Good Day po Atty! Since according to article 12 of RPC, the Criminal Liability shall not incurred but Civil Liability shall incured in exempting circumstances. Tama po ba ung sinabi ng isang lecturer na sa paragraph 4 of article 12, na kapag there is no fault & intention during accident, ang result daw po ay mawawala ung both criminal & Civil liability nung offender? (I got confused po kase nung sinabi nya yun) Ty po.😊
Hi Atty! Thank you for this! Would you have any recommendations po where to find sample cases of insanity defense (both acquitted and convicted)? I'm studying forensic psych and I'm finding it quite challenging to find cases like these as most cases involving forensic psychs are annulments :(
