I wonder how all the new NIL rules in the NCAA will impact this. I heard in another podcast that the NCAA is in discussion with Hockey Canada and the CHL to try and figure out how to allow those players to participate in NCAA.

I'm not sure how I feel about it but I think that just doing the try out process shouldn't exclude you, however if you go play the OHL for 3 years I'm not sure if you should still get to go to the NCAA but maybe I'm bias because I feel its going to negatively impact USA hockey and our players. I could be wrong.
What happens if you sign a tender with a ushl team, but then you commit to play for an Ohl team that drafted you 3rd overall? And you proceed to play for the Ohl team?

you lose your eligibility, then you need to do well in the OHL.
