    Car parking companies are the scum of the earth with lowlifes working for them. Hope the judge sees sense, you win and the company gets a huge legal bill. What they are claiming is that the car was parked in the middle of the ramp facing 2 different directions and had its lights on. 🔔ends...

    I believe they call it double dipping. Usually see it when you visit a carpark twice in one day. They only show the first visit and the fourth visit, making it look like you have been there longer than you have. Good luck with the case

    They have to comply within 30 days
    Ask for all photos, forms, copies of letters emails and all personal data held on file for you

      Not sure how it's corruption... they believe the person overstayed. The landowner issues a parking charge notice.
      Appeal it or take it to court if you feel it's necessary. Don't forget you can always make a civil claim against the company of your own - you don't have to wait for them to take you to court first.

    I work for the NHS and sometimes couldn't park in the staff car park, so would park elsewhere, I've had so many tickets and letters saying we MAY take you to court, as the parking attendants where from an outside source, when I've looked into it, the solicitor was about 70 and worked alongside them, I paid £22 a month out of my wage for my parking permit and all i got was that hassle!!!!!, I ignored every letter, ive never heard a thing since so yeah They're all scammers.... can't park, be late for my shift or just park and be on time? Total scum...kick ass Jesse ❤

    I had a similar "eledged" parking fine. Apparently I had parked my vehicle in a private parking area during lockdown. The initial letter did not include any images of my vehicle on the alleged date. I contacted the company asking for photographic images with a date and time stamp. The fine was passed on to many different companies. Two years later I received a letter informing me that I was being taking to court, unless I paid £345 within 7 days. I stood my ground, did not respond. I then received a letter from the court informing me of the action being taken against me. I contacted the court, informing them that I had previously requested photographic evidence of the 'offence'. Two weeks later the parking company issued a discontinuation of their claim

    Jesse, the same is happing to me with Civil Enforcement, I rent a garage which is located within one of their car parks, every time I drive my car in and out of my garage, I get another letter in the post, I must have received several hundred in the last 2 years. Mine hasn’t gone to court yet, but in my case I don’t think they would stand any chance of winning.

    I had a friend in the same situation, he provided dash cam footage and still lost. The court even supplied him with a solicitor but he since found out that they were working with the car park company.Good luck anyway and really hope you win.

    I always ignore these. Got 2 fines from a hospital due to the metre not working. Been nearly 2 years now. I respect u so much on this. It’s just all a massive threat. As if bailiffs would come for. £170 fine 😅 but I’m in the exact same position as u on this situation mate.

      Not sure where you got that idea from.
      You do realise they add to the fine right?
      The £170 is what they are enforcing..... but the bill isn't £170.... if you ignore it and they keep visiting it goes up and up, and they MIGHT decide to take you to small claims court for the amount owed plus their legal costs.
      Parking companies used to just send letters and not do anything - now many of them are starting to take people to the small claims courts, and when people don't pay if ordered by a judge they can issue a CCJ against you which ruins your credit rating and means you are highly unlikely to get any credit for 6 years.

      @@thefiestaguy8831it’s been £170 for about a year and a half. Private parking fines u don’t have to pay unless they want to take you court. If you have multiple forms with the same company then yes it will go up an they can take it further

    Surely theyve got have pics of the car being parked . The car has to be left without anyone being inside otherwise its classed has waiting not parking . Pictures of a car driving into parking area and back out again regardless of a 20min time gap it still cant be classed has parking .double yellow lines mean no parking but pulling up with enging running is ok unless a no waiting sign is in place

      That might be the case on public roads but in private car parks it's different - the landowner can set out their terms, and it's up to you to comply with them. If of course there's a valid reason for breaching them... i.e medical emergency, poor signage, not clearly displayed etc then you have a case. Many people think these private parking charges aren't enforceable.
      They aren't enforceable through the criminal courts.
      But they most certainly can be enforced through the civil courts... in the same way that if you take a company to court for misusing your information or disclosing your personal data where there is no legal basis to do so, they can be held liable.

