    What if the other party did not respond to do meet and confer? I cannot file the motion to compel?

      Good morning, Irra. That's a good question. The Rule requires you to make a good faith attempt to confer with the other side. Everything is on a case by case basis; but generally speaking, if you tried to reach out to resolve this without having to file something (like a motion to compel) and the other side did not respond (within a reasonable time frame; not an hour, but a day(s) while discovery requests are past due), then your part in trying to confer should be satisfied. Also, it may help your case if they did not file a request for more time to submit the responses, and they ignore your efforts in trying to resolve this without using the Court's time.     "Pre-suit discovery"? How do you request discovery without a case number? Why are you making a RUclips video to drum up business yet you can't remember the Florida Rule of Civil Procedure rule number pertaining to something as basic as an MTC offhand?

      Hi Larainy! Thank you for visiting my page and taking the time to provide feedback.
      Here are the responses to your questions:
      1. Yes, you can have discovery before initiating a case. Presuit discovery is procedural for some cases, primarily those dealing with personal injury deriving from medical malpractice. In some instances, it’s necessary to undergo presuit discovery before being able to file a case. See, for example, Florida Statute 766.106.
      2. I create RUclips videos as a resource for people who cannot afford an attorney and/or want to learn the process. It helps me tremendously in that it allows me to help more people in less amount of time.
      3. In Florida, Rule 1.280 governs the general rules/procedure of the discovery process; and Rule 1.380 governs the rules/procedure for filing a motion to compel. I don’t typically cite* to rules/statutes in video recording as it may confuse/lose viewers with legalese, but will definitely keep it in mind for future recordings. Thank you for your feedback!

      @@AnnaFernandezEsq 766.106 is medical malpractice cases/informal discovery. That's very narrow, not for your typical lawsuit.

      Blessings. A landlord had his police friends falsely arrested me and physically abused me by choking me with a sit belt, put a bag over my head until I fainted & dragged me. I ended up in the hospital with a blood pressure of 210. They then falsified medical report and said that I was drunk when I was never interviewed, never evaluated & no exam was performed on me. What saved me is the fact that I went to a different hospital right away and they document that I was abused, " TRAUMA." I had an attorney, but he was trying to have me sign Medical Authorization form to get that false report... And he told me to sign a Stipulations of Probable Cause, & he wants me to plea guilty to municipal ordinance because I vomited & urinated when the police abused me. Because I didn't want to sign he relieved as counsel. Can you help me to represent myself, please ? I'm willing to pay for your advice. Oh, did I mention how the police had a complete video DO- OVER to convict me & they ask me to waive all my rights to sue them or file against them ? Yes. Help me, please.
