I just had a nice conversation with Joe Frei, the city Administrator for York Nebraska. He started off pushing that auditors are "aggravating" or "frustrating" trying to get the Police to "lose their cool". I think he finally HAD to concede that his position is wrong. I think I made him see that the public is turning on the police and if something is not done.....very bad things will follow!!
He never files a lawsuit he begs his watchers for money and he does nothing. I can't stand him or the way he does his audits he is not out there to correct them he is out there not working a job or anything except traveling around and begging for money. He could sue but never does. I never will support this piece of shit.
I've long called for the IA to be completely separate from the police force and building, that all complaints should be handled immediately and that if they fail to begin an investigation within 1 week of receiving a complaint that they are fired, that would prevent cheating.
Even in places where local "government" has put a "civilian review board" in place, only the most egregious offenses by police are confronted. The police union is more or less ALL POWERFUL.

This officer had been terminated from the Omaha police department for multiple issues with his alcoholism. He went to rehand for three months while working for the department. He failed to show up to his required Alcohol Abuse classes regularly and failed to submit any proof of his attendance to AA as was required to maintain his employment. After that, he was found to be drinking and driving by a fellow officer, but he was let go without any charges. Instead, he was placed on paid administrative leave. After this, he failed to show up to any more of his counceling. Finally he was told he could resign or be terminated, and chose to resign so that he could go get his new job in York. Judging from his rosy red cheeks and aggressive demeanor, I would suspect that he has continued to abuse alcohol and is possibly under the influence of alcohol or other narcotics while on the job and carrying a gun, which would be a violation of a prohibited person in possession of a firearm. With cops like that around town I can only imagine what their criminals must look like.

All he is doing is being the equivalent to a secret shopper but for the police hierarchy. All they had to do was give him the form and he would have left. They were apparently so paranoid and guilt ridden though that they couldn't take the chance.

A representative of the general public that has every right to expect competent and professional service. The onus is on the police officer to provide that. A business can ask your name that is correct however in the end they should still not know you are a secret shopper. They do get plenty of hints though since you engage in all areas but only walk out with a small cheap item. I used to be a secret shopper. I only broke cover one time when I saw something wrong with an important piece of signage. No, I don't remember what it was anymore. Too damn long ago. In the end though if he asked for a complaint form he should have been given one and left alone afterwards. No if ands or buts about it. It is not the officer's business what is written on it and should probably be returned in a sealed envelope addressed to the appropriate party/office/dept. Nobody else has a need to know before they review the form. This is also a specific type of audit in order to see what they would do in a specific situation. Fact is they failed.
@thunderbird002 The only way an ordinary officer needs to be aware of what is on the form is if HE is in charge of the investigation. Otherwise he is interfering and obstructing. There was also no indication that they recognised him specifically. Maybe they guessed he was an auditor but in that case they went out of their way to fail. see you can put it both ways...the auiditor pushed the cop to get that type of response and people will always have a breaking point. Like the whole "are you trying to bump into me" as the cop walked past him. That was him purely trying to goad the cop into doing something. So when you poke at a bear, expect him to get angry. Also the second he tried to prevent the officer from running his tags/vin which is public knowledge and not protected by anything, and can be run by the cops at any point in time they feel like it. He at that point could have been charged with obstruction of a police officer and his partner that started cursing at the officer could have been charged with assualt, since cursing at an officer is seen as assault is some states.

By him actively putting his hand over the VIN number and by her standing directly in front of the licence plate they did just that. Those things are public knowledge and the police and look at them or run them all they want and if you trying to prevent them from doing that, it's obstruction. Like I said he was antagonizing the officers, with the "are you trying to bump into me" stuff and other things that he was saying. Like I said they all could have done better with this EDIT: also some states made cursing at a officer a form of assault, while most things you say are protected by the first amendment, an officer may arrest you for it, it is usually at their disgression if they choose to do it or not. Remember for minor things an officer can just let you go, give you a in person appearence ticket or arrest you, all depending on how you act towards them. It takes money to bring litigation. You must hire an attorney, and they ain't cheap. Then, they make you show up at several different hearings in a courtroom wherever you're doing the audit. All this costs time, and travel expenses. A little, podunk town could draw it out several years, and make a complainant show up a dozen times before it's ever adjudicated.

