Let me lay it out for you, this is just an educated guess, but id be willing to wager serious money that its very close to the truth. There is a law enforcement agency that stops some poor bastard for some minor traffic infraction, the cops intimidate or violate or bluff him into a search of his vehicle and they dont find drugs after the K-9 unit comes and gives a false hit on the walk around, but they do find a significant amount of cash, so they manufacture some charges, arrest him, tow the vehicle, and confiscate the cash as evidence of a criminal enterprise. Then fast forward to they have not been able to prove the guy is involved in any way in any criminal activity now or ever, abd the judge has ordered tbe law enforcement to give him his money back. Fast forward a little more, the head of that law enforcement agency, the DA, and the judge get together and discuss how they could turn thst into a way to keep the money in the future. So the DA or the judge or both start talking to their congressman or a senator and they draft a bill that gives them broader powers to make it much harder to get your cash back but much easier to take and keep it for them. It goes before tbe house and passes, then the senate and passes, and they all negotiate their cut. And the next thing you know, BOOM, ITS RAINING IN THE CAPITOL. SO DOES THAT GIVE YOU A LITTLE MORE INSIGHT AS TO THE ORIGIN OF THAT PARTICULAR LAW?
Yep. You have money, and they have guns and the power of the state backing them, so the state robs you. Even though the truth is cowering behind a wall of legal flim flam, it really is that simple.
As a cop, civil asset forfeiture is one thing that really pisses me off. Yes, sometimes people are up to no good and items should be seized but if someone hasn't been charged with a crime they should be able to keep their money. It is nothing but theft that the Supreme Court has said is legal. It is ridiculous.
He said you make it possible for the Pirates .... Oh I mean the Police to steal your money and they were so nice to give him 500 of it back smdh that shows they knew what they were doing was wrong. Piece of shits
A similar thing happened to my friend. He served in the Army for 26 years and saved every penny he could when he retired he bought a new house for himself and a house for his parents and paid cash, the realtor had no issue with this. When he went to buy a new car he told the dealer "I'm not financing, I'm paying cash", the dealer said "I need to see ID and the cash", so my friend grabs the money from his car and shows him his military ID, so the dealer says " I need to get manager approval for this". So, my friend is waiting and suddenly a bunch of cops pull up with lights and sirens and the dealer points at my friend, they put him cuffs, take his money and take him to jail, they never read him his rights, they saw his military ID, put him in jail for 3 weeks without letting make a call, he finally tells the guy in the cell next to him who's about to be released to call a lawyer for him. The lawyer shows up furious, demands his release, he tries to get his money back and they don't have it, he demands reimbursement and they refuse, turns out after an investigation the money was given as a department bonus. He sues the PD for $150,000 and the judge decides it isn't enough and gives him $300,000, and the chief got fired along with the arresting officers. Oh, and their excuse for arresting him was "he must be a drug dealer" even though they saw and ran his military ID.
Good deal at the end but going through all of the bullshit and it probably took a long time, the judge should of added that he could punch the cops in the face and the pople at the car dealership

My legal advise: Request from your Bank a statement establishing that a given amount was "removed" from a personal or business account. Or in case the money was saved over a period of time, buy Travellers Checks or/Money Orders. Travelling with large amount of cash is not a good Idea. Normally in most auctions an initial deposit is required -- being the balance due in 24 or 48 hours.
Some people bring cash only because they know nothing about the tyrannical civil forfeiture law. On the other hand big drug kingpins are likely to know about that stupid law and have ways to avoid their cash being seized by cops. The fact that the so-called civil forfeiture is allowed to be used by bad cops to rob money from innocent people with assumption that the money is drug money even when the Dems are in power means the Democratic politicians are just as apathetic regarding this travesty of justice as the Republican politicians. Civil forfeiture has become an excuse for bad cops to commit robbery. It's a violation of the 6th Amendment which assumes people are innocent until proven guilty. This tyrannical law should have been repealed a long time ago after knowing that it has been misused by bad cops.

