    The homeless man shooting is such a fucking joke. It's disgusting. She deserves the hardest charges she can take for it. And her side of the story is a joke, no word from any of the woman that he "harassed"? He made no noise during any point of her shooting him and getting in her car and driving away? She didn't notice him hunching over or laying down or anything? Bullshit

    If the homeless man was harassing other women, where are they? Where are the witnesses to this crime if he was just on the streets harassing people?

      Exactly. There is not one person to speak up on that allegation.

    • @Zerovin
      @Zerovin 7 лет назад +26

      TheNanamariam Also how the fuck did she not realise she hit the guy twice? Anyone shot with a gun would make a sound like they got hurt. And even then, someone shot in the abdomen twice in quick succession would be on the ground instantly regardless of who they were. So according to what she claims, she would have had her eyes closed while she was walking to her car, unlocking it while her eyes are closed and starting her car with her eyes closed to not see the guy on the ground.

    I work with the homeless, in Nashville, not too far from where this man was shot. This is heartbreaking. Not only did she shoot him, her father went on to describe him as possibly on drugs, deranged, and unhinged (per a Washington Post article). People that knew him told the opposite story, that he was sober and a talented musician. He even left a temporary housing program because he didn't want to be around drugs and alcohol. The man had trespassing charges on his record but nonetheless didn't deserve this. No one does. The homeless are often overlooked at best and vilified at worst when something like this happens. Like another commenter said, warning shots are illegal (here in Tennessee it is a felony) and fleeing the scene of a crime is illegal (a misdemeanor for vehicular hit and run). I'm biased in this situation, but this woman is a terrible person and needs to be charged.

      There is a homeless man in my small town of *insert town name here* and sometimes the pastor at my church or my dad will go and have a coffee with him, maybe bring some lunch sit down and have a conversation and they always come back with these amazing conversations about the world and peace etc etc. The homeless are just people, they want everything that we want the same, but they just simply have no home.

      Are homeless people really such a normal thing in America? You folks sound like it's an everyday thing to see people sleeping on the street. Is it?

    • @drewasaurusrex003
      @drewasaurusrex003 7 лет назад

      The Mudpit pretty much. In Nashville which 685,000 people there's an average of 2400 people sleeping on the street each night

    • @azadalamiq
      @azadalamiq 7 лет назад +3

      @mudpit yup, more often in dying towns that are 100s of years old, or big metros.
      a lot of people lost their home/jobs during the Bush jr presidency when we had a minor economic collapse. ya some homeless are out on the street due to addiction, but not all. Some had unlucky lives and couldn't hold a job due to lay offs when the economy tank.
      there is a interesting doc about it something like "tent city" or some such. It depicts some homeless people that just had unlucky lives, they don't do drugs and formed a community to help each other out.

There was ANOTHER case someone brought up a while ago about a woman who was "jailed needlessly" because she used warning shots against her husband. A Warning shot is a death threat "You will comply with my demands or else I will kill you. I will demonstrate that I can and will kill you"

      So your debit card was "mysteriously denied" yesterday, but instead of actually checking to see if your account has been drained, you choose to come on RUclips to tell the world how you might have been affected, making you either full of shit, or just stupid. If you were actually concerned about that you wouldn't be wasting your time telling us about it, you would be telling your bank lol.

      Honoring them seems like the PC thing of importance to mention, especially when it's already being covered by every news outlet you can find just about. The more important issue here is: why does this keep happening? And what can we do to stop or prevent it, because as far as I can see nothing is being done, and for that reason these lives keep being lost in vain.

      I had got a letter in the mail from the local state government, and after re-reading it just now, it would appear that they were trying to cover for Equifax, considering they claimed that the info release was "not the result of a malicious attack attempting to access *insert state name here* judicial files, rather it was inadvertently exposed."
      Maybe they are different events, but they offered the same advice as Phil, and gave the same three companies phone numbers, TransUnion, Equifax, and Experian... Just sounds fishy... Did not expect this leak/hack to be on this level...

