  • There is a fine balance between law enforcement duties and individual rights. In some cases, this balance fades and officers disregard the common basic law of the constitution. There are constitutional, legal grounds on which one can refuse to ID to police in public spaces, especially when engaging in activities protected by the First Amendment, like journalism. You can see how law enforcement needs to be better trained in the laws regarding detainment and ID requests. Sometimes even respectful communication and legal knowledge might not suffice when talking to opinionated police officers. And that is when one gets to sue the police and get a settlement.

      The cops don't care if you can win in court cause you still gonna spend a night in jail or longer if they use the system to their advantage and deny bail till you can see a judge. They will also not press any charges but also will not dismiss the case so you can't sue them for several months to a year after the arrest. The whole system is corrupt.

      I used to work at a warehouse and if even scratch something driving a forklift you get pulled of and need to do a mandatory retraining (not the whole course, just the main points and the final test - if you failed the final then you had a big problem), I don't know why cops can be so wrong and at most get slap on the wrist with no retraining of any kind.

    You should hold these Tyrants accountable. 1. Give notice you charge $50,000 per min for unlawful detainment which is a form of arrest. 2. Give notice that a commercial lien and injury will be filed in the amount of the lien amount n them personally. 3. File a UCC LIEN against them personally. 4 Send notice and watch them cry a beg to have it removed when they find out they can’t sell anything until it’s removed.

      They aren’t ignorant. They know exactly what they’re doing. They know their qualified immunity will protect them in the very rare cases a citizen has the knowledge and financial ability to press a lawsuit, they know that tax payers, not their own bank accounts will pay the penalty.

      People need to recognize the limitations of qualified immunity and judges need to uphold the letter of the law when it comes to qualified immunity.
      Qualified immunity does not protect officials who violate *clearly established constitutional rights*.
      There are other limitations to qualified immunity as well. According to SCOTUS "qualified immunity protects all except the plainly incompetent or those who knowingly violate the law".

Training is a contributing issue. I think being a cop should be reserved for those who have gone through military training, which would bring its own source of problems, mainly scarcity.

    All cops should have some sort of “lawsuit insurance” and works like car insurance. More times you get sued, premiums go up. Tax payers shouldn’t fit the bill.

    Cops need to provide their own insurance for bad decisions instead of taxpayers money being used in lawsuits. Also, massive reeducation is necessary to clarify issues. As RN'S in corrections, education modules were on our computers, and we had to pass competency test to continue our employment. And once yearly; we went to off facilitys in person training.. some of the things i remember included de*escalation and communucation skills, self defense skills without lethal weapon, field sobriety tests. And use of tasers and restraints,, both physical and mechanical. Legal holds also, everyone had to allow themselves to be tasered, cuffed, and placed in a police vehicle. I think these things made us all better employees, and even though we were department of corrections and not police, we were better civil servants.😮😮

They must have reasonable, articulable suspicion that the suspect has is or will commit a specific crime in order to detain. Terry, Vee, Ohio required that the officer have legitimate suspicion prior to a pat down of the person. Once the person was found to be in possession of a firearm illegally, he was then require to identify. I understand there’s some confusion about that case, but those are the actual standings.

      According to NC law, the ID requirement is only for someone who is driving. Otherwise, you have that evidence of criminal activity; which is lacking here.

      That is not what the issue is; and even so, I would not like it when some random dude strolls by my house, filming, especially since I have an elderly mother & father, with a young sister. That is creepy as all get out; but I know why he does this. Go onto property, film, get told to leave, or be a "journalist," in public, filming everybody & their sister, get asked by the police, which is lawful, on the books in many areas as prowling/suspicious activity, & also, in many states, if asked, you must present an ID. The crime? If you have no issue with someone cruising around your hood taking video, more power to you. I live in a high murder, rape, burglary, carjacking, & home invasion town, where people will case homes, & the like. I know this cat was not but Joe blow on the street just sees someone with a cam. Normal people don't walk around filming every single thing. Critically think. Sov sits, man.

      @@brianwilson6950 If towards me, yes, it is legal to film in public; the part that warrants police investigation is the fact people do not normally walk around filming everything. This video is so short, it is not known what he was doing before. Even if not filming, a lot of states have a stop & ID law. If you cruise a drug neighborhood or strip known for hookers, usually that is what you are looking for, which is suspicious, & can warrant an investigation; when investigating the act of a possible crime, peace officers/law officers can then request an ID. Those who fight back usually are hiding something. If you refuse to ID that then is obstruction, & becomes a felony charge. If marked in the system, every time you get stopped, it automatically upgrades it to a multi-officer present stop. Easy as pie: cop stopped me & my cousins. Hanging out innocently in a closed ball park. Asked who we were; we answered & explained what we were doing. Boom; done. No chase; no back & forth. White kids & a black public safety officer. Sov sits; cop shows up. Instantly with resistance. He films for a reason; a view & a rise. Sue happy.

And vote a Mayor in who will change the Commissioner, who then has the power over the Chief or Sheriff. Nothing is perfect, but the PEOPLE have to be 'ACTIVE' here. If The People just sit on their ass & do nothing, & wait for "DADDY" to take care of everything, HE WILL ! And you aren't ever going to like the results ! Now, maybe I'm wrong here, but it seems to me that a lot of these problems could be solved by PEOPLE BEING ACTIVE IN THEIR OWN COMMUNITIES !

    Growing up I remember my uncle, who has always been a really good guy, saying never call cops. They just make everything worse. I remember being puzzled at that statement as a kid but now I get it. Unless someone’s being harmed and assaulted in anyway, there’s really nothing good about being in their presence.

    I saw that other video of that law student asking police specifically, "I need to hear you say it that you'll arrest me for ID refusal. I'll gladly give it to you after you say it because it opens grounds for litigation." If everyone says that and gets that recorded verbal confirmation, then cops less likely to be pushy and its easier to sue for violated rights
