I can answer this for you. As a former LEO for DPD and former Federal Agent, every time you are arrested, regardless of conviction or court outcome, it never gets expunged. So he will have this on his record until death. When he attempts to renew insurance claims, tax returns, or purchase a firearm, this will pop up. You can be arrested for FV and all charges dropped, however if you attempt to purchase a firearm you will be flagged by ATF always. This led to what Trump had stated, along with Vivek, and RFK JR, the US Government has too much of an over reach and fails to maintain the information that is obtained. Trust me, I used these databases when conducting criminal investigations, it’s vast and most information is outdated with minimal oversight.

In this case the man paid his bond to the court on his own.

The fact you can sue in a different county, not have to inform the person being sued, and then win by default when the person doesn't show up to defend themself from a suit they have no knowledge of, is a major problem in the state.

He has to get the history of the felony warrants/ charges and the arrests removed. Just the fact that he was arrested and had warrants (not really his) will follow him until they are removed. Let this be a lesson to the uninitiated. If you receive service for a lawsuit against you, even if it's the wrong you, you MUST answer it. If you ignore it, a default judgment will be filed as you will automatically lose when you dont show up for the case. Many of his issues would have been avoided had he not ignored the civil suit summons.

One has to weigh it out, because once you get pulled over in your car when you're by yourself, on top of getting arrested anyway, they're going to impound your vehicle. It would have been just a matter of time before they would have got him anyway, at least this way you can control it in a less embarrassing manner than around a bunch of people like at work, etc.

It has always amazed me that when arrested and found Not Guilty or if charges are dismissed in any way, that the arrest is still on record and can still be used against you. This is not just in the US. I am Canadian and it happen here too. A perfect example is if I wanted to travel to the US. I would be asked if I was ever arrested. Not if I have any Criminal Convictions. Police know that an arrest is used against you. I believe that is why so many people who's only crime is hurting a cops feelings (Contempt of Cop) are arrested. Even if charges do not proceed, we will still punish you.

@@bobroberts2371- I think I saw you write a comment somewhere else. It’s obvious what the lawyer did wrong, once he knew he had sued the wrong person he just laughed and didn’t give a damn. I’m not sure what kind of perspective you could be coming from that you’re perfectly fine with an innocent person being hounded and harassed and having their wages garnished just because they couldn’t afford a lawyer. You also missed that they tried to contact lawyer several times beforehand.
So the lawyer is perfectly fine and nothing wrong with what he did even though he was contacted multiple times, and it even seems like he was contacted before the default judgment even happened, but definitely we know he was contacted afterward. That’s perfectly fine. But a normal every day citizen possibly, again possibly, not responding to the lawsuit because he doesn’t know what to do and he’s nervous and doesn’t have money for a lawyer, that’s an excusable. But the lawyer, perfectly fine. Got it.

The fact you can sue in a different county, not have to inform the person being sued, and then win by default when the person doesn't show up to defend themself from a suit they have no knowledge of, is a major problem in the state.

The judge likely didn't have the information and their hands are tied if one party doesn't show up. I hope this guy gets compensated for this nonsense, but not showing up to a hearing didn't do him any favors.

I remember getting a letter stating I owed child support 6 months after my dad died. I called the authorities where he used to live and told him he was deceased and they closed the case.

It does beg the question of Innocent before being proven guilty. How did the Air Force even find out about his arrest with no conviction? How can they punish a person with no final verdict on the case showing a conviction of a charge?
The guy didn't show up to a hearing which typically results in a default judgement, it sucks since he did nothing wrong here but he needed to show up, ideally with a lawyer but at least with the letter from the police admitting their mistake.

Let this be a lesson to the uninitiated. If you receive service for a lawsuit against you, even if it's the wrong you, you MUST answer it. If you ignore it, a default judgment will be filed as you will automatically lose when you dont show up for the case. Many of his issues would have been avoided had he not ignored the civil suit summons.

The $700.00 was for the reimbursement for the bond he paid to get out of jail, not a settlement with the police/city. I've seen many videos where the police return the amount of money that the person would have been out from the bond fee after a false arrest. Example: Even if someone has a $10,000 Bond and you go to court and the bond is returned to the bondsman, they still keep the 10% fee of the bond paid upfront by the person because they performed the service that was paid for.
In this case the man paid his bond to the court on his own.

I seriously doubt the chief of police would hand deliver a check unless it was to secure his signature for a settlement and allow the city to escape liability.

One has to weigh it out, because once you get pulled over in your car when you're by yourself, on top of getting arrested anyway, they're going to impound your vehicle.
It would have been just a matter of time before they would have got him anyway, at least this way you can control it in a less embarrassing manner than around a bunch of people like at work, etc.

How did he secure a judgement through a court, that means he filled a false judgement with false paperwork, which means you file suit against that company, they messed with your life.
The guy didn't show up to the hearing, which typically means the other side wins since they're the only ones presenting any information. It sucks and I hope the guy is made whole, but skipping the hearing wasn't the best move.

That tells you how much damage the work done by an inept LEO can cause on an innocent person, to the point on him having to scramble and try to figure out how to fix the problem created by the police department, and I bet the inept LEO probably got a slap on the wrist and a pay increase. While this man had to deal with the consequences.
It has always amazed me that when arrested and found Not Guilty or if charges are dismissed in any way, that the arrest is still on record and can still be used against you. This is not just in the US. I am Canadian and it happen here too. A perfect example is if I wanted to travel to the US. I would be asked if I was ever arrested. Not if I have any Criminal Convictions. Police know that an arrest is used against you. I believe that is why so many people who's only crime is hurting a cops feelings (Contempt of Cop) are arrested. Even if charges do not proceed, we will still punish you.