    Regarding Katie Quackenbush and Gerald Melton
    Two notable gun laws in Tennessee:
    1. Concealed or open carry of a handgun is allowed with permit.
    2. Completed the firearms training class of no less than 4 hours and firing range time of no less than 4 hours with an accompanying test. A copy of all scores shall be maintained by the Handgun Safety School for a minimum of five (5) years from the date of the examinations.
    According to the Tennessean:
    In December, Katie Quackenbush was arrested and charged with misdemeanor assault causing bodily injury in Potter County, Texas.
    A complaint filed by the state accuses Quackenbush of striking another woman in the head with a drinking glass.
    Four main gun rules -
    Treat all weapons as if they're loaded
    Never aim your weapon at anything you're not willing to destroy
    Keep your finger off the trigger until you're ready to fire
    Know your target and what's beyond it
    My thoughts and opinion:
    1. At first glance, with limited information regarding the assault, if Katie had a permit, she was legally allowed to be in possession of a firearm since she wasn't in prison for more than a year for assault.
    2. Use of force continuum was not followed and this shooting was not justified unless Katie can prove probable cause that she believed Gerald Melton posed a significant threat of death or serious physical injury. "Oops, my eyes were closed" doesn't count.
    3. Assuming Katie had a permit as required by law, she attended a firearms safety class including both classroom and range time. At the end of the class there's a required test where 70% or greater is passing. That test is kept by the school for 5 years per TN law. They the state should pull the coursework and test to determine if Katie knew the training provided and if it fit into this shooting.
    4. She's an inconsiderate garbage person that should be locked up but that's for the courts to decide. I'm sure she'll get a plea deal for "attempted involuntary manslaughter" or some crap like that since she "didn't mean to" and reportedly had her eyes closed.

      This sounds like another lawyer's kid deciding that rules and laws just don't apply because (and I've heard it often) "My daddy's a lawyer, so I get to do what I want!" Which is the exact kind of dumbass mindset that sets up a situation like this. I hope that not only she ends up in prison for attempted murder, but her father ends up disbarred... Why do these three companies get to create your "credit score" anyway? They have no obligation to be impartial and they are seeking to make money off something that I don't think they have a right to. Your personal financial information should be between you and companies that you CHOOSE to do business with. I never authorized Equifax, Experian, or TransUnion to have anything to do with me or my data. This country needs a personal privacy bill of rights and we need it yesterday.

    • @CynicalDriver

      Clifford Hawley : Actually, you give them permission to exist just by doing anything that requires a credit check. You sign a form authorizing the company you are applying to (employer, creditor, property management company, etc..) permission to not only get that information from a credit agency (or more than one,) but to also report to it. If you have ever had a rental, a credit card, insurance, a job that required a background check... You gave that permission.

    I hate the Equifax story every time I've heard it. If anything it shows that even big companies don't have enough security to protect against hacks like this, which hurts their users (and since not everyone who's information has been put into Equifax's system put it there themselves, it's even more egregious) I already don't trust big companies, but this just makes it worse.

    My big concern with the Equifax issue is that the information is already out there and forever will be. This is over half of all adult Americans possibly affected so for long term protection, there needs to be a perminant solution rolled out by the credit agencies, like an additional "credit identification number" given to all people required for dealing with credit. I understand that this would be a large overhaul and very complicated but the lasting effects could be so astounding for so many people. I also know that proving fraud is difficult and ruins your credit for a long time, and sometimes it is impossible to recover from it. I am pissed that nothing is being done about it and it is our responsibility to protect ourselves from the system built to keep our credit. Ugh.

I'm young, my one card is to an account created off my parents' account (through a credit union not a bank), and I'm on their phone plan as well, I've never applied for a loan or tried to make any big purchases, I don't even know which service has my information and what they even have of mine, how do I know if my information is stuff that was leaked???

      Debit card, I had an apartment for a year when i was in college, but I was 18 and it was cosigned by my parents and my roomate's parents, it was more so their apartment. Rent for that was the biggest bill I've had other than a couple less than 50 a month ones, and we paid that in cheques, not on a card, and again debit not credit. I wish I knew how credit worked at all. I thought I heard checking your credit score makes it worse? And I have very little available funds to do the checking with. And how do you find out who has your information? Is it with just one company or can more than one have it? If my parents are hit, can it affect my stuff too because of the linked accounts?