In 2014 Washington D.C. was attempting to keeping law abiding citizens from "keeping and bearing arms" (firearms). But the SCOTUS weighed in and their conclusion has been the same every time the question of fire arm ownership has come up for debate or scrutiny. The following page I found quite interesting a read. " www.businessinsider.com/the-comma-in-the-second-amendment-2013-8". My friend Stephen it all is insanity, fire arms do not kill people, every time i hear the left trying to "Infringe" upon our freedoms simple anger doesn't even come close to how I feel. I had a very similar situation occur in Phoenix Arizona going through Sky Harbor Airport, I had 50k on me, was going out there to purchase a combination I had found for sale of a dually truck and fifth wheel camper trailer. All but 1k was returned to me at the time and I tried for several years to get it returned only to be told to sue for it. No rap sheet for drugs or money laundering or any reason that could be construed as suspicious for having such a sum. During the interrogation I continued to tell them what I had such a large amount in my possession for, I even had the ad that I had printed off with several notes, sellers phone number and address. They never attempted to contact the seller in order to confirm my account of events. They returned enough so that I could rent a hotel room for the few nights it would be before the next flight back home and the cost of the flight. After returning home I had just a little more than $275.00 remaining of the original 50k. I have never returned to Arizona and would suspect their department purchased some new equipment for whatever purposes with the remaining 49k which I seriously doubt that I will ever see again. What stinks is I spent over 14 years in the military, and had saved this money from my time in and had planned to do some traveling. Sadly that has never happened. Word of caution, don't travel through an Arizona airport with a large amount of cash, you won't have it for very long.
See, this is where knowing your rights comes into play. If an officer approaches me and asks “do you have any drugs or money on you,” and I’m transporting say…$40k to buy a truck, then my response would be “my lawyer has advised me of my right to remain silent. I will not answer any questions. Leave me alone.” And walk away. If you refuse to answer questions, they can’t use anything you say against you. And if you tell them you’re invoking your right to remain silent, then they can’t use your silence against you either. But yeah, this civil asset forfeiture stuff is nonsense. and the Supreme Court justices who ruled that it’s allowed are traitors to the constitution.

I know of a guy who got stopped by an American agent in Shannon Ireland -he was settling his Grandfathers' small estate -he was wearing an 18k Gold and stainless Rolex and a pentagram -- he was going through a Goth/Pagan stage..Since then he was "on the list" stopped twice in 3 trips. Gave up going there.
Just saw a news story about two New Mexico business men traveling through Oklahoma on I40 when they were pulled over by a cop. They had $140K in cash on them that they were going to use to buy about 10 acres of farmland. Short story the cops let them go but kept the cash. They claim they had a right under asset forfeiture laws to keep the money if they believe it was going to used for illegal purposes. Even getting the guy they were going to buy the land from to verify they were telling the truth about the money didn't help. They lost their money to the cops even though the cops could not prove they were doing anything illegal..law says all they have to do is 'believe'' it might be used illegally. Congress needs to do something to tighten up that law so this can't happen to innocent people.
How civil forfeiture was ever declared constitutional is beyond me.
SO DOES THAT GIVE YOU A LITTLE MORE INSIGHT AS TO THE ORIGIN OF THAT PARTICULAR LAW?
this is case of police using the law to steal from lawful people who need to use cash.

My friend Stephen it all is insanity, fire arms do not kill people, every time i hear the left trying to "Infringe" upon our freedoms simple anger doesn't even come close to how I feel.

Even the supreme court ruling it's not unconstitutional just gives law enforcement carte blanche to continue.

@@sfm45 The only valid way to do this is not sign anything. If you sign it, and later claim it was 'under duress' it doesn't matter without witnesses, and duress has some pretty clear specifics needed to qualify, like threat of losing your life. So, the only clear path forward, as risky as it is, is to be arrested where you can at least get it into the public eye and in front of a judge.
They need to be able to sue with triple punitive damages and legal fees covered !
It's not like cops will pay out of their pockets (if you win), so they generally don't care about being sued :( Which is another problem, or part of a problem.

I live in kern county, my brother lived in a residence without permission as the property owner was deceased. He lives there for over 8 yrs meaning adverse possession applied. The county served him with an eviction notice to get him out, then told him if he paid the back taxes he could stay. He sold all his possessions, barrowed money, etc. Paid the 12k back taxes, only to go to court for the eviction and be told by the courts that since the court clerk errored on putting the wrong case number on the wrong form his case is thrown out and he has 5 days to leave or go to jail.the courts also said the 12k would not be returned since it was owed by the property owner and the state has the right to collect the taxes owed even though he didn't own the back taxes.
I thought my whole life, including childhood, that nobody understood how wrong rules are applied and how inequity happen when people use them for their own benefit and manipulate the odds in their favor. I was especially astonished by all the people that fervently believe they are protected, while it is obviously the system that is against us, how people could describe 'criminals' as threats to society, while society eat it's own people alive and turn them into those criminals for benefit. We are being blackmailed to work in the interest of others who are protected against other ways of doing things, it is not only disgusting but abhorant, and I still don't get how people can willingly stay ignorant unless when it touches somebody they care about.
Thank you Lehto for making me realize some people know what's going on, yet our hands are already tied because people made it degenerate that far, we just have to be educated about it and how to defend ourselvs from that system who has an hold on us, our rights, and liberty, because they are conditional.
Congress could easily legislate civil asset forfeiture out of existence. Or place limits on it to prevent abuse. Voting matters.
Dude I just wanna say you’re awesome and an integral part of my childhood 🤙🏼
Yes Congress could easily legislate CF out of existence.
Yet cases like the above and there are many of them are still happening.
It does appear to be a violation of ones civil liberties - people going about their lawful business.
Considering, as Steve said, the courts have deemed CF *not* to be unconstitutional, this I would suggest, congress is happy for this to continue...
Seize the profits from criminal activity by all means.

does it really? I am not sure sure it matters in modern times. Do you really think over 80 million people voted for Biden? I am seriously consider that.

