Do you need to give them a warning?

California is an At Will State so you can fire at any time as long as its not for a protected reason (race, religion, etc) BUT practically you should give warnings and document everything so if someone comes back and says they were fired for an illegal reason you can show proof that was not the case. And you can show you gave them a warning with the REAL reason before firing.