    • @georgewillow112
      @georgewillow112 7 лет назад +3

      You underestimate the power of your personal information. Even though you have the open warrants, let's say you happen to resolve them in the next 5 to 10 years. You've finally gotten a clean slate... and then the hackers use what they stole now.
      You're gonna be fucked. They'll open bank accounts on your name, take loans and bank on it and before you know it, your financial and social future is fucked and you're most likely done for the rest of your life.
      So yeah, even if you have next to no funds, that doesnt matter for the hackers. What matters is they got all the info about you they could ever need. And if they're smart enough (which I'm assuming they are if they managed to pull something like this off) they will abuse it very, very painfully. There will be no going back after that happens.
      I suggest you reconsider your actions and act now while you still can do something. Never take these things lightly.

      Identity matters period everything has some kind of value. Your taxes could be claimed if not garnished already. Someone could use your name for rental history and an eviction never leaves your record. Even bankruptcy clears after 10 years, an eviction never will, unless solved through court. Someone could get hired on at a job with your information because the hiring process there is too lax and the person doesn't pay taxes, next thing you know the IRS is on your ass.
      A general rule of thumb to follow. Is it's easy to get fucked, than it is to unfuck yourself. Resolving issues and getting things cleared up takes way longer than it should. Take your personal information seriously. Take out the space and check out this link

      Peglegkickboxer the UK uses a National Insurance number (NI- all legal citizens get one at 16) however it is PRIVATE. If you got a job at 16 and only worked there for your entire life and never applied for any economic help from the state, there would be a reasonable expectation that only yourself, your employer and the government would know it. It's not used as ID over here.
      I think the difference is everybody in the U.K. has a form of picture ID, as it's the only type of ID regarded to actually prove you are who you say you are. Whereas, I seem to believe that there are lots of people in the US w/o either a driving licence or passport and so maybe they use their SSN numbers a lot because organisations know everybody has one?

    On the Quackenbush story, I honestly believe that the defense the lawyer gave was shoddy as all hell, and the situation given is still unacceptable by using the claim "she had closed her eyes and didn't know she shot a man" as an excuse. In my opinion, I'd say she'd face similar charges, and if she had a license to carry a concealed weapon, for that to be revoked, especially if her side was true.

      Exactly. If you're conceal carrying, you use the firearm as a last line of defense for your life. You don't fire warning shots, you shoot to stop the attack. If she had her eyes closed, she could have easily hit some random pedestrian. Yet another reason you don't fire warning shots. If she went to a CCL class, she'd know that.

    I filed for the free credit report for equifax but they told me they couldn't get it for me online - that I'd have to wait to get it through the mail. I'll have to print and fill out a plethora of forms with excessive personal information, send it to equifax, and wait for them to mail me back. This seems like an extension of the point you mentioned that many people simply won't go through the mail because of the extra hassle, and what a hassle this is. Furthermore, it will take much longer to see how screwed I might be getting right now. It's easily possible that because of this, many people will get screwed - their lives ruined, even if they took prompt initiative in preventing this

  • @sw0rdz
    @sw0rdz 7 лет назад +6

    Equifax broke federal laws. A company is required by law to notify individuals if PII (Personal Identification Information) has been compromised. If SSN's or birthdays have not been compromised, they are not required. Can we stop using SSN as a federal identification?! It was never designed to a federal ID. The most secure part of your SSN is the last 4 digits. The first 5 can be guessed if they know the state you were born in and your birth date. That is why companies will ask you for your last 4 digits. The other 5 are meaningless.