I ask this, because in this situation, based on this SARGEANT's words, intimidating behaviors, and overall series of extremely poor choices - including resistance to assist in formally submitting a complain - be it legitimate/warranted/real or not. If you look around a little - you will find a shocking amount of factual evidence that clearly indicates systemic corruption. The cops should not police the cops. I've watched quite a lot of "audit" videos since I posted that comment last year, and there are SO many examples of cops doing their jobs poorly and literally not understanding the laws they're charged with enforcing. I fully respect people who are trying to instigate some change there.
I went to my local police department for a complaint form following an accident in which a young man rear ended me. The reason was that the officer who processed the scene of the accident lied on the police report (FYI: the young man who hit me was the son of a fellow officer). Due to the way the police report was written prevented the other young man's insurance from paying for my damages and physical injury. I was in luck because the sergeant got involved. He reviewed the dash cam and police body cam and agreed that the report was written in a way to excuse liability by the other party. An amendment was written by the sergeant and officer involved was reprimanded. I re-submitted the police report and was finally compensated for damages and medical care (it took 6 months, but I eventually won my case). I don't think most people understand that police and their departments can be very corrupt. What is needed are honest leaders at the top to keep things in check. Without good leaders crooked cops keep doing what ever they want.

I used to have a coworker who was married to a police officer who was extremely abusive. One day when he was beating the crap out of her, she called the police. When they came, they did everything they could to protect him instead of helping her. The police protect each other.

I’m glad you mentioned the DOJ website. A lot of people who have trouble with an officer don’t want to talk to his colleagues. And to police officers in this situation, really, you should understand that some citizens really want to have things on paper. It feels less confrontational and more formal. These guys act like this is a nut job rather than a potentially legitimate concern.

@@richardingame Obviously youtube has a much bigger audience. However, giving it to the local news ensures that alot more locals will see it. That in turn allows for the biggest chance of actual change taking place there. So yes, while youtube may show this to a wider audience it doesn't mean that the people living in that jurisdiction will see it. The rest of us can watch this all we want, it doesn't mean that we are more likely to force a change. Leaving a comment and dislike on this won't actually help the local people that are needing it to change right now.

A local news station in Chicago ran an investigative report on this very issue a few years ago. They sent people ( undercover with a camera) into police stations to ask for complaint forms. In every case these people were met with open hostility with some being threatened with arrest if they didn't identify themselves. Cops stick together right or wrong and they see it as you vs them all too frequently.
How would you like someone to just show up, out of the blue, at your job and start asking for complaint forms? Wouldn't you think they were unfairly trying to wreck your livelihood? There are some employers that wouldn't wouldn't care how innocent you are, they would have you kicking rocks

@@kolibad No they were there because of prior complaints by the public on how the cops were intimidating people when they requested complaint forms . They were just seeking proof that this was indeed taking place - which it was . If I remember correctly it was a local TV station that sent investigative reporters to find out what was going on . They sent some volunteers into police stations to calmly ask for a complaint form and were met with hostile reactions and intimdation to those requests . One guy was even threatened with arrest .

Most defendants in a civil case will settle out of court to prevent being found guilty or responsible and stipulate terms and conditions the settlement that prevent the plaintiff from publicizing the details. Jury awards are public; out of court settlements are generally not. If you can't locate findings of guilt against cops and or jury awards to auditors and citizens, then you are truly ignorant not just uninformed.

My trip to the police station in my town to ask for a complaint form ended up with me being kicked out of the station, and then pulled over and my vehicle searched 8 times in the next 2 weeks. Wasn't until I threatened legal action that it stopped.

Do the math. 963 / 20 = 48.1 963 / 24 = 40.1 In other words, you're damn near fifty times more likely to get killed by some uneducated piece of shit machismo pig than go through due process and be executed in the criminal justice system. Also, you're over forty times more likely to get shot dead or beat to death by some dumb ass with a chip on his or her shoulder and a shiny badge pinned to its chest than get killed by a terrorist. This is extremely common. More than half of police precincts in South Florida refused to offer complaint forms. A media outlet went undercover to audit the situation.

This is one of the finest examples of police mis-behavior and culture that I have ever seen. And an equally excellent analysis. Some of these "auditors" do fine work. At one time I felt that their activities would improve law enforcement systems. When interactions like this one are publicly-aired, one would hope that public oversight would diligently investigate and effectively penalize officers when appropriate. With the exception of extremely high public outcry and where deaths are involved, the "system" rarely does anything. That leaves civil actions to address issues such as these. Your comment that there has been no legal action is well-taken but I can't really blame the auditor. If you think about it, these auditors take a lot of time not only recording, editing and publishing their recordings but also take risks of being charged and/or otherwise intimidated, harassed and/or physically assaulted. To expect that these people would launch an expensive, time-consuming and laborious civil action is unreasonable. The time and money spent on such an action (even in a legitimate case such as this) is simply not worth it. People (like me) like to bitch and complain but people (like me) just don't seem to care enough to support (resource-wise) effective auditors. Sigh ... here I am bitching about not trusting police and criticizing the system yet I'm not effectively supporting these agents of change. Sometimes I don't like where my thoughts take me. Cheers.

