    In this video I lament about using a Baofeng UV-5R without a ham radio or amateur radio license from the FCC or using a Baofeng or any unlocked ham radio on GMRS, FRS or MURS frequencies. I also explain what might happen if you do break the FCC rules using a ham radio such as the Baofeng UV-5R without an amateur radio license from the FCC. I also explain some of the reasons why using a Baofeng UV-5R or any unlocked HAM or GMRS radio on random radio frequencies might be a bad idea.

    Short answer, yes, you can be fined, your radio can be confiscated, even if you are just listening. Because it does not comply with license free freqs, because of power rating. Just get an operator's license, and register your radio. And know, boofeng is not cool anymore, just like camala harris, democrats, and anything related to 3 letter alphabet thing. Get quansheng uv-k5, it can talk via seatellite, it can listen to 40 ham band, it can listen to airband, it has spectrum analyzer, and I haven't listen quarter of what it has.

      Oh my! Fines and confiscation sounds SCARY!! Do you have a link to any of the FCC Enforcment Actions for when this has happened? Because, as I am sure you know, every time the FCC does something like that it is listed in their enforcement database. So.. We will all be here waiting for that..

    I have my ham and GMRS license, have appropriate radios for both. But the reality is, in real life, no one cares unless you are causing problems in frequencies your not supposed to be in.

      I think that GMRS shouldn't require a license because:
      1. Most GMRS radios have such a short range that it really doesn't matter
      2. Mostly kids and drunk adults playing around in the GMRS channels anyway and I don't feel that I should have to pay $35 for that.
      HAM on the other hand is a different story.

      @@stansmith4054 if you don't want a license use FRS or MURS or CB. GMRS requires a license because it allows repeater use, which repeater owners (like Randy) would like to know whose using their stuff.

      Yea I'm torn on it, maybe no GMRS license unless you wanted to use repeaters, that's where you could start effecting other people trying to share a frequency. The reality is, is there are so many people that have GMRS radios and use them and they don't even realize they are supposed to have a license. I don't mind the $35 for 10 years and I like that me and my family have a call sign to share, then we know who is calling who. We also do a lot of camping and off roading and sometimes it can be hectic out there if a lot of people are on GMRS, it can get confusing. In reality though, if you are being cool on the channels and not causing problems no one cares and the FCC ain't gonna be knocking on your door. For the FCC to come knocking on your door you have to be making someone mad for them to call them on you.

      The once real instance I know of the FCC knocking on a door was a guy that told me first hand. He said it was back in the 90's an he had a CB radio and he was pumping out some insane amount of power with a huge antenna in his back yard. He was causing interference all throughout his neighborhood and someone called in on him. He told them they needed a warrant and they left, and he took everything out and down and just left his basic CB radio with a small antenna. When they came back with a warrant they looked at his set up and said "well it must not be you then" lol.

    My new b00fwang UV5rs are now unlocked and can TX/RX on GMRS/FRS/Ham and MURS as mentioned, and the fact that there is not a Ham anywhere within the range of the b00fwang button pressing makes your shirt all the more appropriate for my situation

    Thank you for demonstrating the correct way to break in a new radio antenna! Suggestion- rub some 3-in-1 on the rubber and it will reduce the amount of time required to break in the antenna.

    Baofeng on GMRS is not a big deal, especially compared to everything else.
    Entire groups of off roaders and dog hunting clubs use Marine VHF radios out in the woods or off road.
    As long as it is not interfering with the Coast Guard or marine traffic no one will do anything about it.
    They would need to receive a credible complaint that was causing a serious issue with some evidence.
    The FCC investigators would then determine if it was worthwhile and prioritize against their existing case work.
    If it was a big enough problem, they would then go out and investigate and start collecting evidence.
    If they can gain compliance in the field they will and probably drop it.
    If they cannot gain compliance and it is still an issue then they turn over the casework to the lawyers to see if they think it is a big enough deal for a Letter and proceed from there.

    I use commercial VHF and GMRS frequencies on modded mobile and HTs in a professional setting all day long with zero licenses of any kind - only one group cares, guess who? Sad Hams

    #1 takeaway from this is they aren’t about to field agents at what, minimum $30/hour?, in a van, loaded with a bunch of expensive hardware, to track down a couple guys that may or may not still be chatting.
    Why on earth would anyone think they’d do that? Like yeah, ok, gov likes to fund itself with our dollars, and they don’t care if they aren’t cost effective, but even a none elected official wouldn’t waste that much

    I'm a ham (and I have a GMRS license as well), and I don't even get what the fuss is about as long as you're not interfering with business, EMS, or repeater frequencies, or being a lid in general. I'm willing to bet that if you punched in a frequency from the simplex portion of the 2m band plan and started talking to your buddy, nobody would even know or care. If they DID stumble across your conversation, they probably still wouldn't care. You only have to ID once every ten minutes on ham frequencies, and NOBODY is going to sit there and time ten minutes out to see if you ID or not LOL. Like Randy said, as long as you're not being a jackass, nobody is going to care.

    i just watched a talk given by the FCC to HAMS and GMRS folk. Only cases that are sent to the justice department are published on the FCC website. They had to stop publishing all actions.

      What I heard was that warning letters were not usually published but the official Notice of Apparent liability (NAL) is indeed still published and the FCC only goes to the justice department for collection of a fine after NAL has been through all the proper steps and the offender has refused to pay. The justice department is the step where you go in front of a federal judge and you have your day in court. I also heard them say that if they need to kick your door down they will bring along a US marshall to do it since they are not a law enforcement agency. (just like Rand always says - 'rules not laws')

      @@ZiggleFingers She said they only publish final actions as of the past 5 or 6 years.
      They used to publish everything before that with personal info blacked out.
      It will probably not make a large difference in the count over current history if you go back 20 years or so.
      My interpretation of what she said is that the only letters that go to justice are the ones where the person refuses to pay or comply.
      I am assuming a non-final action would be if they knock on your door or send a letter and you fix the problem right away, they would drop the issue.
      More to the point, no one from the FCC is going to show up just because you are using a Baofeng on GMRS.
      They are busy handling more important issues.

