Ah, the classic "You're not crying how I think you should be crying." evidence of guilt.
It's worse than these crimes, IMO.
A lack of tears is a clear indication of fake crying. Indeed, this is why we cry tears: as an indisputable signal to those around us that we are genuinely upset. It's an evolutionary adaptation which underlines the importance of social bonds to human survival. This isn't a _lack of crying_ situation, this is a _faking_ crying situation. It's an important distinction. There have been quite a few examples of tearless weeping performances by people caught on camera who were later proven to be killers of family members.
What I find worrisome is that we have no _proof_ for the claim that he was crying without tears: we have to take the witness's word for it. They could be lying or mistaken.
@@aarondavis8943 you are wrong. People can freak out without tears. People can also be balling their eyes out then immediately stop. There is no "right" response to trauma. Being wrong on this revictimizes people already going through hell. Some people will never understand it until they go through it, but I know you are wrong because I've seen it and I've experienced it.

Absolute BS. How could his appeal be denied? It sounds like a small town biased judicial system. My brother went through this same crap. Took 15 years to prove his innocence.
The State doesn't like to be "wrong" about someone and will fight tooth-n-nail to protect their image despite someone being innocent especially if it effects them politically.
Our legal system doesn't really allow for things to be unraveled. Once they set their wheels and motion, and have arrived at at a conclusion they won't go backwards, even when the conclusion turns out to be completely false. And I suppose no one in the governmental system has any incentivization to undo wrongs.

That's why you can make appeals to state and federal courts. I suspect your brother's problem was that his lawyer botched the first trial, which made it more difficult to appeal.
@@uanime1 Actually it was far more nefarious. The DA purposefully withheld a key piece of evidence that pointed to the actual killer. His Mom (I was a half-brother) kept all the court records in her home. she had a bad house fire that destroyed the records. He requested another copy of all the records....and there it was! The smoking gun. The documents regarding the killer were in the replacement records. The soon after proved he did it via DNA. The coward murderer jumped in front of train before facing trial. They had to let my brother go, after 15 years
What a mess this entire case has turned out to be. Poor child.

In grief we try to make sense of things, even when a death like that is senseless, this may give more explanation for why he was trying to convince the police it was murder by ex-girlfriend. And perhaps she did it, or perhaps it was natural causes, but I don't think he is guilty. Not everyone cries in front of other people, using that as proof he did it is ridiculous.

How do the police not automatically investigate a 3 year olds sudden death as homicide?

Because imagine all the paperwork involved.
They did in this case, to the point of not investigating if Christina's history of severe asthma could have been the cause. They even lied about evidence of an act of sexual assault. With police investigators and prosecutors like that, he had a snowball's chance in Hell to get a fair trial. Both children and adults who have severe asthma can die from the disease. Every sudden death that happens to people who have a history of disease that can be deadly must be investigated with an open mind. They failed miserably to do that here.
They did investigate it as homicide except that they were convinced the Dad did it and didn't look for anything else. That happens a lot.

@@louise2467 this is true unfortunately. However the wrongful imprisonment for such a lengthy period would be massive. Either way, I wouldn’t want to be jailed for any type of payment. Jail is a disgraceful existence to endure.

I’m pretty sure he records at least two or three of these per day, having done all the research beforehand. That way even if he’s on vacation or away doing whatever it is he does, he’s got a video always ready to be put up every day.

Wish you would cover the old case of thomas drake it was covered on unsolved mysteries season 4 or 5. He’s my best friends grandfather. He was convicted of attempted murder when his wife was hit from behind and robbed at church. She survived, the only evidence was he was cheating so he was convicted with no other evidence and is still in prison decades later

Never talk to the police, even with your lawyer
I'm starting to really see this is the case, you really can't trust them. Once they make up their opinion about you that's it, they put their blinders on and don't look at anyone else as a real suspect.

There is literally nothing that you can do to help yourself by speaking with them if they are going after you.
@@mangographics225 Easy, don't talk to the cops. He should never have agreed to got to the police station. For that matter, he never should have called them about his suspicions. He wouldn't have been in jail for 30 years, or even arrested, if he kept his mouth shut. I get it, he wanted justice for his daughter. But talking to the cops had zero chance of achieving that, and instead put him in prison as a child killer (and those who harm children are on the lowest rung in prison.)

Invoke right to an attorney and remain silent. Some might say if innocent why not speak. This case is an example but here's a simpler one: police interview you and you mis remember any number of items. Much easier to do shaken up. Later this can be used against you as evidence you are lying. Another scenario: police misunderstand what you told them or purposely get it wrong. Remember also they can lie to you legally. They may say a neighbor saw you at a certain time and can be a complete fabrication but if you belive them may try to think we'll only waybthat could be us if sleepwalking. Then later used against you as admitting to being there walking crime scene and sleep walking therapist ludicrous. Goes on and on. Invoke attorney never answer questions even under threat of immediate incarceration or worse. They can lie. Sickening system.... led to this and many others.
Once again, this shows IT'S NEVER A GOOD IDEA TO TALK TO THE POLICE.
A removed spiderwebb can be fixed amazingly quickly by a pissed of spider sometimes, so depending the exact look of the webb, it could still be pretty new.

The biggest problem is that there isn't any evidence that shows he's innocent. If the Innocence Project can't prove how someone else could have gotten into this house or that Christina died of natural causes they can't prove he's innocent.

