    I tried a case when I was judicial magistrate in Karnal in 1959-61. There were more than a dozen accused who were tenants of one Haryana Jat and two Sikhs who were father and son. They inflicted grievous injuries on the three landlords. When the case came up for trial , the first witness who was the Haryana Jat and an MLA and who had received grievous injures turned hostile because he had been bought by the Jat tenants.
    When the prosecution closed its case, counsel of the accused stated that the accused did not want to say anything in their Defence as the prosecution had failed to prove its case. I convicted and sentenced all the accused. The accused made a request to Sessions Judge Ranjit Singh Sarkaria ( who retired as Judge of the Supreme Court) for suspension of the sentence. The Sessions Judge refused to suspend the sentence and heard appeal after 15 days. He dismissed the appeal and maintained my order of conviction and sentence. I have narrated this case in detail in my autobiography in English which was launched on March 11 in Chandigarh Press Club by a retired judge of the Himachal Pradesh High Court , Sardar Surjit Singh.

      It is the need of the time that Indian Judges come out of the soberness of Fake human right activism,they have to acknowledge the fact that Henious crime culprit is going to pose grave threat for Indian society. If Indian judges didn't address the real issues of Indian people,then people will prefer more roadside judgement instead of long tedious,unworthy court trial and pardon my language even lunatics will not respect it.

      Judges can only deliver judgements based on investigation done by police , if they don’t do their job on what basis can the judge declare innocent or guilty

      @@Uneducatedopinion57 police reforms notwithstanding, it would be naive to say that judicial pendency is of no fault of the judiciary, especially when suo motu reforms for the other arms of Indian state are espoused by the Judiciary (eg recent EC judgements) but any other body's (executive/legislative) suggestions are always taken as interference (eg NJAC). It brings up the question of who's to guard the guardians

    The ground report from Sagrika Kissu regarding the Unnao incident is a MUST READ. The LOUDEST SOUND came from Unnao - the plight of a 14-year-old teen who was wronged twice. Yet, our JUDICIARY saw it fit to grant bail to the criminal who, upon release, set fire to her house. Her sister and son have endured 40% burns. Our JUDICIARY is UNABLE TO PROTECT EXISTING GENDERS but is BUSY DEBATING MORE Genders. The same judiciary proclaimed, "EVERY SINNER HAS A FUTURE" for a criminal whose VICTIM was a 4-year-old. I do not know about others, but I'd certainly prefer VIGILANTES over such a bonkers judicial system.

    When the law minister wants & comments on judicial reforms, it is interference by the Govt. BUT when justice delayed its failure of Govt. While the Govt needs to take blame, judiciary should take the major blame. Indian judiciary is so allergic to even suggestions of any changes.

    Sir , These cases are decades old and has transcended multiple regimes both at the centre and the states. What has not changed is the pathetic performance of the entire justice delivery system that puts a serious question mark on the independence of the justice delivery system.
    Interestingly no political parties including those who wants to save democracy and those who wants to clean it, have done anything to change the system because it has served and is serving the political class beautifully.
    So my question is how this system is better than those in China?

I am sure the entire left cabal will try doing the same in India when judicial reforms are proposed again after 2024 election.     Amongst lawyers there is an adage: Justice hurried is justice buried. But that doesn’t mean that a trial can go on endlessly and mindlessly. Judges too live in the same society. Probably, at least in UP, they were afraid to decide the cases speedily for the fear that the government might not protect them and throw them to the wolves. Less than a year back, we have seen how a high court judge who was on a morning walk was run over by a vehicle. We have read nothing about it in the media.

    Hi Shekhar Ji I was staying in Bhubaneswar in 2008, I was in my school those days. There was huge news in the local media that a person got kidnapped from Big Bazaar Bhubaneswar by a group of men on hun point and everyone went into panic mode as local police also registered a case of Kidnapping.
    Later it was found out that it was Delhi Police ATS who picked up Brijesh Singh and not even the local authorities were informed that’s why all the confusion . Just the story you mentioned in CTC.

    The weak judiciary is the biggest problem in implementing law and order situations. Still our judiciary don't want any reforms. Every CJI comes and goes and Complete his/her tenure peacefully without any radical changes.

