Based po sa explanation nyo, is self defense considered if the robber was killed with a gun within your property provided that: a. The robber was shot without him knowing you have a gun (hindi na tinawag yung attention nya, binaril na lang bigla) b. There is clear proof of robbery (already in possession of your belongings) c. A single, non fatal shot was given but the robber succumbed to injuries
lol hindi ata pasok 1) Unlawful aggression ❌ nagnanakaw lang, so walang unlawful aggression to person 2) Reasonable necessity ❌ Binaril mo lang without warning, and he wasn't even threatening your life 3) Lack of provocation ✅ 2 of the 3 elements were not present. Therefore, this act is not a justifying circumstance... (correct me if I'm wrong)
No problem if judges and prosecutors follow the law. But most often they don't. Depending on who their "client" they twist the law or resort to technicalities.
Atty, in the case where there is a thief that breaks into my house, is this considered an attack and am I legally allowed to defend myself using a firearm to stop the threat? In this second scenario, if someone breaks into my home and they are holding a weapon. Am I legally allowed to defend myself using a firearm to stop the threat? Third scenario: Multiple people break into my house without weapons and are refusing to leave even after confrtonted. Am I allowed legally to defend myself using a firearm to stop the threats to me and my family?
Case #1: Illegal trespass to dwelling pa lang. Unless makita na may bitbit silang gamit mo na aktong nagnanakaw, doon ang thief. Ilan sila? Kung marami at may weapon sila, allowed to defend yourself with a firearm. Need mas buo details kasi kung kulang ang facts, di maibibigay ang tamang answer. (Ayon sa pagkakaunawa ko) Pero maganda galing kay Atty. answer. Law student pa po ako eh.
Case # 3: Allowed to defend using a firearm kung pumasok sa isip mo na it will cause danger to you and your family. Ung pagpasok sa bahay ninyo na di mo kagustuhan ay pagsagasa sa iyong right to property. Kahit wala silang weapon, pero sa dami nila, that can equate to danger lalo at force ang pag-uusapan. Pero mas maganda kung ang ans. galing kay Atty. JP. Nakita ko lang comment mo at nagtry lang to answer. I am a Law Student po applying ano ang naunawaan.
