  • A 66-year-old alleged drunk driver appeared in court bruised and battered. Surveillance video shows Marshella Chidester’s car speeding towards a boat club where a birthday party was being held in Berlin, Michigan. Alanah Phillips, 8, and her 4-year-old brother were killed instantly when the speeding car zoomed right into the birthday party venue. Their mother and a surviving sibling are still fighting for their lives. Childester's attorney says she only had one glass of wine four hours before the crash, adding that she suffers from epileptic-like seizures in her legs.

    So if she suffers from "epilleptic-type seizures" in her legs that may actually cause her to lose control of the car, I would think she shouldn't be driving, period. However, common sense tells me she was blasted and had way more than one glass of wine.

      One glass of wine four hours before the crash. When you drink, the alcohol still remains in your body, it doesn’t dissipate immediately. Drunk driving is illegal no matter how much alcohol you’ve consumed.

      I'm guessing she's probably effectively judgment proof. Has very little in the way of assets, which will be reduced to nothing by her legal fees and will be making less than $1/day in prison for her foreseeable future.

    If she suffers from epileptic-type seizers in her legs, one would think she'd turn the car in any other direction to avoid this, use the emergency brake or turn the car off to avoid this. However, I'd be willing to bet she was under the influence.

      I looked it up. Epileptics can still drive in Michigan as long as they've been seizure free for one year. Now the question is, had she been hiding her seizures in order to keep her license?

    Definitely seems more like a medical emergency type of thing. But just goes to show that people should be reevaluated and retested and given medical clearance to be able to still drive. I’d say every few years once you’re over a certain age.

As someone who also has epilepsy, I empathize with the fact that she can’t control her symptoms, but she could have at least brought someone with her that day to make sure nothing like this would happen. This is very sad. I pray for the family who lost those children.

    I just read an article online saying that drinking while an individual has a history of epilepsy can actually increase the risk of future seizures, so it was her fault for thinking that she could actually drive while dealing with such a situation. Now she's gonna be going to jail for quite some time because of her reckless actions. According to Michigan law, the max sentence for vehicular manslaughter is up to 20 years in jail. However, theres a rule that states that shes now eligible to have her license revoked permanently. Let's hope the judge allows this to happen because of those 2 precious souls that were taken far too early.

    Hmm, I wonder if a breathalyzer test was administered, or if blood was drawn. If there is no evidence of her blood alcohol level, the, "epileptic seizure," defense has a chance.
    Regardless, the aunt has every right to be angry and distraught. What a HORRIBLE situation.

    Her lawyer said she only had one drink. The prosecutor said her blood alcohol was way over the legal limit. I watched the video of her arraignment and I couldn't believe her lawyer arguing in her defense in regards to bond.

    There is never any excuse to be drinking, especially during the day, and drive or operate a machine that can cause injury or death. Absolutely none. I don’t care if it is one glass or one sip. Any alcohol impairs you and I don’t want to hear excuses. You all should know better. Get a cab or a lift from someone if you need to go somewhere and you had alcohol within the last several hours. If you don’t have any alternative but to drive yourself then you shouldn't be drinking until you're settled in for the night with nowhere to be.
