I think if that case had happened after this one, the ruling would have been different. Sometimes the judge will have the defendants pay the medical bills and other times she gives a speech about the two parties taking the risk by going to the dog park so no one is at fault. As I recall, there was a similar case recently aired, and I am trying to remember why the Judge ruled in the Defendant's favor in that other case but ruled differently over the same thing with this one. I remember the Plaintiff exhibited a more belligerent attitude toward the Defendant in the other case, was indignant that Defendant opened her car to get her phone #, complained about an illegal No Parking Sign Defendant posted, had her car towed by Defendant, that her car was damaged in the process, and also Plaintiff stated that a gathering crowd was rooting for her; but for the life of me, I cannot recall why the Judge ruled on behalf of the Defendant. Cop gave her a ticket so defendant should not have to pay a cent. It's very unfair that a plaintiff cannot be compensated for their time spent mounting a defence. $5k is nuts but if she submitted a time-sheet for say 30hrs × $15/hr + itemised phone calls and postage, she should be refunded. If she had hired a lawyer likely they would be paid. The defendant brought a whole lot of legal trouble and cost to her door and IS STILL conducting an illegal parking arrangement, yet he walks away with minimal cost and zero aggravation. That is not 'justice'
Ok I've watched this episode a couple of times and I finally had to look into it. I do roadway design for a living in the state of NJ, and I know that here residential driveways that have concrete aprons and sidewalk have a 1.5" curb. I looked NYS DOT details and saw they have 1" curb. Curb cuts are only for asphalt driveways where there is a discontinuity in the concrete. The pictures the plaintiff show depressed curb that's in really bad shape, so it's hard to tell, but there's no question that it's much lower than the full height curb on the sides. So technically speaking, there is a driveway there and the police had just cause upon inspection to issue the ticket. However, the fact that the plaintiff did her research to prove that the driveway was probably constructed there illegally and not on file with the state of New York, I'm glad she got her tow fee back. Kudos to her!
I'm surprised the defendant didn't have any other issues of people parking in front of his house for 13 years, and that he had no clue that this may not be a parking space. That said, he had proof from his real estate agent that he bought the house with a parking space, and had no reason to question it. JM usually asks, so what did the person do wrong? He thought he had a legal parking space and was justified in towing a car that was left there for 3 days. Plaintiff suing for $5,000 was ridiculous, considering parking has always been difficult in that area.

When he called the police it was THIER JOB to inform him whether or not his driveway was legal. They obviously thought it was legal and gave her a ticket. That's why the car was towed. Her case is against the city police for improperly ticketing her car and having it towed.
That's not an actual legal driveway. Driveways have to have the curb cut. Just because they've used it as a driveway until the concrete has began to break down, doesn't make it a legal driveway. The person he bought the house from was probably just trying to consider it "grandfathered in" since nobody had complained and they had been using it for that purpose for so long. Either way, the city would still have paperwork, it would have to be approved, and the curb would be cut. Edit: I fully agree with this judgement. The plaintiff brought a bunch of evidence with her, which hasn't been the case in previous cases like this. I know that the Defendant knows it isn't a real spot, he just thought he could get away with it. You could even see him smirking at the end almost like "well dang, guess I can't get away with it any longer."
Is that the actual law in New York? Because we have tons of curbs just like that in Indiana and it's still a legal driveway. The city lays the curbing before the driveways in New developments are cut. It's up to the homeowner to cut it all the way down if they want it that way.

They've had massive parking issues in NY because of illegal driveways because there's no parking for neighbors. There is a whole track of new homes near me with 2" curb to drive over for the driveway. I didn't buy the house specifically because of that bump for the driveway.
There may be religious exemptions for Hasidic Jews and others. This hat should not have been allowed because presumably it is not being worn for religious reasons. Other than that, I think women are technically allowed to wear hats in courtrooms
How in the Land of the Free do you need permission for your own access to your land with a vehicle? Not encountered this in any of the countries I have lived in.
It's not preventing people from accessing their land with a vehicle. This is about creating a designated driveway that would prohibit anyone from parking in a spot that had existed for a long time.
Where I live, you cannot block YOUR OWN driveway. So the fact the defendant is parked blocking his own “driveway” is illegal. He can’t do it just the same as other people can’t do it. But that is NOT a driveway he just wants it to be. And he’s liable because he’s the one having cars ticketed and towed claiming they are blocking his driveway. I think the cops and tow truck just go by what he says, that it’s a driveway.
If the defendant believes it is a driveway, why is he parking his 2nd car across it? In Australia you can't park across any driveway including your own and you can even get a ticket if your car is in the driveway with an inch sticking out past your property line.

I live in a south-west suburb of Sydney and our council has sent notices a couple of times to all houses in our street that a fine of $275 will be imposed if vehicles are parked on the driveway so that any part of it extends past the front boundary line and also, if parking on the street, the vehicle's wheels are in any way on the footpath (which is of course council land). So, no cars ever get parked completely on the footpath now because you never know when a council ranger may be in the area ....
I think that since the realtors, are listing with parking spots, the city should paint reserved parking for the address on the curbs. And hope the family only has a single car.
Realtors don’t always know what properties own or don’t own access ways to properties. I went through this with my grandparents property, and the property will get sold stating there is an entryway to a property without there being an actual entryway.

