Some attorneys work by what is called a contingency agreement. These agreements don't generally require you to pay the attorney on an hourly basis. Instead, the attorney takes a percentage of any recovery you receive from the defendants. Contingency fees agreements differ among attorneys, types of cases, complexity of cases, and depending on your state/county/city. Generally speaking, contingency fees range from 33-45% of the total recovery.
Hiring an attorney on a contingency fee basis may be very helpful for you, especially if you can’t afford to pay an attorney on an hourly basis.
In this video, we will give you a few words of caution to keep in mind. Before signing, make sure you understand exactly how the contingency fee is calculated.
I've actually heard the opposite. I've heard that attorneys who get paid by the hour work less harder than someone who is working based on contingency. I've also heard that lawyers who think you may not have a strong case would prefer working by the hour so that their income is not dependent on whether your case wins because they get paid regardless when they work by the hour.
Great tip!
You forgot to subtract the taxes the plaintiff has to pay on the attorney's share of the award. Why does the plaintiff have to pay the attorney's taxes on his income?? I know your paying for his/her expertise, but I brought the food to the table and the attorney only cooks it!! No food, nobody eats! Plus, they can pad the expenses which goes into their pot. Just saying. :)
Depending on the state, in California There's no tax in personal injury cases, of course states differ in regard to tax
Wouldn't a % Lawyer work harder than an hourly to get as much as he could
That's what I heard as well.
