  • It's that time of year when Texas homeowners want to know how to protest their property tax valuation. It's right about now that we get a nice little letter from the county appraisal district to let us know how much we will pay in property taxes for the year.
    If you're like me, you kind of wince when you see the letter and then get wide-eyed when you open it and read the updated market value. This year my property went up an additional 6 percent after going up 52% last year.
    In this video, I'm going to explain the differences between market value and assessed value, what exemptions to put on your property if you don't already have them, what comps to use if you want to file a protest, the timelines to do all of this, and some general things to keep in mind. Lots of information here but all important to know if you're a homeowner in Texas because there have been changes to some of the laws from the last session.

    Buyer Beware….yea, no state income tax but OUTRAGEOUS PROPERTY TAXES….good luck “ fighting” them….you have been warned

    Jennifer, your comps helped me reduce the price on current homestead by 51K this year in 2023. Thank you for the service to the community. We will definitely keep you in mind on future real estate transactions. Saved me a total of $1250 @ 2.5% tax rate.

      Glad to be out of Texas. BS to use actual comps to protest after 4+ years of a nonsensical market bubble. All the comps have their values affected by the same silly price problem.
      Pathetically the population accepts this quietly. You should pay taxes on your earnings, not on the purchases or your primary family home period!
      I would rather pay 4-5% State income taxes and very little property taxes.
      Do the math and it will make sense with an exception if you make lots of money and live in a shack.
      My old Texas home tripled its value, and what use to cost $8k turned into $25K in property taxes. Might as well rent an apartment and have no insurance to pay, repairs, yard, or pool to worry about. As you age, your income decreases and so your State taxes, but that does not work for home assessment values.
      The Counties are probably parting every weekend with nice meals, wines, and champagne every time banks drop their loan rates and people get the itch to move.

      Your income increase a mere 10% for the past 3-4 years hopefully. Then a few lunatics sold their shack for $1.5M then come to Texas and pay $900k for $200k homes around your neighborhood, you will soon be homeless for not being able to pay for your property tax for a $900k assessed home.
      Pathetically the population accepts this quietly. You should pay taxes on your earnings, not on the purchases or your primary family home period!
      Why waste time electing snakes that will come after you and instead of fighting for you?

    Explain the Homestead Exemption Exactly ! They Decreased my market value, but they also decreased my homestead exemption enough for my assessed value to stay the same, and my school taxes went up. The homestead Exemption was a huge decrease !!! Please Explain !!!

    I have almost 6 acres in Kendall county, and live out of state. My tax assessment went up 51% last year which was hard to swallow. This year the increase is 481% That is not a typo. 481%. !!! This is just land, no utilities, no well. My mother has 9 adjacent acres with a shell of a house (nothing but drywall installed, no septic, appliances, kitchen or bathroom) that my father was building to retire to after he beat lung cancer, but then it came back as brain cancer fought it for 19 years and passed away. The house is still just a shell, almost 20 years later. Her increase went from $2500 to over $6100. this year. I’m not sure what the increase was last year. She also lives out of state, so not eligible for homestead exemptions. We recently were at the property trying to figure out how to complete the house (a small one bedroom - more like a cabin) but now this increase in taxes has killed our hopes of this. Being out of state (PA) makes it difficult since we were not aware of the protest process which we have until the 31st (which is now just a few days away. Looks like we have lost our dream of completing the house.

      Hi @mymewow - I'm sorry to hear about your father. As far as the land - I've heard a lot of people have had similar stories with massive value increases. You might start the protest digitally through the appraisal district: eprotest.kendallad.org/ or reach out to a company like www.texastaxprotest.com/ to help since you're out of state.

    So even in Texas you don't own your property lol I wonder if there is any place where you actually own your land anymore or is everyone just renting it?

      Since Texas does not have a state income tax, they have to levy higher property taxes to pay for schools, roads, police and firemen, emergency response services, libraries, parks and other services provided by local governments.

      Short answer is no you can't own it regardless of why it is being taxed. Just because Texas doesn't have a state income tax and they have to tax our homes doesn't meant we own Jack Doodly Squat. They own and we rent it.

    Can you use the same damage repairs from last year to reduce your next year market Value if repairs can not be made to reduce your market value again.

    So what if the county doesn't honor realtor comps. I took mine in, it was saying my property was worth 100,000.00 LESS than what they were going to tax me for. And then I showed images of severe termite damage and roof damage. The board guy I met with for my hearing pretty much ignored the comps and just took off 50,000.00. I was like Sir, my house needs so much work as well as the property does- it isn't worth that. They didn't even want to look at all of the evidence I brought in to support my case.

      In general, if there is work to be done on the house, getting estimates from contractors helps set a number.

    What happens after a person successfully protests their taxes and gets a lower appraisal?
    I turned mine into my Lender and assumed my taxes would be adjusted or receive a refund.

      Has the taxing authority updated your tax due? Your lender may prefer documentation directly from the taxing authority. Your lender will have to tell you the exact steps to take to update the total amount due. They will also have to tell you if they will issue a refund from your escrow account.
      I believe the likely scenario is that at the time your lender performs their annual escrow analysis on your account, they will then factor in the surplus and adjust your monthly payment at that time.

      @@Kevin-yk7tk They will wait for your county's tax assessor to send them the tax bill, which shows the final tax amount you owe.

    Hi Jennifer, your video was very imformative. We moved to Texas and bought a home in Oct of last year, and are very untought as it relates to these topics, so thank you. We did recieved a notice but paid little attention to it as we were still figuring things out. Now, I am looking over these documents and watching videos like yours and having regrets for not giving the necessary attention to these documents. Which leads to my question for you: for the coming year 2024, is it possible to protest the proposed appraised value from the previous year, especially if it went up a rediculous amount?

