This is super clear, helped me with understanding the rules. But still struggling to identify these rules when looking at case reports, any advice?
What do you mean? Do mean when reading a case you don’t know which rule has been used?
@@TheLawBank Sorry reading that back I realised I was super vague! When reading the decisions of judges is case reports we're asked to identify which rules of construciton the judges have applied. I struggle with identifying these, do you have any advice? Should I be looking for keywords?

The literal rule is meant to be used even if it leads to an absurdity, but the golden rule can be used if the use of the literal rule would lead to an absurdity.
Does this mean that the judges can decide how big of an absurdity there would have to be before using the golden rule ?

Judges have discretion to decide what counts as an “absurdity” . So the threshold may vary from judge to judge. This is often a criticism of using anything but the literal rule as it makes the law hard to predict and possibly inconsistent. I hope that helps.
