  • The plaintiff says his brother passed away and the defendant, his brother’s landlord, stole money off his dresser as the ambulance was taking him away. He’s suing for every penny. The defendant says the plaintiff told him to use the money for rent and then changed his mind the next day.

    He shouldn't have took the money. He should have sat it on the dresser, locked up the house and freaking left. He shouldn't have even took the rent money and waited until he got out the hospital or in the case waited until the family came to clean up and got his stuff out.

      Did you not listen to the case? He didn't "take" it... he responsibly collected it and let the family know he had it. The legal wife told him to keep it for expenses.

    This was so morally and ethically wrong. Landlord collects the cash, puts it to the side and then lets them know where he placed it. He took money that was not his. And then for him to say “justice was served.” No justice wasn’t served, there were laws that prevented a ruling in this court.

    He should go to probate court and file claim against the estate for the cost of burying his brother. His brother's wife was responsible for his burial. Then, if his landlord was owed money, he too should have placed a claim against the estate, he not only has the $1300, he also has the security deposit. What should have really happen in a family where a loved one passes is, everyone pitches in, many times even good friends will contribute.

    there is no way he should have taken anything from that man's home... you lock it up and walk away 🤷‍♀️, just doesn't sound right seemed all he cared about was the money... so his cleaning after he died was covered 🤦‍♀️, like seriously.... never rent from that man!

    The clean up should come out of the security deposit for one thing. And most likely he had paid last month's rent too when he 1st moved in. And he said that Robert was gasping for air when he found him and he gave him CPR. But you don't do CPR on somebody who's gasping for air.

    I can’t stress this enough 🗣 LIFE INSURANCE and a LIVING WILL.
    Edit to say: The landlord should have not took the money out of the house. The estate would have paid the debt.

    There is something very icky about a landlord piicking up the money and not immediately putting in a safe place within the apartment, but instead putting it in his own pocket.

    The defendant is basically charging him for having saved his brother's life. You aren't owed anything for doing the right thing.. he should have never touched the money and the wife who was not even living with her husband should have no say. That's wicked that he even wants to keep it. It's not his money. He basically stole it and his estranged wife helped.

    The plaintiff almost sounds like he is saying, "why should I have to pay for the funeral? And iff I do, I should get the money." Why is he even paying for anything? He should have told the wife to take care of it. If she gets his brothers estate, she is also responcible for the funeral costs.

      And what happens if she doesn’t arrange the funeral? Does the brother leave him to rot? The brother still has recourse by filing a case in probate court. He has a very good chance of getting the money back. He also has a good point about there being a security deposit on the apartment which should cover any clean up done by the landlord.

      Good manners teach you that you don’t take money prior to owner permissions not to say that money owner was laying ill on floor suffering from health issue.
      What’s ethical and what’s should be done is that land lord should pick up the money, put it in an envelop and keep it safe until money owner gets well and hand it over to him (or his family) to make CLEAN transaction with owners acknowledgment to pay necessary dues. The land lord took/confiscated the ill man money and took all hostages because of nothing but greed. F’money !

    The poor brother. The law can be a blessing and a curse. He definitely was owed that money. And she only was tryna probably give the money to the landlord to save her own tail cause she knows she lived there too at one point and he may come at her for whatever expense was left.

    I don't think the landlord (defendant) was wrong for picking up the cash and applying it to the man's rent for the following month.......IF the man who was sick (named Sal) ok'd it. Sal seemed to be getting well and then suddenly got called home (that happens). IF Sal died BEFORE his rent was due, then the landlord can't charge him for that next month. The landlord still will have to charge fees to have Sal's apt cleaned out...so he can re-rent to a new tenant. That's the the way this works. Life-Marches-On. Nevertheless; the plaintiff is the beneficiary of nothing, ...Sal's estranged wife is the beneficiary-by-law and it sounds like she's washed her hands of Sal and moved on with her life.
    The plaintiff seems to have a problem with the total amount of money he's talking about. At 3:18 It's $1,723.00 then at 3:40 It's $1,323.00. Which is it?
    Don't get the label of *"Vulture"* attached to your name, plaintiff. Move on, man!

    Well everyone is saying go after the wife for the funeral expenses. While that seems like a good idea, problem is, it costs MONEY 💴 💴 to file in probate court. Like 5-6k. The funeral may have cost around the same or less. Not worth it. I know because I’ve recently have had to experience this. My husband just passed. Didn’t have a will but had smaller issues that could’ve been solved in probate. Problem is, I can’t file a case in probate on my own, I have to have an attorney. Attorneys fees along with filing and all court costs is around 5-6k. Not worth it. It’s a total scam 😠…

    The end piece is generally good advice for job interviews, but I had to laugh because everything that was said to not do, I did, and still got the job. Before the interview, I actually told all three interviewers that this would be the worst interview they’ve ever encountered because I HATE interviews! They laughed, conducted the interview. I stunk it up, as predicted, and the next thing I know I was being congratulated for receiving the job. I was then told, my past work and character spoke for themselves and that’s why they hired me. I always believed if something is for me, nothing can stop it, not even me!

