only behind an handful of cases surly even one innocent person is one to many.
