      When I lived in New Jersey, going to college at a time, I told him about my experience when I was in the army while being stationed at Fort Drum, New York, where the way I was treated in family court. I was working internship in Family Court while in college, and they told me well that’s just how it is if we change the system, children are gonna be harmed. I told him that’s the opposite and I showed him the research and they claim that’s just one research.

    We've had that in Illinois since 1998, called a Voluntary Acknowledgement of Paternity. Works as a court order. But still had to open a case to set parenting time/support.

    What happens if the father does not show up or is not involved in the child’s life. There is a time sharing and paternity in place but he never helps and the minor is now 4. How can a mother get sole custody

    My question is, is the new law retroactive? For example, i am on the birth certificate and their mother and i filed the acknowledgement of paternity at the hospital. Under this new law do i have equal rights? Or do i still have to jump through all the hoops we had to before?     I have a current problem.
    Child lives with grandparent as of current.
    Mom in jail.
    I as father have a DNA establishing me as child father.
    DCF in now involved with grandparent.
    DCF found out grandparent has no custody or rights to child.
    As of now we don't know if I can just go get child with out getting into legal trouble.
    No one is trying to help me.

    If the mom has 80/20 custody can someone get 50/50 with this new law?

      Hi!! Thank you for your comment...I can't give you legal advice as I am not your attorney, but the new law applies when timesharing is being established--there is now a presumption that it should be split between the parents 50/50; and father's now can establish rights with first filing for paternity.
      Courts establish the final plan based on other factors...It sounds like for your case, timesharing has already been established...which can be modified at any time on a showing of a change of circumstance and that the change is in the best interest of the child. Typical example: when parents established a timesharing plan of, for example, 80/20, the parent with the 20% had a work schedule that was difficult to care for the child, worked late at night, couldn't help with school work, pick up child from school etc. That parent now has a new job or schedule that would allow time to care for child and would be in the best interest of the child to spend that time with the parent...this would be an example of a timesharing schedule that maybe modified

      I'm the mother and my baby daddy walked out on me almost three months ago and is ghosting us till this day my question is should I just leave things the way they are or should I file for custody even tho I have custody at the moment since we aren't married and if I file for custody here in Florida it's 50/50 correct can he refuse to see his kids or will the judge tell him it's his responsibility. How does this all go