A spider can spin a web in an hour or less. There is no reason to declare that someone could have not come into a window at some time in the previous 6 to 8 hours based on a spider web being in the window.
Spiders only spin webs at certain times of the day.
@@uanime1 usually at night as they are nocturnal insects. They are known to come out their crevice or hiding spot soon after their web has been disturbed to make repairs. The murder took place sometime at 12:30 a.m. The police thought it was a death by natural causes in the morning. No pictures were taken of the spider web then. They then were summoned to return arriving around 7 pm at night. Taking photos for the first time after the sun had set, a full 20 hours after Christina had been murdered.
Is it possible that Mazook gained entrance to the home earlier and hid herself? Her DNA was all over the bedding, not his.

I've watched many of your videos, and this is truly one of the most twisted cases I've ever heard.
Since watching Dr. Grande's videos I have come to wonder why courts bother to call expert witnesses at all. One takes the stand and says one thing, years later another expert says another. It's useless.

Unfortunately this was beyond the grasp (consulting or retaining a spider web expert to challenge the police findings) during Bart's initial bench trial in 1999. At Bart's 2014 DNA hearing well known and published arachnologist Dr. Todd Blackledge of the University of Ohio testified that unless police had special cameras and lighting and were trained arachnologists they wouldn't know what they were looking at. Adding the spiders usually come out of their crevice at night and repair any damage done to their web. That they re nocturnal insects. The repairs having taken place many hours and at night before police were summoned. It was this testimony that swayed the judge to allow DNA testing of Christina's bedsheet. Testing that showed Misook's DNA being located in 6 out of 8 quadrants. The State then taking the position that as Bart and Misook were boyfriend/girlfriend the results ere to be expected.
Wow, I live in Bloomington and hadn’t heard of this case. Thanks for covering this! I agree with your conclusion, Dr. Grande. You might also be interested in these other Bloomington-Normal cases: Eric N. Ringenberg (family murder-suicide), the murder of ISU student Olamide Adeyooye, and the unsolved 1975 murder of Carol Rofstad.
At the time of the crime I understand that suspicion fell upon Barton. It seemed farfetched that Mazook would have entered without leaving any evidence, and Barton could easily have arranged the details with the window frame and the fan. But given Mazooks later murderous behaviour and her choice of methods it seems Barton was right after all. It’s surprising he is still in jail.
Barton is only right if he can prove Mazook killed Christine, not if she killed someone else.
What would have been the motive from Barton?
The in 1998-1999 State's Attorney Office of McLean County took the position Barton molested his child despite their being no physical evidence, no person or friend that could ever attribute such conduct of him toward his daughter. Christina was in the care of many other persons. She went to day care and spent 50% of her time with her mother and her friends. The State felt that as Christina was just beginning to "talk" that she would tell people Bart was a pervert so for this reason Bart had to kill his daughter. Prosecutors then told this to the local news stations who reported this despite no charges ever begin raised against Bart as they knew (the State) that they could not prove this accusation. Knowing what Misook is capable of stemming from her strangling her mother-in-law Linda Tyda, it is more likely she molested Christina in order to further get Bart in trouble. Just as it is a known fact she called her former husband Andy Nowlin the night of the attack asking for his help to purchase pot so that she could plant it on Bart's car and get him in trouble as he was to attend her sentencing hearing for her conviction of unlawful restraint against Bart and his daughter Christina in just two days time. Google Bart's name and you'll find his website and much more info about his extraordinary case.

I'm lucky. I was never attracted to the 'bad boy', and removed myself from these sorts of relationships as soon as I recognized issues. When they go bad, they really go bad.

Scary to think that being innocent isn't enough to avoid charges with these state d.a's and prosecutors in the U.S.

Misook was/is extremely impulsive. I question her ability to hold back from attacking Barton as he slept.
Barton and Marzook sound like serious gluttons for punishment, persevering through all odds in dragging out their violently dysfunctional relationship. What a tragedy they didn't call it quits long before it came to this end.
The mention of the stomach contents of Christina to determine her time of death reminds me of the case of Mark Lundy here in NZ, where his 2 convictions for ending his wife and child hinged upon the Crown's timeline of the barely digested McDonald's meals in the victims' stomachs, and the testimony of a self-described psychic who said she saw a fat person in a blond curly wig running away from the area at 7pm that Tuesday night.

Barton needs to contact the Innocence Project in his county. They maybe his only hope.
Thank you and Bart is fortunate in that he has the Illinois Innocence Project of Springfield Illinois associated with the University of Illinois Law School and the Exoneration Project out of Chicago Illinois associated with the University of Law School working on his case. The former has been with Bart beginning in 2012 with the latter joining around 2017 after Misook's touch DNA results proved her presence on the victim's bedding. The lower court has now finally ruled against Bart so now it is up to the appeals court of Illinois to reverse this wrong
The tale of Bruce and the spider comes to mind. A search party decided he couldnt be in his hiding place because there was a cobweb over the entrance. Duh!

I think he is right in thinking that his ex-girlfriend murdering his daughter is even more likely than an asthma attack - if you think you know in your gut someone has murdered your child of course you wouldn't want them to get away with it! He doesn't seem to have reacted suspiciously weird in any of this, which is rare!