      Hi Eddy - If you bought your home in October 2022, the tax rates and appraisal amount would've already been set by that time. Then since there was a deed change, my understanding is the previous homestead exemption goes away (if there was one) and then your assessed and appriased value changes based on the current market. In March/April, your notice of appraised value would've been delivered to you and it would reflect the value of the home based on January 1, 2023. The appraisal district typically uses sales from the previous year to determine value. So since you purchased in 2022 and they would've used sales from 2022 for your 2023 valuation, if your purchase price was less than your assessed value, I would bring that to the attention of the appraisal district.
      According to the state Comptroller's website (comptroller.texas.gov/taxes/property-tax/exemptions/residence-faq.php) "A late residence homestead exemption application, however, may be filed up to two years after the delinquency date, which is usually Feb. 1."
      My recommendation would be to contact your appraisal district and have a conversation with them about your options for the current tax bill. Then next year, when you get that notice in March or April of 2024, you can protest your appraisal amount at that time using 2023 sales comps.

    Can a homestead exemption increase cap apply in cases of inherited property of you live in that home?

      Hi TJ - It depends. Only a homeowner's principal residence qualifies. To qualify, a home must meet the definition of a residence homestead: The home's owner must be an individual (for example: not a corporation or other business entity) and use the home as his or her principal residence on Jan. 1 of the tax year.
      You can contact your appraisal district to find out for sure.

    My market value is higher then my appraised value and while protesting it will lower the market value. It will not drop below the appraised value, knowing that, is it really worth protesting, or should I wait till the following year and see what its looks like then?

      My understanding is that since you're taxed on the appraised value, if the market value is still above it after your protest, it won't affect your amount of taxes paid. You should verify with your appraisal district.

    I signed up with Ownwell and they no-showed for the tax protest meeting. I called Ownwell a week prior to the meeting and was assured that they were aware and would attend. A no-show at a tax protest meeting in Houston’s Harris county means the appraisal is certified uncontested. My monthly payment increased $200+ due to negligence by Ownwell.

    So I challenged my property valuation this past year and got it reduced along with many others around me. Great, right? Now this year, my home has actually gone down in value while the land has gone up considerably in value. Any advice for how I can challenge the land valuation?

      Hi Mark,
      You might try the map search feature on your appraisal district website. You can look for parcels of land similar to yours and see if their land values are lower and use their land assessments as evidence to bring yours down. If there are other sales of homes similar to yours on lots similar to yours, you may be able to present the overall sale to support a lower value.

    It"s not worth Protesting because they can use the Homestead Exemption to their advantage. For Example the Higher The Market Value, the Higher the Homestead Exemption. The Lower the Market Value, the Lower the Homestead Exemption. And this keeps the Assessed Value the Same. I Pay Less in Federal Income Tax then in Property Taxes.

    She stated that there is a Military Veteran Exemption...not quite...only for Disabled Veterans. And of course they deserve this, but the way she stated it as "all military veterans" was misleading.

      Hi Mark - You are right, I should've added the word "Disabled' at 2:39 in the video where I list out the types of exemptions you can apply for and say, "Military veteran exemption." I don't actually say that it's available to all military veterans but can easily see how that is assumed based on the way I presented it. Thanks for providing the clarification!

    You are protesting the wrong issue! Don’t protest the amount…protest where the authority comes from. In a brief, taxation of your non commercial property is being misapplied by your county under the color of law. Protesting the amount of the tax in essence is saying you think the tax is ok, just not the amount. Taxes are handled locally, not by the state. Constitutionally speaking, the state has no inherent power to impose taxation on your non commercial property used as shelter. If the state has no power, there is no power that can be passed to your county. This is an extensive research of Federal and State Constitutions, State Statutes, State Administrative Codes, Blacks Law, American Jurisprudence, and case law already decided by competent courts. The research is based on Florida law and your state too will have similar laws being that all states must be in compliance with the law of the land…the united States Constitution.

      If you've only done the online protest and were declined, you might request if you could have a hearing with your appraisal review board to present your evidence to a panel for consideration.

    If Saudi Arabians would quit buying up land in Texas at triple the market value, then we wouldn’t have this mass influx of prosperity taxes. But remember folks! These tax assessors are making the appraisals go up 300-800%! Even if Texas passed property tax relief, it would only cut your appraisal in half. So they are still going to value your land even at double. Charging California prices, with a small Texas income. They want you on the streets! 15 minute cities!

      Someone has to pay, and since Texas has no "income tax" most of it comes from property tax. Here in California, we passed a law saying they cant raise your property taxes more than 2% a year. So the house I paid 200k 10 years ago, now has a market value of almost 600k. But I still pay taxes like its 200.

    I’m with Greg Abbott. I’m disabled with four brain surgery, four back surgeries with rods and pins on my back, left lung damage, hypertension, and my house needs a lot repairs after 18 years I built it. I’m still getting appraised taxed more than what I spent building it. I paid not more than $71,000 dollars for a 2100 square foot home in San Antonio Texas. I paid cash with all my savings, no bank loans nor mortgage loans at all. My tax was $1800 first few years, $2700 4 years later, $5000 years later and still still going high after I protested over and over again that my house is definitely not worth half of value. All evidence took to them, but them democrats are keep raising taxes on same damage home. Like Greg Abbott said, we own our home, why pay rent to the government. By the way, I get no government assistance because my wife makes over $1800 a month and less than $2300 a month. She has to work two jobs to just make car payments home and auto insurance, groceries, utilities and very little household. Free Texas land for homeowners.
    We live in free country of America, not in a communist country. Go Greg Abbott. Real estate agents gets paid for high sales of properties and homes, the more it appraises, the more commission they make on ridiculous high taxation appraisal. We’re getting worse than California on chicken cooks house for a million bucks.