I've met guys in the middle of the night that required " Civil Asset Forfeiture", they carried guns too.
When I was back in high school in the late 1970s, one of our assignments in US history class was to write a hypothetical letter to a colleague in the Soviet Union explaining how the US Constitution protected us from being deprived of life, liberty, or property by the government without due process. It’s extremely disappointing and frustrating to now realize that what I wrote was a lie. It’s even more frustrating that the US Supreme Court has sanctioned this lie.
@Warren Higgins Civil forfeiture abuse didn’t start with the current administration. This issue also transcends typical right - left politics. Fortunately, ‘liberal’ civil liberties advocates and ‘conservative’ smaller government libertarians can, should, and will unite in opposition to these flagrant abuses of the US Constitution to bring this nonsense to an end.
In the1970s it was no where near as bad as it is now. The war on drugs that was ramped up in the 80s and 90s is what has lead to this.
its helpful that people are starting to realize it was a lie. only when the vast majority of the population is ready can we make it actually true
Ahhh...high school indoctrination. Good times.
The United States is broke and needs people like your good self to stand as surety for the national debt all while robbing you in every way possible. And people thought it was just taxes. Ha!

Cop takes your money go to police department then file theft charges against the police officer, say he did not charge or arrest me then stole my money.
Unfortunately, Phoenix PD wouldn't bother to investigate if Kamala Harris snatched a woman's purse in front of them on live television. This is just some professional thieves making good for their worthless bosses.
It will work to file charges from one Man against another Man. Do not sue the CORPORATION (PERSON).
if you individually sued the police officer that took it from you, they'd have it dismissed on qualified immunity. Even in a state without qualified immunity the court would likely say... you are suing the wrong entity; Since this person took the money as part of their duties as an employee / police officer, you have to sue their employer / the police department. That suit would then get dismissed as civil asset forfeiture is legal and no one has done anything to make this illegal - mostly because of the massive amounts of revenue it brings.
Cops commit crimes all the time, with impunity.
Its legal for the cop to take it and keep it. Its the cop's money, not yours. He can take your life, too, so best to STFU.

This happened in a town in north east Texas. A woman and her husband were travelling to Texarkana,Tx to buy a car. They were pulled over for a basic traffic violation. The officer searching them and the vehicle found a large amount of cash. I think around $3,000.00 . She was threatened to have her taken by CHILDREN PROTECTIVE SERVICES unless she relinquished trying to get there cash back. So a state representative has taken the law to the capital to change the law.
They need to start getting the names of the officers involved display them on social media.
The money was stolen in Phoenix to make it more difficult for the victim to get it back, ie: he lives in Charlotte.
You can bet the guys in Charlotte are getting a cut.
Oklahoma allows you to pay an extra fee to not report a traffic infraction after paying the ticket, so your rates won't go up.

When I first started hearing about these “forfeiture” cases years ago, I immediately made a point to never carry more than $500 in cash on me. If I need to pay someone thousands of dollars, I do a cashier’s check, direct bank transfer, or a payment app.
It won’t stop. It’s worth too much to the local jurisdictions.
The feds also incentivize it by having a sharing scheme

My father was a federal agent then police officer; he was tired of all the bs government could get away with, this was the late 1960's. Later he saw other police officers shaking down black teens and placing guns and pot on them to take them in. He spoke out, but they just ignored him. He worked in a very upscale wealthy city. When Black Stars and Slebs, where were moving in the area, the cops were still giving them grief. One multimillionaire foot ball star, was arrested for trying to "break into" his own house. He kicked in the screen, lost his keys... my dad told everyone this is... So and so... the other cops were like who? Whatever... My dad more or less told the court, and the football star was cleared... but all of this time later, this is why until five years ago, we would always have season tickets to any home NFL game in our state; since 1981. LOL!!!! That guy made certain!!!
Maybe they are people that hate people that sell drugs and ruin lives and see a bit of karma here.
Steve, in the absence of a warrant, probable cause is needed for lawful search and seizure. Simply carrying a large amount of cash isn’t illegal, so what legal justification is being used to meet the threshold for probable cause when there was no crime witnessed or reported?
They should make it where if the government loses the case then they should have to pay all your attorney bills.
