I think that's something a lot of us go through as artists, learning the difference between copying and being inspired. It's a skill that you HAVE TO develop: breaking down what you like about something and taking it without copying it. If that's not a skill you have yet, then you should not be selling your art, whatever it may be.
Also a great way to avoid copying things is taking inspiration from multiple sources, the more the better. That is an excellent way to diversify your designs and find something that is yours.

    I'll never forget this:
My brother made a design for a tail and send it to a tail maker to see what they think whst the price would be.
Just a week later the tail maker suddenly came up with a 'new design'... They looked exactly like the fins my brother had designed and they weren't even mentioned as inspiration.
The person who makes the tails even suddenly messaged him saying something like 'hey while making those fins I figured they're close to the fins of your design and that means the tail won't be as expensive'
I personally am quite pissed off about it, my brother shrugs it off but I know how upset he actually is about that. Having his fin designs just ripped off of him and have the creator just pretend he cme up with those which is just a lie. What's your opinion on this?

What tail maker is it so I won't buy from them? Your brother should check out his rights on that. That is just wrong of the tail maker.

Thank you for 7:21 this specifically was something that people really need to hear, especially with the younger people in the community; people just need to step back and think before blurting out that someone's stolen a design when they're barely similar but might be inspo of the same animal etc.
And like you said people could always nicely DM the person and just let them know something is just SUPER close to another maker's design because they might have not known. :')

Oh, I remember when Sealeste and Tanychew's glaucus tails came out. I got a few messages and tags on both sides of the argument after I posted my images upon receiving it in my insta. Not THE drama notes, but it was quite a surprise. I mean, Sealeste was in the works for nearly 12 months from start to receiving it in the mail. I didn't want to take part in any name calling, because I knew this was just stars accidentally aligning in a way that could ensue drama.

It does get fishy when one company teases their new tail with certain fins, colours, patterns... then when it is released another company launches the same thing except a slight difference but they are both identical!
The second company did alter That design, but it still done first. Yes, we dont own colours or patterns etc from nature, but when artists or companies start to plagiarize others it gets a bit... hmm. 😨🤔
Many of my artist friends have been hit again and again with overseas cheap printing companies taking their copyrighted art and using it for similar or same purposes or something completely different that the original artist doesn't want it used for. Its crazy, and exhausting. 😓
Thanks again for the videos Courtney 💖

I talked to my lawyer about this I’ve had him a long time because I’ve been a performer since the 80s and I’ve had all kinds of issues. Now that I’m going to release my mermaid tails I already know that people are going to try to deliberately copy them or even steal the designs and he gave me a lot of insight and we have more rights than we know

Just giving this video some love, I should be making a video like this about plagiarism and infringement in the fairy wing world. Jasmine sent me over here to watch this and she's got a foot in both communities with her business, and most of us all talk as well about the problems we have with this. Currently going thru it with some big businesses.

Good thing that my tail was inspired by Siren, where the color and schemes are dark and serious. What makes it unique, is the small details it has, the dorsal fins and scales and even the fluke cut that separates it to other almost identical tails…. “Details “ are unique

The RUclipsrs that do the mermaid challenges and they never swam in a tail before and just straight up buy a silicone tail. We all know you shouldn't do that, and it doesn't sit right with me to be honest...

although at this point it feels like whatever you make, it will most likely be close/the same/have similarities to other things people have already drawn/made. unless you maybe search out a really niche creature or item to take inspo from but even then.
best way to approach (what i usually do) is to just get off internet, don't look at what others have made already, just look at the item or animal you want to make a design with. that way there is less influence from others and less of a "oh i can't make it like that, oh... or like that... or like-" feeling for me. in my experience looking at what others have created already often feels very restricting...
just have fun with it is my best advice, don't look too much at others creations when planning to make something yourself. and at the end of the day, it is for you. if you are not going to sell it i think it is ok if something accidentally looks a bit like someone elses art. it has pretty much become un-avoidable...
(but if you do sell it, do check if it doesn't look too close to others work otherwise you may get in trouble for it)
