    • @Vidrack

      9 million is roughly 30 thousand refunds, so that's good compared to the 5000 who stepped forward. But I doubt it's anywhere close to the actual number of Australian Error 53s given that there are around 8 million Australian iPhone users.

      Should snap them out of it though, because if they fail to comply they’ll get slapped with more. Compared to the American counterpart, the ACCC actually has some real teeth.Probably helps that our consumer law is written such that it only has to be behaviour is likely to mislead or deceive, intent doesnt have to be proven at all, though the fines do get worse if intent is proven. It’s arguably one of the most ingenious laws ever drafted. Gives no wiggle room whatsoever.

    Trust me this lawsuit changed so much at Apple Australia. As a repair tech before this happened Apple was denying service to any third party modified iPhone whether it was for a screen or battery or even for a whole unit repair.
    An important part of this ruling is Apple can not deny service to customers for third party repair if those repairs had nothing to do with why the device can not turn on.
    That is worth more then $9 million.

    • @robt8042
      @robt8042 6 лет назад +17

      This also applies to computers. So I can get my new iMacs' hard drive upgraded to SSD by a third party and still have standard warranty coverage which is consumer law in Aus. (Well I hope it does)

    • @evthink
      @evthink 6 лет назад +6

      Apple will just charge a lot more money for fixing such devices. Apple is too greedy to lose so fast. It's slowly destroying its base and screwing itself into a tiny corner.

    • @Swiftiify
      @Swiftiify 6 лет назад +8

      Varun Govind Also helps it means that apple
      Can not deny consumer law rights to customers in Australia who have modified there iPhones with third party parts. If a device has say an issue with the logic board say for example touch disease and a third party display and it’s under two years old Apple has to replace that device at no charge to the customer.

      Agreed, but the Australian case is more than an Australian court case-- it focuses public attention on Apple's persistent syndrome of deception. Ultimately, a corporation made wealthy by the trust of its own customers will fall when revealed to be incompetent and deceitful, preferring to harm its own customers rather than deal fairly. All too soon, mere possession of an Apple device will mark its owner as ignorant, gullible and undiscerning.

    3:00 - Security knowledgeable person here.
    They could have easily used the home button securely AND have it replaceable. You could have the fingerprint data stored with a HASH of the GUID of the home button sensor (to keep track of what sensor was used to create the fingerprint data). Then when the sensor is used, THIS hash is checked with the fingerprint data, and if the stored hash is different, that fingerprint data is invalid. They could have easily done a check on bootup of the home button sensor guid hash, to the one stored in the security enclave, and if they don't match, give a notification that fingerprint data has been erased because the home button has been modified.
    Then just let the user recreate their finger scans, and be on your way. This is 100% reasonable and SECURE.
    What they did is PURELY anti-repair/consumer, and is a HORRIBLE design....
    Faking the GUID on the sensor is next to impossible, because reversing a hash is only done through brute force / rainbow tables (pre-computed hashes). Apple could even combine the GUID of the home button with other component GUIDs for more security, and just invalidate fingerprint data. If anybody can fake that, they can surely make a device to crack the phone (modifying a chip's GUID takes microscopic surgery of a very delicate chip).

      "doesn’t mean that said company doesn’t make good products"
      This channel is chock full of videos about how Apple doesn't make good products. It's not about them making good products, it's about people liking enough about Apple to overlook the bad, or about disliking the competition more than what you dislike about Apple.
      I have a Samsung Galaxy S9. I'm not a fan of Samsung's bloaty skin and their slowness to update. But I hated everyone else's dumbass screen notches, lack of headphone jacks, and lack of SD card slots even more. So Samsung it is. Somebody could build a phone that I'd buy over a Samsung (if only Google would make a Pixel that isn't a fucking iPhone clone), but nobody has yet.
      And in the case of Apple, if you want iOS instead of Android... Well, guess you're getting an iPhone even if you're goddamn sick of Error 53 and Bendgate/Touch Disease and "you're holding it wrong". That doesn't mean Apple makes good products any more than my buying a Galaxy makes Samsung have great software.

