- The charge is murder for a suspect who allegedly shot into the back of a woman’s car, killing her 6-year-old son, Aiden Leos. 24-year-old Marcus Anthony Eriz and 23-year-old Wynne Lee were arrested in front of their home after law enforcement spent two weeks looking for them, according to California Highway Patrol. Eriz has been charged with murder and Lee has been charged with accessory after the fact and knowingly concealing a firearm. #InsideEdition
So he killed a kid..while hoping to kill a woman. For a traffic mishap?

Not really surprised that her sentence is so light, that it might as well be a slap on the wrist for her role in all of this. I won't be surprised if she gets an extremely light sentence to possibly no jail with just probation if they get her to take a deal with she confesses and have them throw the guy under the bus hard for a definite guilty verdict.

Wynne Lee was not just an "accessory after the fact." Her role as the driver was integral to aiding Marcus Eriz in the commission of a crime - in this case murder. Just as the driver of a getaway car in a bank heist can be charged with murder should the robber shoot and kill a clerk, so too should Wynne Lee. In fact, her driving was directly instrumental in putting Marcus Eriz in a position where he could shoot at the other vehicle. Good grief.

The judge will take into account that they both have no prior criminal records, and since the guy was a gun-fanatic he likely always carried his gun with him in the car while he was with her. She could obviously testify that she didn’t know he was going to open fire all of a sudden because of all the other times he didn’t randomly open fire or threaten other drivers with a gun (there’s no history of him threatening others with a gun on the road).
Under California’s new law: In 2018 Gov. Jerry Brown signed legislation on that limits who can be prosecuted for felony murder to those who commit or intend to commit a killing. The new law, scaled back California’s old felony murder rule, which allowed defendants to be convicted of first-degree murder if a victim died during the commission of a felony - even if the defendant did not intend to kill, or did not know a homicide took place.
There is no evidence (as of yet) that she even knew he was going to open fire, or encouraged him to open fire at the other car. You charge her with murder and the case is going to be dismissed because there is not enough evidence to pin it against her, especially under the new California law. If her boyfriend testified against her too and said that she encouraged him to open fire, then she will also be charged accordingly. As of yet, the info is extremely limited for the public.

It doesn't matter. He had the intent of causing serious bodily injury or death or had such reckless disregard for human life in discharging the firearm into an occupied vehicle, that serious injury or death was a very likely outcome.
So he is rightfully charged with murder.