  • @swolf7956
    @swolf7956 7 лет назад +90

    So there is absolutely no way I would ever put my information in that Equifax site to "see if you got hacked". Not only is that site not in the Equifax sub-domain, but you can tell that it was originally not even reachable through the Equifax website given the week difference in the security certificate dates. I had a colleague who did use this tool on their computer and then again on their phone with the same information, but one told him he was hacked and the other said he was in the clear. Supporting the claim that the site never offered true functionality at the time of writing:
    www.businessinsider.com/equifax-data-breach-site-check-angry-response-2017-9
    Think of it this way: a major hole in their security systems was just exploited and the company spent more time covering their own asses than informing the public. How can anyone be sure that they even fixed that security concern? It is possible that they don't even know how the data was accessed. They have no business asking for your personal information, even if it is just a partial social. Namely, the important part, by the way, because the rest of the social can be gathered by simply finding out where said person first applied for a social security card. Further, there have been reports that their captchas don't even work (a hard thing to get wrong by even beginner web developers):
    www.businessinsider.com/equifax-data-breach-site-check-angry-response-2017-9
    It is most likely that this site is an enrollment of some sort. Claims that using this tool waives your right to class action lawsuit have already been brought up, and was supported by trustedIDs own terms of service until people started getting really pissed off... showing us that Equifax is truly making this stuff up as they go and covering their asses one step at a time.
    I had my identity stolen and let me tell you, a credit freeze is a total joke. I put a freeze on my credit and took out a loan less than a year later. This happened about 3 years ago, but I remember how mad I was after talking to Equifax because it was top 5 most angry moments of my whole life. On top of that, Equifax suggested that I enroll in something along the lines of lifelock... which by the way you should also not do:
    www.ftc.gov/news-events/press-releases/2010/03/lifelock-will-pay-12-million-settle-charges-ftc-35-states
    Plus, if they have all the personal information, and they know who was breached, it ought to be their duty to contact those people! It shouldn't be a case of "contact us if you want to know your life is changing forever", it should be them contacting each and every person who had their information breached. It definitely shouldn't be setting up a whole other insecure database of who was hacked where the key (the identifier) is that persons social security number.
    The fact that this took over a month to get out is awful because that data has already been sold to the highest bidder. Identity thieves sell information quickly to get the most profit and have the least amount of chance of getting caught. Remember that we have no clue who these hackers are and we can't assume that they had read-only access. It is possible that they also had write-access, in which case they didn't just get your data, but could have potentially changed your data within the Equifax system, which Equifax would have very little knowledge of whether or not that even happened.

      967patty well the impact is alot like playing Russian roulette and Equifax loaded the gun with three bullets in a six round revolver ....sure you personally may get lucky but likely chance is someone you know won't be so lucky....since credit is the way you get loans house cars and so on then and even simple bankruptcy to clear your credit will take 5 to 7 yrs and another 5 yrs to rebuild your credit if hit a major part of your life could be delayed ....also many jobs use credit score to hire if you can't pay a bill how can you be trusted is how they see it....so yes the worst case is very very bad ....my suggestion wait and see watch your credit reports like Phil says and join the law suit if possible just in case even if your against suing best to be safe then rebuild something they destroyed

      It's the only excuse that her daddy could think of so they are going to stick with this story despite the obvious flaws with it as changing your story in court is frowned upon. My guess is that daddy is just going to buy her way out of jail. She has previous assaulted people and is now stepping up by doing so with a deadly weapon in a very public place. That bitch needs to go to jail for the maximum sentence allowed. Some people shoot people during stick ups, but generally there is a reason for this such as non compliance or just to eliminate witnesses. What this woman did was look at this homeless man and this to herself "this trash doesn't have the right to speak to me, look at how dirty he is" before shooting him TWICE in the abdomen. There's no reason for it besides mean spited crazy bitchyness. Hopefully she will be in jail 'till she in unable to reproduce to that this crazy bitch gene dies with her.

      Cobalt360Degrees also funny thing about the identity protection that Equifax is offering free for a year to those affected (or so I've heard that's it is going to be free) is by agreeing to sign up for that protection, you are agreeing to an arbitration clause that waives your right to sue them or be a part of a lawsuit if there's one against them. Basically any disputes you have with the company with be settled outside of court instead of being litigated in court.

      It is interesting how approach to warning shots differ between countries. In Poland it is mandatory to shot a warning shot before the "real" shot. The idea is that it may scare of the attacker, or sober him up enought to surrender.
      But gun ownership is rare in Poland and our self defense laws are quite stupid. I just found it interesting.