    I found my UV5R in Shoe box in the closet. I don't have license. I thought about getting one but lost interest. Just for fun I tried making contact with someone/anyone. The radio has all the FRS/GMRS/MURS programed into it. I also added any local repeaters I could find. The UV5R is unlocked. I live in a metropolitan area and no one is using any of the frequencies. I scanned about 80 preprogrammed frequencies. I listened to some net on the repeater. A guy from Paris, TX was trying hard to conduct a session. I felt sorry for him because very few people were responding. I would like to pick up amateur radio as a hobby, but it doesn't seem that is anyone else out there to talk to. I not going to study for a test for the privilege to listen to dead air.

    I’ve been using mine uv5r for almost a year now on ham and gmrs and on repeaters with out a license for almost two years .
    I don’t think the fcc really cares.

    Thank you . I'm a hiker overlander . I have not used it out in the wild . I do not have a license . But it only transmits a few miles . If I'm wheeling in the forest , with friends, yes, I'll take my chances . Lol .
    After all there are real criminals to catch .

      It really depends on the environment. I barely get a mi simplex in my neighborhood, but I can hit the repeater 27 mi away on a hill no problem, if I can see the hill. That's on a UV-9G, but it's only putting out a little over 2W on a stock antenna.

    Just get the chirp program, cord, and program the FRS channels. Use it all you want on FRS. Nobody cares if it's not meant to be used on FRS, or if it's too many watts.
    As a sad ham, I do have a request: PLEASE FOR THE LOVE OF GOD STOP KERCHUNKING REPEATERS INCESSANTLY !!!!
    Hey, I get it, you wanna make sure your radio works, if you gotta do it, do it once. I beg you all. Licence or not.

    As a licensed ham, as well as a licensed gmrs user, I’ve never seen anyone get into too much of a twist HOWEVER, idiots do from time to time wind up on public safety frequencies and that does create a problem.

    Yeah, I’ve got a ham license, but I’ve never really cared to flips about the FCC anyway. If I didn’t have a license, I would use it anyway, and just be smart enough to do it in a way. Nobody knew I wouldn’t advertise it. But even if not, I wouldn’t be scared anyway.. You see I’m a ham, but I’m a happy ham. We are a rare breed indeed.

    My unlocked UV-5R seems to work just fine. It has never once asked me about a license before "broadcasting" into the wild blue yonder.

    FYI since ruling of Chevron deference I do NOT think the FCC has much enforcement power. And FCC rules maybe in play also, congress makes the laws.

    If you're talking to your friends, of course they wouldnt say anything. If anyone stumbles upon your transmissions it would be better to continue quietly gaining intel on you, and hope you say something juicy. rather than revealing yourself early and spoiling the fun. Let the bird skwawk!

    It's pretty stupid that the FCC doesn't offer a "simple" license that just allows one to talk to another without needing to take a REDICULOUS exam containing questions that you'll never ever need to know. Some say just get a gmrs radio. Problem is, nobody in my area is on gmrs, they are all hams.

      So what you’re saying is, I should probably just get my gmrs license and a few BAOFENG UV-5G Plus GMRS?
      It would distribute them to family to have on hand in case of a natural disaster or you know, Civil War.
      I was thinking of getting the RockyTalkie gmrs too. They look like a solid build and I’m not trying to get too far into the rabbit hole of programming radios.

    I have a bunch of Bowfang radios,, and they are all programmed to GMRS, MURS, Marine, and Ham frequencies... 5R, 15RM, 17 pro gps, 21, and I am going to add a bunch more, and I intend to broadcast on GMRS and MURS, FRS frequencies....

    So just use MURS frequencies, don't be a dick to people, enjoy your time with friends and you're going to be fine. Thanks!! I love the UV-5R design compared to Wal-Mart or any other walkie talkie. Shame on the FCC to not allow this just for regular use sadly.

    Using A Baofeng UV-5R Without An FCC License - Do You Need A License To Use a Baofeng?
    Yes Transmitting: the uv5r was not made to be used on the FRS frequencies or any other band besides then ham for transmitting.
    No if your just listening or using the flashlight. OR if there is a true emergency.
    Enforcements: does not equate with the laws on the books if you are a morally upright person.
    Edit: Yup he covered it all.

    Define "use." I'm pretty sure I can use a Baofeng UV-5R as a paperweight and the FCC wouldn't be able to do anything about it. And I'm not a licenced ham radio operator.

    I am in Canada. I dropped my UV5R and it went off! Will Industry Canada hunt me down? My handle is so slippery, long and black. It does flop around like yours does. Is there a video about how to not drop my boa fang? Maybe a wrist strap will help.

    A volunteer county emergency radio group that I am familiar with (no names) supported a police training exercise a while back. They had a lot of volunteers, but many of them did not have any type of license. The group purchased a bucket full of UV-5Rs and programmed them to one of the MURS channels and distributed them among the volunteers. Everything when smoothly until the FCC SWAT team arrived. OK, no FCC SWAT team and the exercise did go smoothly. NO ONE CARED. I am a ham and I personally have no issue with programming the UV-5R for use on any legitimate civilian frequency that one is authorized to use. 😇

    How well did the FCCs enforce the license requirements for CB in the 70's? I had a licence. Most didn't. I was 14 and scared of the law.
    The day must/will come when the FCCs are going to have to give it up.
