      Anyone that claims to not believe him is free to post the section from the EULA that he got wrong. I agree with you, but I think that the E2 community would love to take a chance to EXPOSE! one of the ‘scamtubers’ as liars if the chance came up. If they don’t, you can safely assume he got it right. But again, putting it on the screen IS the better idea, 100%

    If they can't be bothered to spend the money on real assets (for the web site if nothing else), then I'm pretty sure that they won't be spending money on legal action against "slander".

      Except they would, plenty of lawyers in this field operate with 'we only charge you if we win' so many times there is little to no cost (sometimes just a filing fee) unless they are counter-sued. The mindset on E2 is 'press button, make money.' These same people think libel lawsuits are just 'call lawyer, make money.' The lawsuits against SidAlpha, Karl Jobst and others are proof. They think it's a money machine, and they think it's effective bullying, and they do it all the time, with zero knowledge of what libel is, or how the system works.

      @@Darkwolfe73 But how many layers would take up a slander case. Such cases are extremely hard to prove, take months or years to proceed, and are only as lucrative as the people they are suing can pay out. Which in the case of random internet critics isn't very much.
      Keep in mind we are talking about lawyers and legal firms, not some random lunatic suing on their own in a hopeless case against Sidalpha or some other youtuber.

      Like that isn't even the biggest issue... they could've literally imported the asset into Unity and then took a picture and credit the creator in the image they made as opposed to taking a screenshot of the marketing picture. Process would've taken like 1-2 minutes tops.

      ​@@usosaito.namahage This assumes that the person doing the web design has access to unity, or any experience with game engines, game assets, or anything other than photoshop. The game devs wont be the people handling this, and wouldnt be taking the time to coordinate, given the lack of effort or care surrounding the project as a whole. Remember that this is likely just a huge NFT style grift.

If that basic effort of clicking download and import is too much then clearly shouldn't be doing that for a job. This has been a big NFT scam since it first saw light.

    the way the community turns on supporters is very similar to Star Citizen. Star Citizen is 11 years, approx 700 million dollars, still pre-alpha, and anyone who says a bad thing gets death threats.

      To be fair, Star Citizen can be played, you can enter the world do something and try some available ship. at least they have a vision on what their game is. Though the quality is nowhere close to the time and money invested.
      E2 still doesn't even know what the game was supposed to be. fps? tps? sim city? the 3d building before was just cheap assets to try faking a wip / development progress. the only thing they spent energy is on how to grab your cash.
      In a sense even dreamworld look more legit than E2 as a game.

    This might sound like a joke, but I said Star citizen will not release before a new engine makes it obsolete. That was ajoke, and we have unreal engine 5 now.

    I can almost guarantee you one thing, Shane has no "legal", if he did he'd know the first rule of a lawsuit is to never say anything and certainly don't tell the people you're trying to sue about it before they're served. Literally anything and everything he says publicly is a piece of evidence that might be used against him during the hearing, its pretty common practice to have any statements he might want to make checked over by "legal" before making them. Mind you, If the state of his "game" bears any resemblance to the state of his "legal" department then I can only assume he hired Lionel Hutz 😂😂

    Funny thing: it's incredibly hard to prove slander or defamation, as often time you have to prove actual malice, which is incredibly. While UK and Australia courts may differ, it is still an incredibly hard claim to prove, not to mention critique falls under fair use, which would also shut down those claims. Not to mention you have to prove financial loss as a result of those slanderous or defamatory claims.

      Defamation is making injurious comments in written form and slander is in verbal form. Neither has to be proven to result in financial loss, rather it is reputational damage in the first instance. Neither requires malice aforethought.
      Shane would struggle to get any lawyer to pursue a case as it would be extremely detrimental, given the fact it would put him and his fucking woeful project under the spotlight and as we all know, actions have consequences. Any lawyer would tell him he was fucked from the get go. The legal process called discovery would absolutely slaughter him. He might act tough against RUclipsrs, but would get ripped to shreds by a barrister or QC.
      Please Santa Jebus, make it happen...

    Your explanation about the circle jerk raising the price is also how the current domain auctions are working as well. It is really bad, and it makes it worse because domains have an actual value. So quite a lot of new startup companies get screwed being forced to buy a very expensive domain that shouldn't be near the price it is.