The commenter in no way indicated they had interviewed for a retail or other unskilled labor position.     I don't like that this man took the money in the first place. There was no concern over safe keeping. The landlord, wife and brother would be the only people that had access. The landlord is disgusting. He knew his tenant was on death's door

    The plaintiff is much too invested in retrieving or collecting something that didn't concern him, his true colors then begin to show the green of greed, his chase for that money, should have been given up long before coming to court, how can you be haunted everyday by where someone else's money went, SMH 💯

      When on SSI (disability) it is often the case that you are only allowed to have so much money in the bank or benefits are cut off as you have enough money to pay your bills, buy food, etc. It is not uncommon for people to keep whatever money they can scrape together and keep it with them so that their disability isn't cut off. That may have been the case with this gentleman.

      @@proshu My wife was on SSDI for several years, and we were never asked to report either our financial status or our earnings.
      While on Social Security, you can have only a certain amount of income, (and it might be only earned income, not investment income) but again, no limits on net worth.

    landlord should've only taken the money that he was entitled to for rent and put the rest of the money that he gathered off the floor away in a safe place in Sal's home rather than taking it when he had no right to it. I understand the need for probate to determine which of his relatives the money he would go to, his brother, his wife, or his daughter, but there is one person that I can guarantee you is not entitled to the money and that is Mr. Bongiorno.     So the wife moves away from her hubby and that doesn’t say red flag to the defendant about their relationship when he knows what type of housing she got? He can’t play the “I didn’t know about their relationship currently”, he knew too much about them and could easily contact the wife about the hubby’s money. The issue is that he was still married to her. So with no legal document about who gets what, everything goes to wife first. It’s the spouse first (even if they’re separated), then kid(s), then the parents, then the siblings are last legally on the list to get anything or control of any of their stuff if there’s no legal document on who gets what and who’s in charge of things.

      not a bad ruling because as the judge said she is not probate court. Therefore they're in the wrong venue to determine where the money would go.

    Honestly... I get the brother's frustration having to cough up to bury his brother when the brother had a wife but he sounds so ungrateful!! The landlord had a right to be paid. The landlord or his agent found the guy and tried to save his life. Because of the landlord and his agent, the plaintiff got to spend a little more time with his brother. When a person dies, the bills still gotta be paid for that month or whatever months that person (or their property) takes up space. In most places if someone does without a will, the spouse gets what's left and then the children. Not sure how this brother thought he'd be entitled to it anyway. The plaintiff should have not taken the landlord to court but instead thanked him and showed a little more compassion as it's not the landlord's fault or problem the brother died. And without a will. *face palm*

      @@JordynMcCray Except the money was already explicitly for him and the only reason the landlord was there. He later was told to keep the money by two parties who have the legal right to do so.
      The family is really lucky the landlord didn't sue the estate for more rent as it sounded as if the plaintiff's brother's crap is still in the apartment.

    It's different that he took the money but what people are missing is he could've lied.. It would've been easy to say I didn't take the money... There were emt workers there etc...the plaintiffs brother didn't even remember half of what took place according to the defendant... So it's clear he's honest because he never had to say anything in the first place... Picking it up and putting it on the dresser wasn't safe because it's left out and anything could've happened. It's just a sad case.

    I think the wife was given the money to the landlord because of the cleanup, but the gentleman that past still has a child I believe and that money should go to them, they will figure it out in probate Court good luck to all

    For once I don't think the landlord did anything wrong here. The money was set aside for rent and extra expenses accrued due to him having to clean everything out. Not saying the brother shouldn't get help with the funeral cost but funeral cost and rent are separate. The money is being used for what it was meant to be used for.

    I'm kind of with the landlord. The plaintiff sounds like he would not have paid his dead brothers lease obligations and felt 100% justified in doing so. People make all sorts of excuses when a loved one dies.
    It makes the defendant look kind of scummy but he's got a business to run. If the plaintiff makes a statement that he'd rather see the money go to charity, then he should pony up the money for the funeral since he's such a stand up guy.

    The dude should have left the money on the person's apartment. Even if he was there to collect rent he isn't capable to give a receipt to the person who is unconsciously giving him money. He self helped himself to the rent money that was laying on the floor while the tenant went to the hospital.
