You are right about the clearing sample steps. But I think in most cases people don’t need to clear samples unless the song actually sells/streams very well. The likelihood of getting sued on a track that isn’t selling thousands or millions is very low.
For sure. this is normally how people choose to deal with it and that is true for songs that are not doing big numbers. But people should be aware of the risks and very real possibility of the original owner of the sample coming after them if the song makes any money
all ima say is if you can't clear it the last option is this (sample now save and settle later like Moby,Fatboyslim and many other producers once they blew up from tracks that used samples in then gave them the money from the selected tracks as they saved it and cut a future deal going on basically showing good intention of paying the orignal artist something and not pure comerical gain unlike Juice WRLD who just spent the money then got sued for the total profits and future cut at 100% loss)
The best method of clearing samples is by using the editing tools of your equipment, to completely change the sample into a different and unique waveform!.💯🎯
Upcoming artist need permission to profit off of remakes without getting a lawsuit or worse. its impossible to get in touch with original artists. But we have soo many big ideas.😢
Yeah but many of our favorite producers and songs were written with samples in them. I’ve wrote all my stuff from scratch but can take a lot longer for some people. I play multiple instruments so it’s some what easier for me but for people who only know how to work a DAW, they may be looking for samples of certain instruments
just make it unrecognizeable reverse reverb delay tf out of it to your liking and put odd but cool filters easiest things to sample are vocals (not words) melodies i wouldnt tap into..
Really wanna sample Alan Watts in my songs, some of his teachings are so profound & the world neeeds to hear them. I think Alan would want his stuff to be shared. Has anyone used his lectures in a song and not gotten in trouble?
to avoid all, i’d say to just get creative w sampling & try to mask it (sample used) as much as you can lol. many different approaches to this. tbh tho, if you try to sample anyway without taking proper measures, people really only get in trouble if: 1. the song blows up 2. it’s super obvious what the sample is. madlib is a prime examples of the consequences associated with the minimalist approach to sampling lol.
On the Citizen DJ website they pull samples and organize them from the library of Congress public domain archive so all the songs on citizen DJ are free to sample no credit is even necessary.
if the creator of the sample directly says its royalty free then absolutely go for it but just be careful because sometimes even things that are listed as royalty free are not actually.
people still get copy right issues with samples and loops on mostly all music making platforms. it's bogus. we are basically notallowed to get inspired
yeah its called interpolation, still just as big of a pain in the ass. juice wrld's lucid dreams melody was an interpolation of a sting song and he completely fucked nick mira and juice by claiming the rights. iirc sting ended up getting 100% of the revenue, if not the full 100% then nearly all of it
Copyright lasts 50-75 years After the death of the creator of it - All of the music that is currently public domain is from 1927 or earlier according to the official public domain music library. So respectfully I doubt you are sampling things from that time period. But sample away!
Same situation, get in touch with the rights owner, usually the movie studio (but not always), and be prepared to pay up-front... not always stupidly high fees, but enough to ensure you are serious and root out people that may potentially damage their 'brand' or IP... oh, and they know a thing or two around rights and merch, so expect to always pay a percentage on top of your fee ;)
It’s not solely up to the artist his/her self , got to get the publishing rights and the musical composition rights.. the artist can say yeah you could use my shit, but then his label gets involved and says otherwise- and boom 💥

Nah, I’m tired of hearing 80s/90s songs with just some basic techno drums under it and call it a remix. Enough people already exploited that lane.

Ok, the problem is
I want to sample a song from Tiny Tim, and Tiny Tim d13d in 96. So, what can i do?
Go for it most of the time people that sample get rich then sued but so rich getting sued doesn't matter 😅
That's if you go viral so there's that
Ask the publishing company. They own the rights to the sample.

Yes they definitely had to clear that sample with Dionne Warwick and her publisher

You have to clear it with whoever made the original sample and they will have demands for percentages and/or upfront payment and credit
Can i use a cover of a song on youtube as the sample instead of the original?
Good question, can we get an answer on this people? Like an acoustic guitar cover something if that sort.
