  • As the Alec Baldwin trial is expected to kick off on Wednesday, a pretrial hearing took place on Monday where they discussed multiple filed motions including excluding witnesses, evidence, and protection with Baldwin’s role as a producer. Baldwin’s armorer, Hannah Gutierrez-Reed, was convicted of involuntary manslaughter and sentenced to 18 months in prison. A judge will rule on these issues after hearing motions from the prosecution and Baldwin’s defense. Baldwin was indicted on one count of involuntary manslaughter in January for the death of 42-year-old cinematographer Halyna Hutchins.

    Is everyone missing the point? The gun shouldn't have been loaded though ? It's the armourer at fault.

      Her fault for her part in the chain of events, which is why she was charged, tried, and convicted. The assistant director's fault for his part in the chain of events, which is why he was charged, pleaded guilty, and was sentenced (suspended). And Baldwin's fault for his part in the chain of events (failing to assume it was loaded, failing not to point it at anything he didn't intend to destroy, and squeezing the trigger), which is why he was charged and tried (at least until it all fell apart due to prosecutorial misconduct). Fault and negligence are often shared and apportioned accordingly. It's not all-or-nothing.

      Yeah, I am always curious if they used live rounds for shooting some scenes (like a bullet hitting a door) (a bullet hitting some iron or rock for using that sound) I think they use live rounds for that no ?

      @@LibraryOFSounds absolutely never ever do they use live rounds on a movie set (I used to work on movie sets). My theory is that Hannah wanted to do some target shooting during off hours (another huge no no) and didn't bring the rounds home after. She had asked the armor vendor if she could do so if you recall and he said absolutely not. They use squibs to show bullet hits

      I was taught that because I personally chose to take classes when I became a gun owner years ago. Baldwin is not a gun owner and did not choose to become a gun owner. He was filling a role in a production.
      See, it’s a bit more nuanced than this view point.

    It doesn’t matter if it was an accident. Someone died. That’s why it’s called involuntary manslaughter. Because you don’t mean to do it. But there is still a penalty to be handed out. If she went to jail, then he needs to as well.

      She was in charge of firearms/munitions, he was not. There’s such things as culpability and responsibility. If you work in a donut shop and the baker poisoned the goods, should you be charged because you handed those goods to customers?

      Alec was a producer (boss) and he’s responsible for all aspects of the production, including safety.
      He ran a chaotic set hyper focused on time.
      Alec inappropriately handled the weapon on several previous occasions and lied about pulling the trigger.
      Alec is a seasoned actor and knows protocol. At a minimum, he knows not to point a gun directly at someone.

      No. The question is now who was last in the chain of custody of the gun, pointed it at another person, cocked it, pulled the trigger and killed that person. Assuming a gun is not loaded, is not dangerous and is not lethal is not a valid excuse or defense against negligent homicide and manslaughter.

      @@Northernlightzzzz on set rules are almost exactly these: Treat every gun as if it were loaded. Always point your gun in a safe direction. Never point your gun at anything you don't intend to shoot. Keep your finger off the trigger until you’re ready to shoot. Baldwin was reckless and clearly NOT safe (look at the clips from the HG trial).

      that is not relevant. Gun training 101 states you don’t point a gun at anyone unless you are prepared to kill them and you always check a gun when it’s handed to you.

It’s probably because he tried to lie and settle with money and it wasn’t enough. This is BS. He should have been locked up along with the Armorer and anyone else that’s already been found guilty. My biggest gripe with this is that you don’t be as old as Alec is and not know how to handle a gun. Actor in acting or not, I’m going to be diligent in ensuring the weapon doesn’t have live rounds and is safe if it goes off even if it’s been cleared by others.

      ⁠@@kenshin527 HGR’s trial wasn’t that long ago though. This incident to trial time span isn’t uncommon at all, if anything it’s on par or above average from how quickly these cases tend to get before a judge.
      You’re letting your bias get in the way of reality and a fair trial.

As well as being producer and ensuring that everyone follows safety and he was barely present for the safety briefings regarding gun safety.

    there is no doubt baldwin played a part in the negligence, he settled a court case
    that alone is reason to convict
    money should not buy your way out of a violent act that caused loss of life
    he should serve some time in jail and spend at least two years on probation as well as attending safety classes

      It only it was that simplistic. People settle civil cases all of the time - it’s not an admission of guilt.
      I do think that as a producer, he had a level of responsibility for what went on on his movie. I don’t know enough about the culpability of an actor and I’m interested to see how this plays out.

    It's already said and done. The judge and defense team are going to set him free. It is so obvious. He can't be tried as a producer and tell the jury he was responsible and show a list of rules he should have gone by . It's a shame that justice is only given to the rich and famous. The poor lady he killed gets no justice. The judge is going to make sure he goes free. She's doing it now and yesterday's ruling. He is producer and actor. He was wrong and careless.. This is why we have no respect for the law

    As a child, I learned gun safety. If handed a gun in a safe manner, I always check it myself to ensure it is not loaded. If you don't check it, assume the gun is always loaded and treat it and others with respect. One should NEVER point a gun at someone else whether it is loaded or unloaded. That's only common sense. Alec Baldwin failed on all gun safety rules. He is responsible for the murder of an innocent individual regardless of whether the gun handed to him was loaded or not. He had the responsibility to check the weapon for himself. To point the finger at others for safety violations is irresponsible.