      Has this kind of thing been reported to fair trade regulators? It's literally a scam and cannot be legal. Whether or not any enforcement action actually happens is another thing, but regulators have to know about it first and dismayingly it seems like people in 2022 think that complaining about something on twitter is equivalent to reporting it to authorities.

    To be fair, in court they could argue that they've delivered hundreds of hours of entertaining content in form of RUclips videos critiquing E2. I mean, it's Cyberpunk level screenwriting: there's theft, dishonesty, drama, I'm sure there is sex somewhere...
    Also, here is a completely random thought about web 1-2-3 (It'll be a bit long, but bear with me). If you remember the days when Internet came to being, you might know that it was pretty much unusable. There's a talk about X (Unix display server) by amazing engineer Keith Packard (The political history of X - go watch it if you interested in computer science or software engineering), where he talks briefly about its state at inception.
    Web 1 was something necessary - when a group of very smart people actually fixed the internet, finally, you can present your company or self for everyone too see, start selling things or services etc. Clear advantage was, for companies, significantly better outreach cheaper, and for customers it was the choice.
    Web 2 introduced something even more interesting - user-generated content. Meaning that I, as individual with, quoting Liam Neeson's character, 'a particular set of skills', am able to now share those skills with others and maybe even get compensated for it. Or share ideas, opinions, and of course, the whole point of all of that, pictures of cute animals.
    Now the question. What exactly of that level introduces so-called Web 3? Finally having ability to shove more stupid ads down our throats and get more money from us by selling literally nothing? Isn't it exiting?

      I guess the "dream" is that Web3 is a virtual world that we can just live in. Not just sharing content or ideas, but the... whole of... being... I guess. It makes sense in my head. You know: Direct connectivity to people, not just their creations. Social media with extra steps I guess?
      The reality, of course, is that "Web3" is 30% idea men, selling their lofty ambitions to the other 70% (which is anonymous financial transactions). It's a huge concept that has completely rotted through so it's just a hollow pit that people throw money into for some reason. Then they keep trying to convince themselves that, if they keep throwing in money, it'll eventually develop into something real. Meanwhile everyone else see's it for what it is.
      In the end, the crypto bros are just calling it "Web3" so they can pretend it's not just the biggest scam in history. We might see a real Web3 sometime after there's an actual breakthrough in technology (not before), but it'll be something else entirely.

      @@Vandassar I think you've mistaken a bit technology with the concept. The technology is potentially 5G - there are literally barely any advantages besides latency and (in very rare cases) speed increases.
      Web N is, in the other hand, a concept of what actually gets delivered over this 5G or whatever, and in what form. In form of horrible jpeg-selling shit, seemingly. :)

    Earth 2 and the company never fail to amaze me how absolutely incompetent they are. Let's look at this objectively. All the gaming scams and jokes over the last few years alone- all the Kickstarters, all the viral bad marketing and collapsing examples. Many were absolute jokes, but none were as continually incompetnet as this.
    Take Dreamworld. A laughable example, but at least they are now trying to do something, and when you compare the two, they are light and dark. They have made some progress and have learned. Shane hasn't. He has learned nothing, he has shown nothing.
    It has been many months since the whole acquisition of that cars driving over landscape thing. How many other games have still NOTHING to show after such time?
    That should speak volumes.
    He's making the same poor excuses and same poor mistakes.

    As a dev asset it would be fine, but you wouldn't put dev assets as showcases on your website. So what the hell?!
    It's just a joke of a project, with utterly imcompetent people.

    When I started looking into this, I decided to ONLY look at Shane's videos and their website in my video. Their side was confusing and inaccurate and yes, confusing. It's true it was damn near impossible to find out what they meant E2 even was! 😂

    If they attempt lawsuits then they're opening themselves up for discovery, they'd be required to turn over a significant amount of their business transactions and dealing in court which would then become public record. If it's not a scam it wouldn't be a big deal but if they aren't on the level they're going to get completely plowed under in court.

    Can't wait to hear what else you found out. Shane isn't even denying those resource validation claims. People in discord are saying they are just putting random messages in their claims and getting approved. So everyone staking essence on the claims are getting double the essence.
    Shane making sure the essence is spread out real thin so the value isn't too high if he actually goes thru with turning essence to crypto.

