He was granted immunity via the State so it's likely the federal level will follow with that, there was no justified reason for him to run that stop sign and the fact he didn't see her means he wasn't paying attention to the road.
Catching up to other vehicles in a surveillance team does NOT constitute an emergency. Even when ANY LEO is going code they are still REQUIRED to practice due diligence. The DEA agent needs to be prosecuted under State law but should be found guilty regardless. NO IMMUNITY for receckless driving, period.
It should but time and again SCOTUS and the circuit courts have ruled it does whenever the facts of a case does _not_ match the preciseness of the facts of previous cases where the courts found the cop clearly broke his qualified immunity! 😠😡🤬👿

So he ran a stop sign which he committed an infraction and it resulted in the death of an innocent citizen? What is the difference who he was employed by? This is disgusting
Because police have qualified immunity. Is this your first time experiencing people being upset by that? Police officers are not individually liable for what they do while acting in the course of their job. This is why the police aren't afraid to violate your rights. If you sue and win then the money is paid by the taxpayers. They won't even lose their job for it.
If the appellate judge allows it to go Federal court, then that is exactly what all Feds under that appellate region will get ...a get out of jail free card.
@@jondoe406 Qualified Immunity is actually at its core a pretty sensible doctrine that you can't sue an official like a clerk for doing legitimate work that happens to negatively affect you, but it has been warped and twisted by our utterly corrupt court system into a special protection for any public official against any kind of damages in any situation regardless of the facts and responsibility. They don't need that much protection though
Immunity in this context is absolutely ridiculous because this isn’t just an accidental killing while properly executing duties. This was negligence while ignoring the law as if it doesn’t apply to him.
@maddog He understands it perfectly; it seems you don't. Sovereign citizens are against government and their laws. The agent works for and is looking for protection from the government and its laws to benefit himself.

I’d like to know a bit more information about the incident. If it was critical to speed and run stop signs, why wasn’t he utilizing a siren or lights? Was this “fentanyl dealer” an immediate threat to the public? Did the agency know the “dealer’s” home of record? Had the rest of the team lost the “dealer’s” whereabouts? If the “dealer” was that much of a threat to the community, why was the dealer out free? Negligent homicide for sure. If I am operating a forklift and I drop a load on a customer or customer’s vehicle, I am responsible for those consequences even though I am acting in my work capacity.
That's pretty funny considering his being a federal agent has everything to do with it! He's not a mailman or a garbageman driving a route, he's a federal agent on duty doing surveillance and it's the entire reason he's on that street doing what he's doing.
@@EstherMoffett-d7hhe wasn’t using deadly force in the line of duty, he was running a stop sign to get to his other officers who where already following and surveilling the suspect. In *any* situation qualified immunity should not exist. It's an excuse for "we screwed up and harmed someone and now we don't want to be held liable for our actions".
@TheCableStrain local governments are much more accountable. The mayor could be at a cook out, Lowe's, the grocery store, etc. but no one is bumping into Joe Biden at any of those places. Unless Joe got away from his handlers and wandered off of course.
if a police officer runs the stop sign with no lights and siren he is charged. this guy had no lights and siren and it wasn't even an emergency he was going to.
Not true. Sometimes officers also roll without lights and sirens. If they are actively conducting official business, they can also have a claim to qualified immunity. Not saying it's right, or even should be allowed, but your statement is categorically false.
@simsreject5925 whether operating emergency lights and sirens or not they are still obligated to make sure an intersection is clear before proceeding through it.
My sister in law was almost killed by a cop that ran a red light while off duty. It took almost seven years to settle the case because of this immunity crap. And no one paid for the new vehicle that was totaled and only a partial payment of medical bills. Government offices only pay the public for their actions when forced to by courts.
"Running the stop sign was NOT necessary to do his job as a DEA agent" - 100% correct. It was NOT like he was running code or chasing down a fleeing violent criminal. What you're not aware of is that the so-called government went private in 1933 and declared war on the American people. It has always been a corporation chartered in 1791 to manage foreign trade and protect individuals' property. What's more is the fact that the District of Columbia usurped the constitution that bound them when the CONSTITUTION OF THE UNITED STATES was counterfeited in its place. The Bill of Rights attached to the original was also usurped in place of amendments that look and sound the same but have different definitions and interpretations of language. When one claims an amendment, one claims a privilege , not a right. For some reason, i can't seem to get this "verifiable " information into the thick indoctrinated minds of the masses.