    Equifax should be put out of business. I still have zero notification FROM Equifax that this happened, and I've already verified my information is in there without signing up for their bullshit that forces arbitration. I signed up for Equifax credit monitoring service when I was buying a house because they were the only ones who offered the same credit score calculations my mortgage provider was going to use. You can be sure i'll be seeking damages against them the second someone tries to spend a penny in my name. The credit bureaus are a legal racket to begin with. I think now that it's coming to light how irresponsible they are, we're setting the stage for making them obsolete, and for FUCK'S SAKE WE NEED TO STOP USING SOCIAL SECURITY NUMBERS FOR FINANCIAL TRANSACTIONS IN THIS COUNTRY.

  • @DavidFrostbite

    The entire credit system in America is ridiculous. The fact that you can't see what affects credit and what doesn't is shady. For some reason just looking at your credit costs money, AND lowers your score. Not to mention that no one ever agreed to have these companies collect all of this information in the first place, and now it's just "whoops, literally half of the country is screwed". This is insane.

    I am shocked and very afraid. Waiting so long to make the breach public shows a reckless disregard for those whose information was hacked. Damage could have already been done! I do NOT believe the stock sales were 'coincidental'. Those individuals protected THEIR own assets while ours are at grave risk. What angers me is the fact that I, as a consumer, cannot 'opt out' of having my entire financial history of every account/address/etc that I've ever had stored with not one but THREE different credit reporting agencies against whom I have little or no REASONABLE legal recourse for failing to protect my information. Even in a class action suit, the award against Equifax would have to be in the billions of dollars (which the courts would never award) for 143 million consumers to see any appreciable recovery after the attorneys take their statutory 40% contingency fee. This IS the absolute worst case scenario for identity theft. So many people have no idea of their unprecedented vulnerability here. Thank you for getting the word out!

    Homeless guys story: It's pretty straightforward and sounds credible, but it's still from his perspective. Lets see her story!
    Her story: Sounds weird, illogical, stretched and dishonest.
    Fires two "warning shots" when you're aiming the gun at him is not warning shots. You can't just stab someone twice and say "No its cool, they're warning stabs. Had my eyes closed". What is this sack of horseshit? When you aim at someone and pull the trigger regardless of your eyes are closed, you aimed to kill.
    "After Katie left on foot, Melton continued to approach" after he was shot twice in the abdomen. I think i know where I'll put my money on who's lying. This is a homeless guy not a Terminator continuously walking towards you with two bullet wounds impatiently waiting to say his catch phrase "Where is John Connor" and "Turn that fucking music down so i can sleep off these gunshot wounds".
    But the cream on top of everything is she did it where people were living. Imagine if they ricochet into someone's window and hitting someone else? Bystanders being hit walking down the street? Passing cars being hit? No she can get fucked.

      And there's another detail: firing warning shots, even if she had pointed upwards, which she admits she didn't, means the bullets will go up... And eventually come down. It's not like you fire "warning shots" and the bullets will simply disappear, or fly into space.

  • @budemawa411
    @budemawa411 7 лет назад +71

    Why the hell did she get a CC permit?!?!
    1. Don't pull a gun on someone you don't intend to fire at
    2. If you NEED to fire at an assailant in a life or death situation, shoot to kill to shut down the situation as quickly as possible, shooting at legs or arms is not reliable and may cause bullets to ricochet if you miss the shot, leading to the harm of you or bystanders.
    3. When you fire at someone DO NOT SHUT YOUR DAMN EYES
    4. Do not fire "warning shots" as it gives the attacker time to lunge and stray bullets may hit bystanders, a bullet that goes to an unknown location by the shooter is a very dangerous thing!
    5. Don't put yourself in a situation where you need to use lethal force (getting out of the car in the first place in her case)
    Anyone who doesn't understand these basic concepts should not carry!!!!