    NFT's are behaving exactly the way any 'fashion' items do - the value, the appeal is transient.
    And Shane's use of "legal action" as a threat is the standard response to criticism; they use it to scare, regardless of if they have any case to present. It's like those folks who are recorded doing something stupid - they usually start with "You filmin' me? I'll call the cops! You can't do that!"

    Its notable that unity licenses normally are only permitted so long as its used with unity as well, unless theyre working with unity in their project and paying unity royalties this would be a breach even if theyre allowed to use the marketing

    You know the real frustration to us in the indie scene? Fact that these guys actually managed to get super popular.. That is so hard to do that wasting it on a scam is just painful to watch. Me and everyone else who's made a game want to get eyes on it, want to provide value, but these guys already have eyes on their project, literally just make it a real game, scale down the promises to something realistic and you can make a successful game. Ask any dev if they can come up with ideas what to do with their current grid system and you'll get a ton of ideas on games that *can* be made and you can possibly get the minimum viable product out within months

    I think the correct term for items/assets/stocks being traded back and forth is called wash trading, and insider trading is when you sell assets based on insider information not available to the public. You probably knew that and just used the wrong term, but I thought I'd point it out just in case you're planning to do a more indepth video in the future.

    'Go anywhere and do anything', wait, does that mean I could go into this hypothetical MMO and basically destroy everything? E.g. Set off the worlds nuclear bombs and let Dr Bright do whatever he wants?
    Now that I think about it, I'm not sure this game can succeed even if they 'prove us wrong' by it's own concept.....could be a cool plot for a cyberpunk dystopian media though.

      It's gonna be P2E/P2W, so basically by definition you will always be heavily restricted and tied to the leash/collar that sugardaddy Shane puts around your neck. Unless you spend a whole lot of money. And even then they will make sure to rule over the things you can or cannot do rather strictly.
      Because if even most "normal" or "legacy" games (as they call what we're currently playing) struggle to satisfy these wettest of wet gamer dreams that you portrayed there, then why should Shane succeed to do that in a game that will attach even more money labels to and need to rebalance everything much more often than even your worst current MTX-heavy P2W games do? Should you have watched or plan to watch most of their videos, then you will notice that it's almost always only ether here, essence there, mentar this, jewel that, whitepaper when, trading then and so on. If they are already so f*cking busy and concerned with mostly just that stupid monetization hellscape fineprint then I don't wanna know how much worse it will get once they actually push out a proper product with presumably millions of people playing it and of whom many will be hellbent on rigging the P2E game to their advantage just so they can strike gold and finally go "to the moon".
      "You can do everything" is of course marketing/buzzword bullsh*t, just as "millions of players", "Ready Player One", "Matrix" or "Red Dead Redemption 2 graphics". None of us believe them that crap. The E2 followers on the other hand...

    The license is right there and it doesn't state anything being claimed in the video. Neither store requires attribution for anything on them. The only if is whether or not whoever put it up there had the asset themselves, which I still think only applies to contractors. I'm not willing to sift through a license for an engine I don't use if they have some specific stipulation about marketing materials, first look says no.

    If shane wanted to make a game he could have said ,,Hey we are making a new sandbox game, basically a 3d factorio set on earth". People would be interested and Earth 2 people would most likely be able to pull it off. Instead he opted to do NFT bs that is worth less then nothing and some weird promises about a game they will never be able to fullfil

    Speaking as dev, this is just making me hurt and makes me angry.
    The lack of funding I seem to find, even programs to find..... and somehow this group gets away with this open fraud, this consistent fraud.
    Yeah, I said it, fraud. I'd act as a SME witness on project management if you want to sue these guys. I'm normally not so vitriolic about this. However this gives the entire industry a bad name for stuff like this.

    Just FYI, I don't think you mean to use the phrase "insider trading." I only mention this because I don't know if any of the parties involved are litigious, and the UK has _really_ plaintiff-friendly defamation law. "Insider trading" essentially refers to the illegal use of non-public information in buying or selling stock. (Say Mark Zuckerberg, because he is CEO of Facebook, knows a memo is going to leak on Wednesday that proves the company is just a big research experiment to see how many teenagers they can get to jump off bridges. On Tuesday, because he knows this, he sells all his Facebook stock. That's insider trading.)