    The blood of these gangsters as well as their victims is on the legal system.
    We need special courts for trying politicians and members of the Mafia.
    Fast track the cases with daily hearings. Every trial must be completed within one year.
    Witnesses must be given full protection including new identity and relocation.
    Witnesses must be able to give evidence and be cross examined on Camera, from remote locations with faces masked.
    We must learn from how Italy managed the Mafia.

    Witness protection, whistleblower protection is nonexistent in India.
    Still remember news of Karnataka IAS officer Anurag Tewari who was killed and left roadside when he went to UP. God knows if he got justice or ever will?
    Among all the nexuses (politician-builder, politician-police, politician-media, politician-judiciary etc etc) the common factor is the same.

    One common factor (mentioned in passing) is the justice system which epitomizes the saying "Justice delayed is Justice denied". That can never be corrected until & unless the system of self regulation is dismantled.

    In America, the Sixth Amendment to the Constitution provides that "the accused in a criminal prosecution shall enjoy the right to a speedy trial". This has become one of the most ridiculed statements regarding our justice system, because courts have been overloaded for decades, and the complexity of laws and of the entire legal process is such that it is simply impossible for anything to happen in a "speedy" manner. One documented case involving a lawsuit against a corporation by an individual, in its 12th year in court, was interrupted by the death of the defense attorney, followed by the prosecutor being diagnosed with advanced Alzheimer's disease - and the judge stated that they would have to start the case all over from the beginning. I have no idea if justice was ever served, (or if it even matters when deaths are not involved) - but there is a point in time where someone has to say "enough", and end it. It seems the more advanced a country is, the more ridiculous the drawn-out cases become. Maybe one advantage of nations run by tyrannical governments is quite speedy arrest, indictment, trial, sentence, and possible even execution in a very short time (days?)- then just move on. 😧

By now, we should've all understood that every political party, every politician, every criminal from every religion are the same. They play us against each other while they continue to do all the heinous things they want to. When someone has done wrong, stop debating it for or against his or her religion or political affinity. A criminal is a criminal. No matter which political party they belong to or which religion they follow.

    There should be appraisal system for judges like we have in our companies. Each week there should be review of what work has been done. If there is delay in passing judgements, then the judge should get a lower rating. This will help to get rid of underperforming judges. After all our country has abundent talents who can replace these people.

    I can safely say that in both the cases, accused were guilty of crime and acquittal is a nightmare for the victims family. Even the people convicted in Bilkis Bano case became free. Ultimately judiciary denied justice. Both executive and judiciary failed.

    Well said. The blame squarely lies on the Judiciary. It is due to their lackadaisical approach that things are going from bad to worse. The representatives in the system needs to be ashamed of it. Justice delayed is justice denied and we end up with the public heaving a sigh of relief when some gangster gets killed. It is due to this approach of judiciary that Powerful people care a dam about getting convicted in their lifetime. There is no fear and they have confidence in the system that they will not be punished.
    There is a Criminal Negligence Act even against doctors who work under pressure in case of emergency and are liable to be prosecuted for erroneous judgement.
    Judges who take their own sweet time to give verdict are still immune to any such act. What penalty do judges have if their judgement is overturned by higher courts - nothing. That's why a Jayalalitha is out on bail for a case and after her death her co-accused Sasikala, in the same case does not get bail for years. So much for equality - does anyone prosecute judges for improper judgement?

    Reforms required at lower level courts
    These reforms are difficult in states like UP, Bihar coz of Gunda raj so judges afraid to take right decision

I remember Shekarji's talk at CPR around Jan 2020, where you argued with a bunch of Political Scientist (Gil Vernier was really annoyed with you) regarding why you shouldn't simply treat data as reality. This article reminds me of the points you made there. Next time you argue with them, you can point to the stories covered in this article.

    Thank Shekhar sir for bringing nuance in the debate. There whole set of problems which are plaguing our judiciary and our police. Most of the time, with witnesses not being protected and the case being dragged in the court. Justice gets delayed or never comes.

    CJI's response at the India Today conclave:
    on too many cases: it's a sign that people still trust the judiciary
    on too many leaves: judges work 24*7 while preparing for cases
    I feel like a colonial subject at the mercy of milords.