When you work at a grocery store (and probably many other public service places) they're always telling you to watch out for the secret shoppers, and every few months you might get a report that you've had one. It seems like we need the same sort of thing for the police.
When asked questions like "who is the officer?" they are only trying to lead you into an unofficial complaint. Simply reply I wish to formalise my complaint by putting it in writing. If they still continue down that path send and email and address it to both the Chief of Police and his supervisor.
FYI. The "Department of Justice," unfortunately, is only interested in upholding criminal convictions (on appeal), and things like that. They don't care about protecting innocent civilians or justice for us innocent civilians. Believe me, I reached out to them for help and that's what they told me, themselves. Got a letter in the mail telling me that very thing. Pretty pathetic and disheartening. FYI

I just had a nice conversation with Joe Frei, the city Administrator for York Nebraska. He started off pushing that auditors are "aggravating" or "frustrating" trying to get the Police to "lose their cool". I think he finally HAD to concede that his position is wrong. I think I made him see that the public is turning on the police and if something is not done.....very bad things will follow!!

The process of complaining on an officer needs to be separated from the police departments.
I've long called for the IA to be completely separate from the police force and building, that all complaints should be handled immediately and that if they fail to begin an investigation within 1 week of receiving a complaint that they are fired, that would prevent cheating.
Even in places where local "government" has put a "civilian review board" in place, only the most egregious offenses by police are confronted. The police union is more or less ALL POWERFUL.

This officer had been terminated from the Omaha police department for multiple issues with his alcoholism. He went to rehand for three months while working for the department. He failed to show up to his required Alcohol Abuse classes regularly and failed to submit any proof of his attendance to AA as was required to maintain his employment. After that, he was found to be drinking and driving by a fellow officer, but he was let go without any charges. Instead, he was placed on paid administrative leave. After this, he failed to show up to any more of his counceling. Finally he was told he could resign or be terminated, and chose to resign so that he could go get his new job in York. Judging from his rosy red cheeks and aggressive demeanor, I would suspect that he has continued to abuse alcohol and is possibly under the influence of alcohol or other narcotics while on the job and carrying a gun, which would be a violation of a prohibited person in possession of a firearm.
With cops like that around town I can only imagine what their criminals must look like.

A representative of the general public that has every right to expect competent and professional service. The onus is on the police officer to provide that. A business can ask your name that is correct however in the end they should still not know you are a secret shopper. They do get plenty of hints though since you engage in all areas but only walk out with a small cheap item. I used to be a secret shopper. I only broke cover one time when I saw something wrong with an important piece of signage. No, I don't remember what it was anymore. Too damn long ago.
In the end though if he asked for a complaint form he should have been given one and left alone afterwards. No if ands or buts about it. It is not the officer's business what is written on it and should probably be returned in a sealed envelope addressed to the appropriate party/office/dept. Nobody else has a need to know before they review the form.
This is also a specific type of audit in order to see what they would do in a specific situation. Fact is they failed.

There was also no indication that they recognised him specifically. Maybe they guessed he was an auditor but in that case they went out of their way to fail. see you can put it both ways...the auiditor pushed the cop to get that type of response and people will always have a breaking point. Like the whole "are you trying to bump into me" as the cop walked past him. That was him purely trying to goad the cop into doing something. So when you poke at a bear, expect him to get angry.
Also the second he tried to prevent the officer from running his tags/vin which is public knowledge and not protected by anything, and can be run by the cops at any point in time they feel like it. He at that point could have been charged with obstruction of a police officer and his partner that started cursing at the officer could have been charged with assualt, since cursing at an officer is seen as assault is some states.

EDIT: also some states made cursing at a officer a form of assault, while most things you say are protected by the first amendment, an officer may arrest you for it, it is usually at their disgression if they choose to do it or not. Remember for minor things an officer can just let you go, give you a in person appearence ticket or arrest you, all depending on how you act towards them. When they say be honest with me, it can be them trying to go easy on you.

I went to my local police department for a complaint form following an accident in which a young man rear ended me. The reason was that the officer who processed the scene of the accident lied on the police report (FYI: the young man who hit me was the son of a fellow officer). Due to the way the police report was written prevented the other young man's insurance from paying for my damages and physical injury. I was in luck because the sergeant got involved. He reviewed the dash cam and police body cam and agreed that the report was written in a way to excuse liability by the other party. An amendment was written by the sergeant and officer involved was reprimanded. I re-submitted the police report and was finally compensated for damages and medical care (it took 6 months, but I eventually won my case). I don't think most people understand that police and their departments can be very corrupt. What is needed are honest leaders at the top to keep things in check. Without good leaders crooked cops keep doing what ever they want.

