As someone who was awarded TDIU I have one word of advice. Get a certified vocational expert to perform an evaluation using your C-File, work history and education history. If they determine that you’re unemployable they’ll write a report for you to submit to the VA. The report is compelling evidence that the VA will find difficult to ignore or dispute. I quit my construction job because of knee pain. I lived off of savings for 2 months. Im awaiting full knee replacement surgery & the VA is backed up through January 2025 so I wait. Called my Senator asking for advice - SSA called me & set me up based on my wages this yr. Now getting TDIU This happened through EDD (86% of my regular wages) till they can replace my knee. Thankful I paid into social security all these yrs because otherwise I would be out of luck.
If the VA didnt address the work issues when raising a % when it was CLEAR that there was work issues(even if still employed at the time), can a TDIU claim be backdated to that claim even if it is over a year old?
No. You can apply at any time. There are 26 DBQ'S for VA disabilities. You can also apply for TDIU and SSDI. The more evidence you have, the better your chances.
I am currently at 90 percent, 2 months ago I was given a pulmonary function test by my private Dr and my fev 1 score was 53, I submitted that to the VA on my copd claim, was given a c&p exam and the examiner used that same score , mental health dr also provided me a letter stating i was in her opinion unemployable,what are the chances of a positive outcome
Well if you were receiving IU that means you obviously had something that you claimed prevented you from working so I’d be curious how now you’d be able to work if you were unable to do so prior to getting the new rating?
I have severe, chronic panic attacks. It's well documented in my service medical records. It started after my first Afghanistan deployment. I've been to the ER (both VA and civilian hospitals) over 150 times in the last 6 years and I haven't worked since 2016. I can't even go to the grocery store without freaking out much less have a job. I currently have a total %80 rating with %70 mdd rating. Think I could get tdiu?
I filed for an increase and TDIU. I had 3 C&P exams for what I claimed, now I'm waiting for the decision. I submitted my work history from social security, and a VR&E acceptance letter explaining why I cannot obtain substantial gainful employment due to my mental disability, lack of educational history and training.
Tdiu can be permanent and total if your award letter says no further examinations are scheduled in the future. If your award letter says that you are scheduled for future examinations your tdiu is temporary.

Do you have to be currently unemployed to file for IU? What if your just sucking up the pain in order to survive with the wife??

Yes u can. Only TDIU, SMC, and AA can be impacted.

I have 70% with 100% pay & the doc. Unemployment because of PTSD Heart attack, bercitses the state ssa is being evaluated for a little over a year