    I bought apples 3, 4, 5 and 6 plus upgrading blindlessly all those years with their hyped marketing strategy that got me hooked... I've had issues year after year and the Apple store would recommend an upgrade thus I got an upgrade every time a new upgraded model came out... realized I allowed myself to be screwed by Apple all those loyal years and stopped purchasing any Apple products at all. I've switched to the android mobile phone after the 6 plus and have never been feeling better by paying an android phone that is reasonably priced with no issues on software screw up updates anymore and completely stayed away from their iPad's and MAC PRO and used HP desktop and laptops eversince the 486 came out and I'm FULLY satisfied with HP not screwing me up with their software updates. Watching your technical videos of how Apple screwed up and fleeced hundreds of thousands of customers into buying upgrades and making the old still workable iphones a perfect paper weight alternatives. I've stopped buying any Apple products when I faced the same arrogant Apple service crew when it comes to servicing errors but where so amazing when they enticed me to buy the latest iPhone and iPad products on display and I really got encouraged and purchased them because I saw other people scrambling to get hold of the boxes opening them on top of those huge tables .. several tables in fact which told my brains that Apple is the right product for me. I've learned my lesson on the way Apple markets their products and I won't be enticed into their marketing sales TALK EVER AGAIN. I bought my last Apple products from their Apple store in a suburb called Castle Hill in New South Wales Australia.

    Louis, it ain't no accident that you've got 900,000 subscribers (don't worry that number will soon be a million) you have effectively and quite legally created a mechanism that called the Australian arm of the Apple corporation to account. The dollar amount of the fine was a piss in the ocean I agree, but the media exposure given to this contentious issue will cost Apple more than any old financial penalty. I recall how Apple was cognizant to the suiciding Apple assembly plant employees in China, that was something they slithered out from to a fair degree. I'm hopeful that you read my comment based on your CBS accompanied look-see into the Apple Genius Bar video back in 2018, you will now fully understand the reason I had provided a dialogue about the typical corporation business model. Keep on keeping 'em honest Louis. I happen to be an Aussie from Tasmania. (the Disconnected Island State)
    Cheers for now.

    I think you have to understand how little people Australia has.. $9,000,000 in a country that likely had at BEST 5,000 people effected by error 53, is a win.
    Even if all 5000 bought refurbished phones to replace their old ones, apple only got $1,250,000 back (which is not all profit either). A fine of more than 7 times what they gained is pretty fair.
    And yes, it's nothing to Apple, but it opens the doors for other much bigger countries to do the same.
    If the rest of the world did this and based the fines off their average effected population, and at the same rate as Australia, then Apple would be facing fines of around $3 billion. Still affordable, but not something to sneeze at, even for Apple.

    I'm not a lawyer, but I am Australian, so I can tell you something about the law here. The dollar amount is actually symbolic. Everyone knows that Apple sneezes into golden handkerchiefs that cost more that. The point is that under Australian common law the ruling against Apple creates a legal precendent that establishes a rule that can be used in subsequent trials. In other words, individual rulings essentially become law until a statute or other legal event overrides them. The fact that Apple lost this case is actually a legal win for third party repairs. To state that clearly, it places the consumer's right to repair into law or confirms that principle through this ruling, so if anyone wanted in the future to sue on similar grounds their lawyer (barrister) would present this case to the judge and establish his/her case on those grounds.