I used to have a coworker who was married to a police officer who was extremely abusive. One day when he was beating the crap out of her, she called the police. When they came, they did everything they could to protect him instead of helping her. The police protect each other.

I’m glad you mentioned the DOJ website. A lot of people who have trouble with an officer don’t want to talk to his colleagues. And to police officers in this situation, really, you should understand that some citizens really want to have things on paper. It feels less confrontational and more formal. These guys act like this is a nut job rather than a potentially legitimate concern.

@@richardingame Obviously youtube has a much bigger audience. However, giving it to the local news ensures that alot more locals will see it. That in turn allows for the biggest chance of actual change taking place there. So yes, while youtube may show this to a wider audience it doesn't mean that the people living in that jurisdiction will see it. The rest of us can watch this all we want, it doesn't mean that we are more likely to force a change. Leaving a comment and dislike on this won't actually help the local people that are needing it to change right now.

A local news station in Chicago ran an investigative report on this very issue a few years ago. They sent people ( undercover with a camera) into police stations to ask for complaint forms. In every case these people were met with open hostility with some being threatened with arrest if they didn't identify themselves. Cops stick together right or wrong and they see it as you vs them all too frequently.
How would you like someone to just show up, out of the blue, at your job and start asking for complaint forms? Wouldn't you think they were unfairly trying to wreck your livelihood? There are some employers that wouldn't wouldn't care how innocent you are, they would have you kicking rocks

But, in this type of case, an auditor has no intention of getting the form, and that be it, the auditor still hates, and wants to get an innocent cop fired, just so they can "put a feather in their cap" This incident was exactly what this guy wanted to happen, so he could get views, and fatten up his wallet. @@kolibad No they were there because of prior complaints by the public on how the cops were intimidating people when they requested complaint forms . They were just seeking proof that this was indeed taking place - which it was . If I remember correctly it was a local TV station that sent investigative reporters to find out what was going on . They sent some volunteers into police stations to calmly ask for a complaint form and were met with hostile reactions and intimdation to those requests . One guy was even threatened with arrest .

Most defendants in a civil case will settle out of court to prevent being found guilty or responsible and stipulate terms and conditions the settlement that prevent the plaintiff from publicizing the details. Jury awards are public; out of court settlements are generally not.
If you can't locate findings of guilt against cops and or jury awards to auditors and citizens, then you are truly ignorant not just uninformed.

Also in 2016 in the USA 24 Americans were killed by foreign born terrorists and some of those were abroad.
Police used deadly force in 963 instances in the United States in 2016.

This is one of the finest examples of police mis-behavior and culture that I have ever seen. And an equally excellent analysis.
Some of these "auditors" do fine work. At one time I felt that their activities would improve law enforcement systems. When interactions like this one are publicly-aired, one would hope that public oversight would diligently investigate and effectively penalize officers when appropriate. With the exception of extremely high public outcry and where deaths are involved, the "system" rarely does anything.
That leaves civil actions to address issues such as these. Your comment that there has been no legal action is well-taken but I can't really blame the auditor. If you think about it, these auditors take a lot of time not only recording, editing and publishing their recordings but also take risks of being charged and/or otherwise intimidated, harassed and/or physically assaulted.
To expect that these people would launch an expensive, time-consuming and laborious civil action is unreasonable. The time and money spent on such an action (even in a legitimate case such as this) is simply not worth it. People (like me) like to bitch and complain but people (like me) just don't seem to care enough to support (resource-wise) effective auditors.
Sigh ... here I am bitching about not trusting police and criticizing the system yet I'm not effectively supporting these agents of change. Sometimes I don't like where my thoughts take me.

Once he said 'criminal' they should have asked him to an interview room or private space to write a witness testimony to open an investigation.
When you work at a grocery store (and probably many other public service places) they're always telling you to watch out for the secret shoppers, and every few months you might get a report that you've had one. It seems like we need the same sort of thing for the police.
When asked questions like "who is the officer?" they are only trying to lead you into an unofficial complaint. Simply reply I wish to formalise my complaint by putting it in writing. If they still continue down that path send and email and address it to both the Chief of Police and his supervisor.

FYI. The "Department of Justice," unfortunately, is only interested in upholding criminal convictions (on appeal), and things like that. They don't care about protecting innocent civilians or justice for us innocent civilians. Believe me, I reached out to them for help and that's what they told me, themselves. Got a letter in the mail telling me that very thing. Pretty pathetic and disheartening. FYI

if i asked for a complaint form from a police department that ultimately lead to my finger being fractured... i don't think I'd go the route of taking legal action out of fear. this sergeant is clearly backed up by his peers and subordinates for him to act like this on video. i really would fear for my well being and my families if I was in mr. roths potion and sued them
