Each state (typically through the Secretary of State's office) registers the names of LLCs and corporations. To check, you have to look at the database of the state where you want to register the LLC. Each state handles registering an inactive LLC differently. In most cases, they require the name to be inactive for 2-3 years and then it's available to register. Others require getting a signed form from the original LLC owner giving the rights to you. You can check with the Secretary of State to see what their rules are.