      A little bit further to Sam Short short letter.
      The mere fact that Apple has been found to have engaged in not only deceptive behaviour to their Australia customers - they have also been fined that somewhat paltry sum {the MAXIMUM allowable unfortunately} because of their abusive and somewhat obnoxious disdain to their "loyal" customers - the upshot of this is because this will now stand as a LEGAL PRECEDENT for any future cases of tort ANYWHERE in the world!
      Unfortunately apple is not the only American firm who has tried coercion and strong arm tactics to bolster their bottom line profit margins - and for those who still live in the real world may - or may not know that printing companies like Lexmark and HP - as the two leading companies tried to enforce the consumers to purchase their consumables {INKS and TONERS} from the manufactures supply chain - or have their printers rendered useless if they tried to use perfectly good replacements
      Last May, in an 8-0 decision, the U.S. Supreme Court issued a highly-anticipated decision in Impression Products, Inc. v. Lexmark Int’l, Inc., reversing the Federal Circuit and holding that, when a patent holder sells a product, it exhausts all of its patent rights in the product, regardless of certain restrictions that the patent holder sought to impose on further resale. The Court held that exhaustion applies whether the product was sold internationally or within the United States, such that the patent holder may not bring an infringement claim for otherwise-infringing activities once the product has already been sold by the patent holder or its licensee authorized to do so.
      Similarly in the European Court of Appeals, HP printers were also dealt a death blow to their dirty tactics when they surreptitiously introduced software by way of their "security updates" in which they rendered each and every one of their printers inoperative if the owners used any cartridge other than the "official" HP cartridge
      AND furthermore in Australia - the usually useless A.C.C.C. surprisingly bared it fangs and also took action against HP printers when they installed their version of "Do what you are told" and installed their “Dynamic Security Feature” (DSF), was designed to prevent non-HP ink cartridges from being used in these HP printers. {www.accc.gov.au/media-release/hp-to-compensate-printer-customers}
      This normally flows on to others in the same industry - with the exception of Epson printers - who have ignored the decisions of the US Supreme Court against Lexmark, the E.U. Court od Appeal against HP and also the AC.C.C. Court Enforceable decision against - also against HP - who have continually rendered my printer {an XP-960 - 6 cartridge high end home printer} useless because I use a C.I.S. instead of their dear as poison cartridges - looks like another reasonably decision to be handed down in the not too distant future hopefully.
      So you might well ask - what has this all got to do with the apple way of screwing people over with their somewhat overpriced heap of electronic parts - is the people are beginning to fight back against severely under - engineered and more often useless bug ridden piles of electronic junk - with only the soy boys feasting on the soylent pap they are fed because they know no better.
      What one needs now is a similar decision to be brought down against apple - to complete the rot set in by these excellent decisions handed down in the Courts!

    The problem here is in order to pass new laws regarding this it will require new legislation, our country is run by millionaires, they will never pass a law that could ultimately hurt them.

Not to mention we saved the ungrateful European allied nations twice in a row(Granted that's falling in line with "shoot that shit up" and we're good with shooting shit up.)

But here afaik the fines are negotiated and the companies can accept them or not and they are always less than what they profited from that they were fined for. The goverment gets some money to waste, and the end user ends up 100% screwed. Pretty nasty in the cases of banks. There is 0 incentive not to screw the user, the goverment just wants a cut of that screwing.

      Australia has extensive consumer law. Basically, the law provides that warranties exist with their source in the consumer law, not within the companies specific rules. That means if you pay for an iPhone you automatically get a 'reasonable' warranty which cannot be voided by anything the company claims - including replacing parts with a 3rd party.

    • @ShaneGadsby

      It should be noted that while you'd be correct regarding the total profits vastly outweighing the fines, the Australian banking sector has been hit with fines nearing a billion dollars ($700M+) by the Australian finance regulator (AUSTRAC, granted that it was in relation to anti-money laundering laws. And the ACCC has issued quite large fines to ISP's/Telco's for misleading customers.
      Now the Aust. banking sector is (per capita) one of them most profitable in the world, but $700M+ in mandatory fines is a fairly good indicator of a regulator doing it's job.

Their sole purpose is to protect the consumer from retailers purposefully exploiting them as to make money but due to the law as you mentioned the lawsuit amount cannot be more than 9mil. But this serves as evidence that this issue is obviously in other countries and they would possibly be able to find them more than Australia can

    • @Abion47
      @Abion47 6 лет назад

      The fact that it cannot be more than 9mil means Apple can continue to do whatever it wants in Australia and the fines won't even make a dent in their net profit. The only silver lining in this is that hopefully this lawsuit will act as a precedent and the rest of the world will follow suit, but even if it does happen that will be a process many years in the making. By the time this and other current issues are finally addressed in a court of law on the international scale, Apple will have long since moved on to other more creative ways of screwing over its customers.