      I like the effort you put forward, but i fear her father being a defense attorney and taken the stance of self defense... there must be cameras or something. Were the cops there? How did they know the story? I fear she will get off because she has money, her father is an attorney unless people believe a homeless person above those with money and influence...time will tell

      Nguyen, with the statement as given, self defense is clearly off the table. From the sound of it, she shot him in the back. There's no justification.
      These TV attorneys aren't actually that good. They win so much by taking easy cases. From the defense given, he's already given up on winning the case and is just trying to plead it down.

I just had some activity on a credit card of mine in the beginning of august that wasn't me and to know that it is probably linked to this makes me so angry. Those little pieces of lead do not discriminate between "guilty" or "innocent", if they leave a firearm they are the shooters responsibility for anything they hit. Whether or not Quakenduck closed her eyes does not relieve her of said responsibility.
    Any responsible gun owner who has taken a CC class knows that if a firearm is being brought into play that it is a force multiplier. One does not warn an assailant with a force multiplier, if it enters play it must be used with the intent and knowledge to neutralize an attacker.
    Neutralizing an attacker does not mean "winging" them nor does it mean firing warning shots, it means center mass with the intent to kill.

      I don't think it is, a suspect could confess to the crime in confidence with their lawyer just so the lawyer knows what they're dealing with, the lawyer could then still claim their client is not guilty if there was no proof, that is lying.

      Drood If the defendant (at this point no longer a suspect) confesses to the lawyer, he can enter a plea of not guilty, but can't say that the client didn't do it. It's not the lawyer's job to determine guilt; that's what the courts are for.

    A good tip when checking annual credit report is not to check all 3 on the same day. They pretty much usually all say the same thing so if you are serious about monitoring your credit due to this hack, check one now, then check another 4 months from now, then last 8 months from now. Rinse and repeat every year.

    • @ghost2coast296

      Zoidberg that's only temporary because the credit monitors think you might be checking your credit to take out a loan/card. If they see no new loan/card your score goes right back

    • @Lightningfootjones
      @Lightningfootjones 7 лет назад

      Dr. Zoidberg i've heard that too, but even if that's true the effect is very very minor. Most of your score comes from how long you've had credit, how much you owe versus max balances on credit cards, and whether you've ever missed payments etc.

    • @trevorgrover5619
      @trevorgrover5619 7 лет назад +1

      Well, you might need to check all 3 scores against each other now that one of them is hacked.

    • @greadarr2394
      @greadarr2394 7 лет назад

      This does not give you your credit SCORE @Dr. Zoidberg and everyone else commenting. What a credit report shows you is your credit history. Credit cards you have that are open or closed, your payment history on them (like if you paid on time or have ever been late). It shows you previous addresses. Loans you have taken out (like school or mortgage). Etc. It doesn't show you your score and most credit cards these days give you an idea of what your FICO score is for free. But if your identity was stolen, your credit report would be one of the ways to check and see if something is amiss.

    In regards to that girl. As a CPL instructor it's people like her that infuriate me. A pistol is a tool of last resorts used in defence of life. No where in her own statement does she say she was threatened or had any reasonable fear or death or great bodily harm. Her father I think is trying to get rid of intent to make attempted murder harder to prosecute. But still easily get her with reckless endangerment, assault with a deadly weapon, fleeing a crime scene, and much more I'm sure.

    Phil, I want to thank you sincerely for sharing this information. I am one of the people who has likely been affected by this data breach, and I also immediately went and signed up for the "free" credit monitoring service. Without this video I would have accidentally screwed myself out of my legal rights to take legal action against Equifax for there serious lack of data security. I hope a huge class action lawsuit lands on their heads and takes that company out of the playing field. Considering they sat there and lobbied for a relaxation of cyber security regulations recently only to turn around and pull this shit, yeah I'd say it's safe to bet they won't be in the running much longer if they keep this ridiculous shit up. I've written my letter to opt out of arbitration, so I will happily be signing onto any class action lawsuit I can get my hands on. They should be taking proper remedial actions WITHOUT bringing courts into things, but seeing as they'd prefer to continue to fuck Americans over instead, courts it will be. One way or the other, they need to be held legally responsible for their negligence in this data breach. One can only hope it would be by shutting their business down outright. Anyhow, thanks again! You've been a huge help!