    I had this many years ago in Milton Keynes, was told to just keep ignoring the requests as they just hope somebody will pay to leave them alone - crooks the lot of them

      Years ago that was the case.
      Now a lot of firms are taking people to the claims courts over this. As for the "it will cost them more to enforce it than they will get out of me"... this argument doesn't work because they are enforcing for the fee amount PLUS their legal costs... so a £60 parking charge if not paid for instance for 2 years might turn into £500, of course it would take a lot of letters, phone calls etc before it got to that stage and some companies don't enforce at all any further than sending irritating letters or texts.

    Go on Jesse take them to court get the best solicitors and defend yourself. I got 1 in a gym in a nursery carpark but the gym is in the same car park. It was after 9pm no nursery open but I just paid the £25 at the time because I didn’t want the hassle but I wouldn’t pay now. But I just stopped going to that gym. I’m a member and should get parking there. If they can’t provide that, then other gyms can. Learnt to just take yourself out of situations that aren’t worth it

      Some car parks are confusing. Some car parks which might appear as "1 car park" are actually two. So for instance parking there to use the Gym would be using the spaces for a Nursery to go to the Gym. Plenty of people get caught out although there's not a huge amount of these confusing car parks, most are owned and operated by the same landowners or enforced by the same companies.

    I got done for driving without due care and attention at court for a car crash that wasn’t my fault, 6 points £600 fine. £65k claimed against my insurance for injuries to third party and car. For me to appeal it I was looking at over 2k back in 2010. This isn’t as serious but the courts, lawyers etc aren’t cheap and will rinse you for everything they can. My advice would be, just swallow your pride and pay the fine.

    Years ago I had a similar issue with a supermarket carpark, they had a lower and upper car parks covered by cameras. They tried to scam me and caught me going lower carpark at a certain time and leaving via upper car park later past the allowed time. Fair enought, but unfortuately they don't know the layout of the car park and there is no car access from lower to upper without going past cameras which are seperate I got a photo me entering lower car park and a photo me leaving upper car park but other 2 photos wasn't presented me leaving lower and entering upper one and I appealed explaining and I won and they cancelled the fine. Like yourself it pays to know the layout and rules where you park when you live locally and know the area.

    Wife got a ticket for overstaying in a retail park. Picture going in with the time and a zoomed in pic of the reg going out. What the company didn’t show was it was hitched to the back of an rac van as the radiator failed and had to wait for recovery. RAC gave proof of the time of call and it took them so long to arrive that she went over the time. Ended up being thrown out

    I had a simiar issue when the ANPR cameras failed to pick me up leaving a Sainsburys car park which was monitored by a 3rd party company.
    I went there in the morning for something and the next day went there for something else and they claimed I had parked for over 24h. Luckily I had CCTV footage of my car parked at home between them times but asked them if they had footage of my car parked for that amount of time.
    Coincidenatlly they said they could not share what they had due to GDPR even though I said I would make a (DSAR) Data Subject Access Request to them to call their bluff. I shared the video footage of my car parked at home and they dropped the claim.
    I was going to go further wth the DSAR but the effort was not worth the reward considering I had the claim already dropped.
    Stick to your guns mate and make that DSAR and even anything like purchase receipts from your mrs using the car while you where dropped off can help.
    One thing I would do is get your own solicitor and ask them if they do any pro bono work for a shoutout on your channel. Any solicitor the court provides will be an inside man so to speak so you will loose from the outset.

    Had similar this week for washing my car in a petrol station. Euro car parks sent me a fine for £60 which is now £100 as I’ve gone over the date. I wasn’t aware that I had to put my plate in the system with petrol station staff. I was 44mins and u only get 15min. How anyone can wash a car in that time is beyond me. Use the place to fill the work van as it’s 24hr and washed it there too. Not once have I had a fine from them b4. I’m waiting for a reply from an appeal as it’s know for giving out fines from reviews I’ve read. I’m absolutely fuming imo these companies make it up as they go along it’s disgusting
    Update from the appeal… they dropped the fine by way of a goodwill gesture 2day

      Don't mean to be rude... but how on earth does it take you 44 minutes to wash a work van and get some fuel?
      I could literally wash 8 or 9 cars in that time.
      Unless your "work van" is an articulated lorry....
      I used to wash my car a lot using the Tesco jet wash.. I could wash it easily in less than 6/7 minutes.