The DEA is NOT breaking the Law - the Law was written to serve and protect the System, not the Citizen - that's why Courts and Lawyers are so prevalent in Society.
The existence of the DEA is a violation of the Constitution, as is the DOJ. Neither can be found in the Articles of the Constitution that formed the government, and by their very nature, they violate the Bill of Rights just by breathing air each day.
The UK provides a compelling example of how law enforcement can effectively function without a doctrine like qualified immunity. In the UK, police and other public officials are fully accountable under both civil and criminal law for their actions. This includes the possibility of private prosecutions, where individuals can initiate criminal proceedings, a mechanism not available in the U.S. This system promotes accountability and public trust, demonstrating that law enforcement officials can indeed perform their duties effectively without the need for broad legal protections such as qualified immunity. The absence of such immunity does not impede their ability to do their jobs but rather ensures that their powers are exercised responsibly.
At the absolute minimum, his inability to do both grossly underscores that he is NOT capable of the job. At the very least, he should never get a license or check from gov ever again.

So flip it around. What would happen if a civilian, say a frightened mom, was speeding her child to the ER, ran a stop sign, and collided with a bicycle officer, tragically killing them? Y'all reckon the law would say "well, she had an emergency so we won't hold her legally accountable"? Any wagers on how that one would play out?
This is a fantastic point. The woman in your scenario would be screwed. I also think rushing your child to the hospital is far more urgent and popular amongst citizens than the war on drugs.
You assumed an emergency. The only emergency in this case was after the DEA officer struck the bicyclist and not before. He created the emergency by ignoring traffic laws.
Under no circumstances is it reasonable for a person to drive a vehicle on public roadways while not being fully in control of the vehicle. Neither the cop nor the mom are doing their emergency any favors by getting into a collision along the way.
I agree its terrible and wish it never happened but this is a tricky case. not as clearcut simple as some make it out to be. Are cops allowed to speed and not stop at stop signs if they are chasing a suspect? then does an undercover fed working get basically the same rights a local or state cop would get from state? i think they do. lets say the Potus gets shot and secret service speeds off and blows off stop signs and kills a pedestrian en route to hospital. what happens in this case? i think unfortunately not much. terrible accident.

What in the actual fudge is going on in this country that we have fallen into such insanity.
We have been, actually. Ruby Ridge saw an infant and his mother shot by an FBI sniper in her own yard because her husband refused to become a mole on a backwoods militia. You ignored it, because right wing bad.
We warned you when the ATF burnt down an entire complex in Waco with military weapons because a kooky cult leader offended one of his concubines and she claimed that the cult leader had illegal weapons. The entire cult was burned alive. You ignored it, because religion bad.
We warned you when the CIA didn’t like the extremist rhetoric of an Islamic American, and so had the military vaporize him along with his American minor children in the deserts of Yemen without trial or charges. You ignored it, because men bad.

Thank the corrupt Supreme Court.
Protecting a murderer just because he wears a badge. No one should be immune from murder no matter what their job title.

If there was NO SUCH THING AS Qualified Immunity....THERE WOULD BE WAAAAAAY LESS cases of this. ACCOUNTABILITY serves a HUGE PURPOSE.
Q.I. perpetuates bad behavior, there is NO DOUBT ABOUT THAT.
Qualified immunity needs to be abolish from all state actors
Blue lives don't matter
Some qualified immunity is a must. Every society has those. The only question is when does it end/start. I'd imagine we would fail as a society, if we cancel QI just because a law enforcement officer ran a stop sign
without immunity, every cop would quit, or at least just stop enforcing the law, because he would be putting his life at risk just by carrying out duties. Cops would get sued 24/7 and they would be attending court hearings from every arrested individual, rather than doing their job
This is not qualified immunity. This is about whether federal criminal law supersedes state law. Qualified immunity is only about civil liability.
@@artyomarty391 what society? Does common people have immunity? Did Trump get it
I'm a police officer of 23 years for a large police department and this is outrageous that the DEA is pulling this garbage. There were no exigent circumstances while doing surveillance that warrants him driving a normal vehicle in a careless and reckless manner. He needs to be tried in state court and justice served. What he was trying to do is just catch up to his buddies who were following him so he could be in on the fun. He was a cowboy who got too big for his britches thinking he was "the law" and rules don't apply to him. I've seen this mindset many times during my career.

"Federal law supercedes state law" I don't think that's open enough for interpretation to justify senseless completely unrelated murder
How many times have we seen local deputies harassing Federal employees. There seems to be a very big double standard here. If it is not DEA, it seems to be ATF - and when I think of it, there are just too many people in uniform who forget who they work for.
"There was no emergency, and there was no hot pursuit"... that is irrelevant. It shouldn't extend to anyone....
That’s completely wrong. Federal agents enjoy Farmar, robust immunity, protections, then state actors.
See: “De Facto Federal Immunity: Why It’s Almost Impossible to Sue Federal Agents”