    The Australian judgement wasn't punitive, it was restorative. It was to ensure customers got their money back. The idea isn't to put Apple out of business, and it's especially not to scare them out of doing business in Australia. it's to set things straight. We're not trying to damage or hurt Apple. This is a win because customers got what they were owed. Nothing else matters.

      Did you read his sources? They say only 275 Australians were affected by this...yet he quotes "hundreds of thousands of people". His sources defeat his whole argument. Apple paid $9 Million for only 275 phones. Apple paid over $32,000 per phone. That is an abuse of the court system. Apple's net worth is irrelevant. I agree they should have to pay REASONABLE compensation, but paying $32,000 per phone is not reasonable. If you think a company should be fined based on their net worth rather than what is a fair and reasonable amount, then you are a communist.

    • @dekeonusb
      @dekeonusb 6 лет назад +1

      Apple should compensate users AND should be fined for breaking the law (Apple had the expertise to know they were breaking the law). The ACCC didn't engage in abuse of the justice system. The only abuse here is Apple's abuse of the Australian consumer protection laws. There is remediation to be paid to the users AND a fine for breaking the law. The fine is levied as punishment to deter future wrong doing.

    • @jimsmith3392
      @jimsmith3392 6 лет назад

      Bill Prendergast I agree, they should pay compensation and be fined. My point is that a fine should be fair based on the circumstances, not a company's net worth. If this was a small mom & pop computer shop that sold 275 custom computers that violated consumer protection laws, do you really think the ACCC would fine a mom & pop shop $9 Million? No, they wouldn't because that would be unreasonable. If it's unreasonable for a small shop then it's just as unreasonable for Apple. If this was "hundreds of thousands of phones" like Louis claimed, perhaps $9 Million would be reasonable, but his own sources say it was 275 Australians and approximately 5,000 world wide. Being that this case only applied in Australia then the fine should be based on the fact that 275 consumers were wronged. A $9 Million fine for what equated to 275 phones getting damaged is extortion, period.

  • @hellofyou

    The only iphone I've ever owned was a 6s i bought from my nephew fo $25.00. I quickly realized a major difference between apple and the rest. Apple is like a large boat. It never stops costing you money. I can vividly imagine one of the initial production meetings when they first started making these ridiculous devices. It was, "how can we design a phone to be a huge money pit." Top to bottom it is not upgradable like ALL the rest. After finally chucking the iphone that originally cost several hundred dollars, I bought another android, brand new for $55.00 total take home price. And I honestly believe it works at least as good as the apple and its camera and other accessories work better. I learned computers back before there was windows as we know it today. To run programs you used a DOS like command line. So not being able to properly name and fully manage the files I create on that device was to me, completely absurd. What sort of crap is that? Being able to just simply name your files is not possible. That is insanity. Isn't it? People are stupid to pay all that money for a piece of crap. What spell is apple using on them???

WHY?!?! And there was no way to easily disable this, if at all! This was to me the undeniable evidence that Apple users are all extremely retarded and barely know how to turn on and off a computer.

His own sources say that 275 Australians were affected by this. So Apple was fined $9 Million for 275 iPhones. That's $32,727.27 per phone that has a retail value of around $800. That is an abuse of the justice system. That is the Australian government stealing money from a business. I agree Apple should have been held accountable for this, I agree they should have fully compensated the customers for their trouble and paid all court costs, which at most would have been $200,000. This is simply an abuse of the justice system by the Australian government. If you think a company should be fined more simply because they are worth more rather then being fined a fair amount of reasonable compensation, then you are a communist.

    I've always laughed at these silly fines the big companies get. AT&T has been robbing people for several decades with bogus charges after charges on people's phone bills, yet once they get fined for one thing they take it off and put something else in its place!
    It's good for business to rob your customers because the fines are a mockery.
    I laughed so hard when they were fined a measly $50,000 for one of those bogus charges. That's pocket changes for them, found between couch cushions.
    AT&T makes several millions of dollars with each of those bogus charges, that they could pay the fine with the interest they are earned on their ill-gotten gain.
    So yes like AT&T, Apple paid maybe 0.05¢ in fines for every $100 dollar they ripped off from their customers.