      I on the odd ocassion wash my own car when the car wash isn't working. It doesn't take anything more than about 6 minutes...
      Unless this chap has a huge "work van" how it takes him 44 minutes is beyond me. Either that or he spent 20 minutes queuing for fuel...
      For what it's worth most car washes in the UK aren't run by Turkish people, they're run by Albanians, at least the majority of the ones near me are.

      @@thefiestaguy8831 I was washing a car I just purchased that hadn’t seen a jet was in months. I wasn’t washing a van. My job as a mobile tyre fitter means the van gets filthy very quickly and as it’s only a year old I like to keep it clean plus general up keep is down to us to keep clean as we have 3 month inspections from the gods above.     claming you stayed or parked there... they are clearly manipulating the fact you came and went multple times... ?
    proper cctv vid images have date/time stamps on them...
    problem you have is you knowingly drove into a restricted parking area....
    not sure the rules on that one....

    High court is criminal, this matter is civil and would be dealt with through small claims court, where you would get a letter from Northampton civil court, which you get the chance to nominate your local court and submit your defence, I have never heard of a court mediator, this sounds very suspect as courts operate through written letter, you can file online, pay the court fee online, but you get written confirmation on official paper.

      In my experience you ignore all letters and calls. They dont go to small claims because that costs them money to raise the claim. They would rather sell the debt and make money that way. Multiple people have done the same as me in comments and no action is taken in my experience of parking fines and small bills like mobile phones.

      Also if they do go to small claims court they cannont claim for more than what the fine was originally, no extras can be added. They also have to attend the court which is more cost to them. Totally uninforceable just like the british tv licence.​@@SBBUK

    I had the exact same problem last year. I went to Walsall because I was booked in at mij to get a custom exhaust, but I was a little early, so I went to Maccies drive-thru to grab some food.
    It was pretty busy, and I was waiting in the queue around 12 minutes before driving to tesco and parking in there.
    Over a week later, I had a letter stating I was allegedly parked in mcdonalds for over 10 minutes. I was like wtf I didn't even park there!
    I argued the toss, and they couldn't care less. They sent me images of me going in and out in a 12 minute gap, not actual proof of me going through drive-thru or parking up.
    I asked for them to check cameras at mcdonalds, but they ignored my request. I ended up paying because I've had a ccj in the past from parking and not being notified about it, so I didn't want to risk that.
    They're dirty little rats, and they'll give you such a migraine over something petty.

    I had exactly this happen as well. I dropped my wife and kids off at a party and left to return later. And nearly a month later I got an enforcement letter with the first arrival and last departure, same as you. I tried to get CCTV from the garage I visited in between but most places delete CCTV after a couple of weeks. The conspiracy nut in me suspects they delay the enforcement letters so that such evidence would be hard to get. I managed to get it sorted by contacting the owners of the building, but it got tense for a while.
    If I were you I would take another car up that ramp. Then drive to places with ANPR, like a multistory car park, anywhere that would count as independent proof. Then drive up the ramp again.. Then when they send you another enforcement letter you will already have proof their full of shit.

    I feel like you should have just paid the £95 mate. I work in debt recovery, so thought it might be worth clearing a couple things up:
    - you'll be in County Court, given the value
    - you would be surprised how mediation, hearings and litigation add up. If you go to hearing and get a judge having a bad day, you'll end up with a CCJ and about £300 worth of additional costs and interest.
    - Don't try and counterclaim for harassment and damages, if you aren't willing to spend £££ on a good solicitor.
    These places are a business at the end of the day, if there's money in it they'll pursue it!

    My cousin went through something very similar- in the end a couple of days before the court case I believe the parking company was contacted and told to drop the case as they will lose

    Afew years ago, I pulled into kfc in Newark, hoping for some food. Turned out it wasn’t open, so I drove back out of their carpark and went to McDonald’s instead. 2 weeks later I get a fine through the post claiming I needed to pay £60 for parking out of hours in kfc. I called them and explained that I drove in, realised it wasn’t open, and then drove across the road to McDonald’s. The parking company said, because I stopped in a parking space, I had broken the rules. I laughed and said I had to park the car to approach the door to then be told by a member of staff, it wasn’t open for another 35 minutes. This apparently was enough for me to break the rules! I ended up paying it because I didn’t need the hassle. £60 for 1 minute and 38 seconds. And no kfc food!!

