There are lots of websites with tables saying that if someone (illegally) makes a derivative of a ND work then they *can* legally change the licence for the derivative work according to the terms of CC licences. Could you please clarify whether breaking the terms of the licence does in fact give such a right to the person who violated the licence' terms?

You can relicense the same work under a different licence but the old licence will still apply to any work accessed or obtained before the new licence existed. If you want to forego more rights, that's not a problem. But if you want to reassert rights you had previously waived then you can only do so on copies of the work you produce henceforth. You can't reassert rights over copies produced previously.

Yes. The artist holds full copyright automatically. The artist may instead choose one of these licences as a way of waiving partial rights.
