- In this video lecture we will learn the meaning of Conditional Legislation with examples (Environment (Protection) Act 1986, Air (Prevention and Control of Pollution) Act 1981 and Factories Act 1948). I will also cover 8 cases which will help you to understand the concept of Conditional Legislation. I have also covered the three categories of Conditional Legislation as well as difference between Conditional Legislation and Delegated Legislation.

Mam, please tell that could delegated legislation be challenged on grounds of violative of excessive delegation?
Delegated legislation can be challenged on various grounds like Delegated legislation is ultra vires the constitution, inconsistent with the Parent Act, inconsistent with the general law, arbitrary or unreasonable. I will be uploading the video covering these grounds under judicial control over delegated legislation on next Monday.
Also, the Parent Act which delegates the power of rule making through one or the other section can be challenged on the ground of excessive delegation. Yes, it is related. You will also find ample of cases under the chapter Judicial Control over Delegated Legislation, where the Delegated Legislation was declared invalid on the ground of being ultra vires.