    Biggest mistake ppl make is acknowledging any correspondence from private parking companies.ive had in excess of 40.some of the images they send are hilarious.so obviously my car parked in different bays.fair play if U go to court and state your case.once U respond to their scam fine,U enter into a contract with them.if U don't respond,who's to say U have ever received any communication ?

    Details matter, if you can get any proof that your partner was with the car at any point at the times stated they are fucked. If she has gone to Tesco or any supermarket, they will have captured your plate with an ANPR camera which you can use for evidence. Really hope this goes to the point where they get shut down for being such fraudsters.

    alot of car parks in ilson used to be 1hour free then they changed it about 3/4 year ago, used to always park in the one near gizmo's but now if i ever go into town just use wilko's there free bays up there if you go 63 Barbers?

    You got the time and date so you can show your bank statements to prove that you was in Tesco like you said. My advice is get your evidence together because most car parks show a car going in and coming out a that’s perfectly fine to warrant a fine. Good luck bro

    Mate, they’ll probably pull out before court, I had a similar thing and the day before cancelled the fine. I’d counter claim saying it’s caused you emotional distress, and causing mental health issues etc etc. But I’m 99 percent sure mate they’ll pull out before it even gets to court, it’s all scare tactics. Like you say they haven’t any evidence of you actually parking there and they KNOW that. Hasn’t the barber got cctv of you at that time and date of you been dropped off and picked up? 🤔

    Do not attend court buddy. Ring the magistrates directly and give them the reference number nothing else, don't mention your case just the ref number they won't have anything that matches that number, it's a scam they hire the courts out. Don't use any phone numbers the scroungers gave you get the magistrate number from the web.
    Just keep offering your £60 and record your phone calls but you must tell them you are recording if you offer a payment youre not refusing payments. Good luck pal.

    My daughter has had the same letter from the same company for the same amount for parking at qmc where she works but she paid on the ring go app! And has the receipt may I add but they are not interested and said she still needs to pay the fine because there might of been a fault with the ring go app,you couldn't make it up! I've told her to tell them to take you to court. They make my piss boil! Good luck with your case Jesse 🙏

    They haven't sent you the picture proof like you said of in between so it will get thrown out... they will get asked by the courts why the other pictures haven't been issued to yourself but send for a Data Subject Request

    I think it’s crazy that in shops like ASDA, you are only allowed 2 hours there, even if there is proof you were us using the car park to shop in the store, and not going elsewhere. That will make your shopping trip £70 more.

    They've omitted some of the evidence, but you're right, the proof does not show a car parked. I would request the video evidence between those time stamps, that may prove that the car was moving. Hopefully you win the case, they're very dodgy, I would look at reporting the company to the English equivalent of the Ombudsman they can investigate the company.

      Most companies use ANPR cameras to enforce their parking.
      ANPR works by taking still images of a vehicle, reading the plate, and entering it into a database along with a date and timestamp. When you drive out, it does the same.
      The automated system then compares the time you entered, to the time you left, and if that is beyond the maximum permitted stay a parking charge notice is issued (or penalty charge notice if council/public operated carpark).
      There is usually no video footage because they don't enforce it by CCTV means in the majority of cases, and ANPR cameras don't record video.

    just write too them ask them to set a court date you want to go to court ,they always back down .ive had loads ,only a judge can make a decision .parking eye are sick off me and moorcroft and lowell finance and others . always ask for a court date .