There is no way that this man would legally have to pay this lady for the cops giving her a ticket and a tow... Sadly, he can not appeal. Everyone that comes on this shows waives their right to appeal and agree to her rulings as final no matter what. I don't know why Anyone would ever agree to that but obviously many do.

I would personally go out of my way not to park in front of another car, just to avoid this problem. I would find out if the car was illegal, and then asked for him to get ticketed, so he stopped using it, so I could park there. Yes that would take time. it was stated that there was no car there when she parked and that when the county went to investigate, there was no car there

Edit: I fully agree with this judgement. The plaintiff brought a bunch of evidence with her, which hasn't been the case in previous cases like this. I know that the Defendant knows it isn't a real spot, he just thought he could get away with it. You could even see him smirking at the end almost like "well dang, guess I can't get away with it any longer."
Is that the actual law in New York? Because we have tons of curbs just like that in Indiana and it's still a legal driveway. The city lays the curbing before the driveways in New developments are cut. It's up to the homeowner to cut it all the way down if they want it that way.
@@bestcee Yeah, they have to be cut. You have to get a permit approved and go through a process though. They've had massive parking issues in NY because of illegal driveways because there's no parking for neighbors. Apparently now officers have to check with the city before ticketing to find out if it's a legal driveway or not. Too bad they don't pass along info to code enforcement for the illegal ones.
The person who gave a ticket and had the car towed, needs to be fired.
There is a whole track of new homes near me with 2" curb to drive over for the driveway. I didn't buy the house specifically because of that bump for the driveway.

There may be religious exemptions for Hasidic Jews and others. This hat should not have been allowed because presumably it is not being worn for religious reasons. Other than that, I think women are technically allowed to wear hats in courtrooms

So glad I have my own drive way and no issues with parking. I can park 2 in the garage and two in the driveway.

How in the Land of the Free do you need permission for your own access to your land with a vehicle? Not encountered this in any of the countries I have lived in.
It's not preventing people from accessing their land with a vehicle. This is about creating a designated driveway that would prohibit anyone from parking in a spot that had existed for a long time.

Where I live, you cannot block YOUR OWN driveway. So the fact the defendant is parked blocking his own “driveway” is illegal. He can’t do it just the same as other people can’t do it. But that is NOT a driveway he just wants it to be. And he’s liable because he’s the one having cars ticketed and towed claiming they are blocking his driveway. I think the cops and tow truck just go by what he says, that it’s a driveway.
Actually, the cop should know the exact same way you knew, and that was because there was a curb there.
If the defendant believes it is a driveway, why is he parking his 2nd car across it? In Australia you can't park across any driveway including your own and you can even get a ticket if your car is in the driveway with an inch sticking out past your property line.
In Brampton, Ontario, people park across their own driveways without getting ticketed.
@@loriwhiston1587 In most cases here it is the same, but there is always some neighbour who likes to complain. When the council officer comes around, depending on their mood, they will either warn everyone in the street or ticket everyone.
I live in a south-west suburb of Sydney and our council has sent notices a couple of times to all houses in our street that a fine of $275 will be imposed if vehicles are parked on the driveway so that any part of it extends past the front boundary line and also, if parking on the street, the vehicle's wheels are in any way on the footpath (which is of course council land). So, no cars ever get parked completely on the footpath now because you never know when a council ranger may be in the area ....

I think that since the realtors, are listing with parking spots, the city should paint reserved parking for the address on the curbs. And hope the family only has a single car.
Realtors don’t always know what properties own or don’t own access ways to properties. I went through this with my grandparents property, and the property will get sold stating there is an entryway to a property without there being an actual entryway.
Judge has always defaulted to if there was a ticket issued the planriff was out of gas. The guy called the cops first and they issued a ticket.

Okay so this is the problem that I have with trusting this show that I have watched for years and years... There is no way that this man would legally have to pay this lady for the cops giving her a ticket and a tow... He has every right to call the cops and let them know what's happening... and if they decide to ticket her and tow her then the person needs to sue the city and not the gentleman... So the legality behind The win in this case is such BS and is not lawful... Can you imagine if you thought somebody was breaking into a house and you called the cops... And the cops decided to beat up the person.. but then they found out that it was actually the owner of the house.. do you think the owner of the house could then turn around and sue the person that called the cops. Lol uh NOOOOOOO... If I were this guy I would just go ahead and appeal this.. and have a different judge take a look at the matter
Sadly, he can not appeal. Everyone that comes on this shows waives their right to appeal and agree to her rulings as final no matter what. I don't know why Anyone would ever agree to that but obviously many do.

I live in Miami went to work an had someone parked in my driveway I parked behind the car an wait the next day I had the car towed, not saying this is the case here but people can be self entitled and park where they feel like it and it's not always the case

If you turn a garage into an apartment, you lose the space between street and “garage”. You can bet your bottom dollar if it was a legal driveway there would be a no parking, blocking “driveway” sign. He is full of manure.

I would personally go out of my way not to park in front of another car, just to avoid this problem. I would find out if the car was illegal, and then asked for him to get ticketed, so he stopped using it, so I could park there. Yes that would take time. Of course, then he'll just park in the part you were going to park in anyways.