    I switched off when he said “denial of justice is a secular phenomenon” while talking about the Naroda Gam case in the same episode. What a twisted thing to say.
    Yes politics has been riddled with criminals for ages but Shekhar Gupta continues to deny the turn of this country into an alley much darker than that - communal politics overstepping the constitution, the law and order, the basic peace and quiet that we all look forward to in life.
    Communal majoritarianism was going to solve the problem of crime in politics or corruption?
    Erosion of democratic values was going to solve the problem?
    Cracking open the societal fault lines into wide and deep chasms was going to solve the problem?

    Yeah, the Indian judicial system needs an overhaul, but the eloquent English-speaking judge-babus (like the general sarkari babu two decades ago) don't want to allow reform because it'll reduce their unaccountable power. The Indian justice system is 2-3 decades behind the Indian bureaucracy, which is about 3-4 decades behind that of China/Korea/Japan/Singapore.

    1. will the witnesses find time to testify every time, in each higher court?
    2. Will the original investigating officers remain in charge?
    3. Will the judges and lawyers continue to work on with same vigor, vigilance?

    Investigation takes minimum 20 years.
    Trial and appeals take minimum of another 20-25 years.
    Finally real culprit is acquited as innocent, for various reasons, or innocent is punished as guilty for many other reasons.

    If you want to understand a society look at the movies it makes. Every time someone commits a crime, as simple as jumping a traffic signal to as heinous as killing someone, Indian movies show the culprit feeling good about themselves and facing no legal repercussions. This shows people that in India no matter small or big, if you commit a crime, be rest assured that the law will not come after you and even if they do, you'll walk scot-free soon.

    the same justice system that refused to give justice to kashmiri hndus in their own land, shamelessly saying that they are too late.!!!
    the same justice system that appoints judges by the most nepotistic way (the real facistics)
    the same judiciary system in which 11 judges refused to hear Atiq's case from fear of Atiq Ahmed.
    the same supreme court which takes Weeklong holidays for Holi, Dussehra, and Diwali. 2 weeklong holidays for Christmas, 45 days long summer vacation apart from regular holidays. (And no body to stop them.)
    the same supreme court that wants other to address it as LORDSHIP (BC aisa kya ukhad lia inhone ) but wont do anything to archive that title.
    you know i could go on and on about this banana court but it just won't matter because these entitled fungus dont have any body to check on them (at least the fu** politicians have to answer to the public once in 5 years for votes )

    Haven't seen this video ... but instinctively let me share something..
    My fufaji fought a property case which continued over 30 years ... he passed away last year ... but the battles still wages on ...
    Expect prudently.. what else such an environment will give birth to ...
    The dare lies in accepting the reality as it is ... and the approach has to be top down ...
    One side we sell pesticides and another side we don't approve chemo therapy for the cancer so developed...
    And journalists (not particularly shekhar) .. will find a narrative..at which they are comfortable so as to survive around such environment..
    Not we watch and find out.. what is on the plate ..!

    Law and Justice are two different things and when the law of the land is unable to provide justice and protect its innocent citizens despite having all the evidence of the crime, the best alternate justice system is Yogi Ji's "thok do" policy. Thats why people are happy with it that these criminals and mafias are now facing what they deserved and common people can atleast live in peace.👏

    Judiciary system is worst in lower level. Come to odisha and see any district court where judges don't know the basics, cannot write proper judgement, reject the case and refer it to highcourt which are small and minor cases.

    Judiciary has let down INDIA big time. Lack of decisive judges shows either corruption or incompetence . Supreme Court is neither seized of cleansing internally or bringing judges displaying laxity in delivering justice to book. They are interested in cases which give them media coverage. This is not about to change anytime soon

    Failure of judicial system s root cause of all ills n society. Need large scale reforms. Leaders , meritocracy, promotion based on performance not age. Leadership courses/qualifications/trainings abroad, need leaders n judicial system to change system. Currently no faith n system to slow process by polititians to corrupt to anyone. Get rid of old colonial judicial system to modern relevant ones to the needs of indians. Financial penalty based on income will deter a lot especially rich with faster justice system