    Lol same company tried it with me said I stayed in a carpark for 2 days when it was a 2-hour carpark I went the first day but had to take something back the next day as it was faulty and got me on that saying my car was parked for 2 days lol keep sending me letters saying they were taking me to court my wife said just pay it I was like no I wasn't there for two days. Lucky for me I had CCTV at home where my car parks and a tracker on my car to prove it they didn't like it and said they were sorry and it must be a faulty camera 😂😂

    the problem you've got is that you left it a yea before doing anything about it. You got an invoice for parking where you're not allowed.
    Arguing that you didn't park on the ramp, won't get you anywhere because they don't need pictures of you parked there, they have pictures of the car twenty minutes apart - going in and out, You're saying that they've decided to delete the pictures or not send them and you're being scammed; but you ignored the letters. You know why they've not sent them? because you left it a year; the pictures and footage probably no longer exists because ...... you got it, you left it a year.
    You're expecting them to believe that you're telling the truth because it's got to the point where they're taking you to court.
    The debt agency didn't believe you're being scammed, you contacted them so it went back to the company to enforce the debt.
    Now you've got to go to court and try and convince magistrates that you're telling the truth because you left it too long for them to check that you were actually telling the truth.
    and if you offered to pay the £60, you've accepted that you parked there and they'll likely use it against you.
    If you didn't reply there's a chance they'd just take you to court, you wouldn't turn up and you'd more than likely end up with a CCJ.

    Take your partner as a witness and testify that she was driving, that may go in your favour? Also did you have a dash cam in the car and go through the footage? Dashcam is the way forward mate. Hope it goes your way and the judge see's through the scammers!

    This happend to me when I dropped my daughter at work it showed me arriving dropping her off and leaving with her 7 hours later but not me leaving or coming back in between like I sat waiting outside Asda while she did her 7 hour shift 😂 suffice to say I didn’t pay and luckily Asda sorted it out but it’s so frustrating

    Usually find they cancel the court case days before. As it cost them to much to take to court

      Costs them but they reclaim the costs from the losing side (usually you). A lot of car parks are operated by massive firms like Parking Eye, Euro Car Parks or NCP and they aren't exactly short of cash.

      All depends... years ago they weren't enforcing them.
      But they can enforce it for up to 6 years. So you could hear nothing after the first few initial letters but up until the 6 year mark the debt is not "Statute barred".
      A debt after 6 years become "Statute barred" unless the company claiming the debt can show they made numerous attempts to enforce it, but were unable to track you down (for instance you moved to a different country for 6 years before returning).
      So people might "bin the letters" and in 12 months time might suddenly get a demand for the original fee plus enforcement costs for the last 12 months, which might consist of a fee for letters, enforcement visits to your address, etc. If you still refuse to pay they might opt to take the case to a small claims court whereby you can end up with a CCJ.
      On the other hand, they would have a hard time enforcing it, if no initial notice was ever handed out, and 5 years and 360 odd days later they suddenly wanted to enforce it.
      Just pointing out that it isn't a case of "Binned the letters, heard nothing for a year so the case has gone away".... often it takes 9 months or more to get before a court anyway.

    Absolutely ridiculous as it’s going to cost them more going to court , I think they need to supply full evidence in court (all photos) they cannot withhold evidence so in their best interest to retract this . Stick to your guns Jesse and make sure you have as much evidence to back your case although I honestly think the court will just throw this out . Good luck we are all behind you on this mate 👍

      Missed how the courts work.
      They take you to court for let's say £60.
      Do you think they're going to spend £500 enforcing a £60 debt? No.
      But if it worked that way, nobody would ever get taken to a claims court - which DOES happen.
      So it clearly doesn't work that way....
      It actually works so that you get taken to court for what you owe, PLUS their legal costs if you lose. So a £60 parking charge might suddenly become £560 if you ignore it for months and months and they take you to small claims court. Of course the longer it drags on and the more they enforce it, the higher the charge. Of course you can still physically refuse to pay it even if a judge orders you to pay it - since it's a civil claim and not a criminal one.
      BUT then you are likely to end up with a CCJ (as someone else commented on here they have one from a parking charge).

    Asda did this to me sent me a fine saying i was in asda over 24hours and sent me 2 images 1 me entering and 1 me leaving.. i sent them a email advising them to check their cameras properly before send out fines as i entered the day before left within 10 mins and entered the next day to put fuel and left within 5 mins they then sent me a email advising the fine has been scrapped.