    As actor PLUS producer role gives a clearer picture of the lawful list of responsibilities. To say he was only acting as an actor brings his charges down to a less severe level of manslaughter.

    If I was in the jury, I would find him guilty. If you are handling a firearm, regardless if it was not loaded, I would not point it at anybody. I would ask the defendant, would you point an unloaded gun at your family or yourself?

    How horrible the prosecution wants to show autopsy photos and a video of Helena on the ground after being shot. If I was the judge I would not allow it. Helena was a human being not a prop for their case! Absolutely horrible.

      @SteveSpeaks-u9p It is not necessary in this case. We know how she was killed and where the bullet came from. There is no suspected second shooter on the grassy knoll. It's a sympathy strategy on the part of the prosecution to turn them against Baldwin. It shows their case is weak if they are stooping to such levels.

    Executive producer provides funds to a film and receives a share of profits. It’s offered to many actors and doesn’t mean they have any responsibility other than that. Not the same as a producer. Baldwin was in the midst of being directed when the gun went off. He was being told where to put his hands and fingers by the cinematographer and the director.

    Ich dachte, Alec konnte das Unglück längst hinter sich lassen und war dabei es zu verarbeiten. Für mich ist er unschuldig. Restlos unschuldig. Mit Sicherheit geht es mal wieder nur um Geld. Ich wünsche Alec, das er diesen Prozess schnell hinter sich hat und in Ruhe und Frieden mit seiner Familie glücklich werden kann. Alles, alles Liebe für Alec Baldwin.

    Now, the state is trying to prove that it was Baldwins responsibility and not Hannah's but, Morrisy claimed it was the other way around in the other trial.....DOUBLE STANDARDS! I'm glad that HG refused to testify in this case!!

      This is very true. If you watched Hannah’s trial they claimed it was her and her alone responsible for the live round and gun safety and they convicted her. Now they want it the other way around for Baldwin. Not a Baldwin fan but this is a double standard.

    In New Mexico law involuntary manslaughter requires acting in a reckless manner, proving that the death was an accident and that Alex Baldwin acted as he was supposed to be acting, and not recklessly, would exonerate him. That's why they keep pushing for witnesses to recognize it was an accident. The other charge, negligent use of a firearm, requires the defendant to have used the firearm with negligence. Negligence is defined by "omitting to do something which a reasonable man, guided by those considerations which ordinarily regulate the conduct of human affairs, would do, or doing something which a prudent and reasonable man would not do." That is why they're trying to prove that he didn't act negligently because a) It was a "cold" gun, b) He was adhering to set procedure in which two people would've reviewed the gun before handling it to him. Prosecutors are trying to suggest he acted negligently because he didn't ask about the gun once it was handled it to him. But, based on the facts, he should've been able to reasonably assume the gun didn't pose a threat and that he could handle it as his character would've handled it. Therefore, he didn't act negligently. I would be surprised if he's found guilty.

      @@CynthiaCalafati she was horrid in the previous trial already, cannot take it second time. They kind of teamed up with the equally dislikeable judge against the defense. One of the most unprofessional prosecutors and courtrooms I have seen.

      Anybody that handles a gun is just responsible for it as anybody driving a car. If he didn’t check it he’s responsible. He broke all gun handling rules.

      Errrr, Wrong, actors are exactly that, actors. They don't check guns for real rounds, or whether they are functioning properly or anything like that. That is someone else's job, probably multiple peoples jobs, and those people need to be charged with murder.

    I’m not commenting on the video. Didn’t watch, no interest. I just want to urge the channel owner to edit the apostrophe out of the title. It’s “attorneys” plural, not “attorney’s” possessive. You’re not taking about a thing that belonged to one of the attorneys. See there? See how I used the plural because the judge was angry with more than one attorney?       I assume you mean objections. I have seen other judges rule against speaking objections. Oftentimes a lawyer objects and then says why they object which might lead the witness to answer in a certain way and disrupts the flow of the opposing counsel. By not allowing speaking objections then the objection is dealt with in a sidebar so the discussion is not heard by the witness nor the jury.

      @@Asidebar well the difference is when they say "no speaking" that generally means no narrative-explanation (like Elaine always tried to do in the Depp trial) but they are allowed (usually actually asked) to say the basis.; so like "objection-relevance or objection-hearsay or objection-non responsive etc just like the defence attorney asked for. This judge isn't even allowing them to state the legal basis.

    In the Hannah trial prosecution said all of the things they are going after Baldwin for now was irrelevant and they convicted her. Now all the sudden it’s all relevant. Not a Baldwin fan but the prosecution is shady. Don’t think he will be convicted.
