      I wonder if the husband isn't tying everything up and preventing them from filing criminal charges.
      None of what the wife said makes any sense.
      They should be able to file criminal charges, then sue the mother for attorney's fees and damages. Settling with a criminal who is extorting you is never the correct option.

      I once hired a bad attorney, they will drag your case out and ask for more money, listen to Dave and if you have to cut your losses ( bad attorney fees ), and fire said attorney.

      They made up this BS or they're complete idiots. In PA you could settle this case without a lawyer in 20 minutes. Just bring mortgage documents to County Clerks office. Not rocket science. Boyfriend/ husband is a total idiot and the wife is a clueless jackass. My 12 year old son has more balls than this woke, no backbone dishrag. Backbones are in Aisle 3 of Wal-Mart.( My favorite Dave Ramsey expression. ) MIL would not have waited 20 years if she was legitimately owed money. The fact they had a closing 19 years suggests she got all the money she was entitled to. This woman and her boyfriend should get married and title the deed in both names, then they would not have to deal with this BS. You're pretty stupid if you're over 30 years old and you can't deal with this on your own without talking to a entertainment podcast, radio, TV personality. I hope these stupid, idiotic calls are made up.

      @@miketheyunggod2534this is crazy but I think you are right. This almost happened to me, but because the deed needed all signatures notarized by all parties to refinance there is a legal paper trail. This means you can prove fraud very easily.

    The woman who married my FiL threatened to do this exact thing to us. After five years of owning the property, she got mad about something (I forget what set her off that particular time) and she threatened to go to the courthouse and say we obtained the deed to the property fraudulently. Luckily for us, she died of a heart attack a month later and never followed through with her threats. We had a party to celebrate and sang "Ding Dong The Witch Is Dead."

    I think a new lawyer may be in order or this woman needs to change her mindset. Criminal charges are a kick in the ass for the criminal to begin cooperating. She was talking about paying ransom when she should’ve been talking about considering dropping the criminal charges if the criminal pays all the legal fees and gives the property back

    The local DA's office isn't likely to pursue this criminally. They, along with local law enforcement, will almost invariably tell the caller "this is a civil matter."

    There's no honor among thieves, so stealing from your own child isn't a stretch.
    My aunt went to jail for stealing from a church. I remembered when I was a child, she stole my Nintendo and pawned it and never got it out. She first said she gave it to the less fortunate, then she said it melted in the back seat. I found the pawn shop receipt.

    Owners. How did she get their signature to sign off the deed? If she forged or lied to a notary this is definitely fraud and you can file criminal misdemeanor charges!

I would taken care of this in one day 2 hours without an attorney. Read law books, do research, and use your God-given brain for Christ's sake. Younger generation seriously needs to smarten up. No guts, no glory. And no money. And no house. And no wife/girlfriend. And no honor.

      Single mothers often (not always) are so codependent their children because they don’t have a spouse - that they feel their adult children should act as their spouses. This caller said her MIL started getting nasty when her husband chose to be “the man of the house” for his family, and not for his mother.

    *There’s clearly more to the case than she’s disclosing.*
    No client is that stupid to pay $40K in legal fees on an open and shut case, particularly without resolving it.
    Guessing the original property transfer has some defects.
    If this is Detroit-proper, yah the Wayne County prosecutor isn’t going to mess with a criminal action.
    But if this actually is in one of the suburbs and outside Wayne County, the prosecutors might take action… only if it is an iron clad open and shut case.
    That the attorney - she claims - did not first recommend criminal action also hints there’s more to the case.

    Ummm…they also need to sue the notary who notarized the fraudulent quit claim deed. In order for a quit claim deed/warranty to be recorded, it needs to be notarized.

    After my dad passed, it took his attorney 18 MONTHS to settle. He basically owned his house and car. I called the bar, we settled soon after. I worked in a job that he needed something from me. I put his ass on hold and never picked up. He put his request in writing and I completed his request. Easy peasy.

    So most states the years of occupancy for adverse possession to stick is 20 years. Except he bought the home legitimately 19 years ago so its almost as if the mom saw this as the last chance to claim the home. I dont understand how this is possible.

    Normally both parties have to sign a quitclaim deed, but I guess at this point the crazy mom forged her son's signature, if it was needed. It's also crazy that the quitclaim can be done for practically free, but they've paid $40k in attorney's fees to try to reverse it.

      They're stupid. 40K attorneys fees is total BS. I think they made it up or won't pay it anyway since they're morally and financially broke. One of the dumbest calls on the Dave Ramsey show. That stupid laughter from the caller is really annoying and aggravating. If she had had a brain she and her boyfriend could have settled this BS in less than 24 hours. I did it in less than 1 hour at County Court house without a lawyer on my own. People are so stupid its enough to make you pull your hair out.

    I'm struggling with this. So according to this call anyone can just go down to a county clerk and file a quitclaim deed on anyone's house without the owner''s signature and the county clerk files them as the owner? That can't be right.
    There's definitely more to this. Otherwise even if there was an error with filing it it'd be pretty easily resolved and wouldn't cost $40k.
    MIL sounds awful but story doesn't quite pass my sniff test.

      Yeah, there are some holes in the story, but of course, Dave and his crew jump in and declare that the lawyers the caller has are idiots, without having crucial information. And that bit where Dave thinks that a lawyer has to do anything their customer tells them to is the most asinine thing I've heard. Lawyers, typically now the law and people ask all sorts of stupid crap, that might be illegal. So a real lawyer doesn't just do whatever their customer asks them to.

    So there’s a lot to think about here. Who’s been paying the taxes? What are the squatters rights in Michigan? How much does mom want? Is mom in good health (can they wait her out)? They’re also in Detroit, wouldn’t be hard to find someone to take care of this if you know what I mean.

    Well, why is your husband not managing this? It is his mother? And if he can't protect his family from his own mother, then maybe you need to question your relationship with him. Most men would not want their wives getting this involved with issues with their mother. I'm not saying they didn't give you good advice ... I'm just saying apples rarely fall far from the tree.
    And if I were you... I would quietly be gathering a *leap* fund because filing criminal charges against a MIL....

      People can't press charges. People can file police reports and indicate they'll cooperate with prosecutors but individuals have zero control over whether charges are pressed once a report is made.

      @@RiSkyNick The prosecutor is who makes the decision on whether to press charges. Otherwise we'd have people not charged with serious crimes b/c their victim is scared/intimidated or loves their attacker which increases risk tl everyone and also people going around pressing charges for asinine "offenses" (for example charging someone for assault b/c they accidentally bumped into you on the street which resulted in no injury whatsoever).
      Where people get confused and probably where the confusion comes is sometimes the cop on the scene (who also doesn't make a decision on whether charges are pressed) may ask if you want to file a report or decide not to arrest the perpetrator if you (the victim) indicate you won't cooperate with any police/prosecutor action.

    My Mum went to a Solicitor because my brother's girlfriend borrowed £34,000 and wouldn't pay it back. The girlfriend said it was a gift. It went to Court and my Mum got some of it back. Too many people go to Solicitors instead of the Police when this crime is committed. I think they must be too embarrassed to admit they fell for it. The Solicitor is happy to make easy money so they'll just go ahead and make what they can out of it.
