      Well clown, he has the same rights as you, which means due process. He has been suspended without pay until an internal investigation is completed and he goes to trial and anyone living in HI knows, he has nowhere to go and can't leave, he's not a flight risk so therefor excessive bale cannot be set. Jail space in HI is limited. And when I say an internal investigation, that means an outside agency from a separate police force IED is brought in to investigate, a police agency cannot investigates alleged crimes within its own police force.

      This happens more than people think. In my locale, we had a retired sheriff's deputy that was running people off of his favorite fishing spot by flashing his badge and claiming that they were fishing on his private property. The local cops wouldn't do anything until video of him doing it was circulated around.

    If the Sheriff meant to be of service, there are friendly ways to let a bruddah know the place he’s fishing is kapu. He maybe had the right message but his approach was all wrong. Missed opportunity to learn something from each other and resolved in the worst way possible.

    The real question is was it a pepper ball gun or an actual gun and did the arresting officers conceal or hide the fact he was carrying a real firearm concealed off duty? If it was a pepper ball gun why would he be arrested and charged with any offense if he brandished it in “self defense” due to the angry fisherman charging towards him aggressively. Let’s not act like all locals are polite saints just asking “Excuse me sir, why you taking my picture.” Also what size eye net was bradda man throwing? Too many people scraping the resources with illegal nets, under size fish, out of season fish and over bag limit. What does DLNR do all day? If everybody just take and take not going have nothing left. It’s one thing to feed your family but it’s another thing to ravage the resources everyday because you have no job. (Not saying that this bradda is one of those people) but We all know guys who do illegal fishing. SO MANY UNANSWERED QUESTIONS. POLITICIANS IN HAWAII ARE 🤡🤡 MOST LAW ENFORCEMENT ARE CORRUPT OR INCOMPETENT. SOME ARE SOLID.

      It's not really any different when you are brandishing a real firearm versus a toy or something that looks like one, it's the intent. Doesn't matter if it's unloaded either. Also, police are allowed to conceal carry when off duty. They don't need a concealed carry permit. And yes I think the real question is did the fishermen Act aggressively towards the sheriff because he was being filmed? Many people erroneously believe that people do not have a right to film them in public when in fact you have no right to privacy when you are in public and anyone can film you.

    now if we had pro 2A laws the off duty deputy would have never drawn his weapon without the thought in his mind that if i draw my weapon as a civilian and others view me as a threat to them, others and society they could intervene, protect, de-escalate or if worse comes to worse they could shoot and kill the off duty deputy and it would be the deputy’s own fault for drawing his weapon without any probable cause, threat or justification. not saying we should all go around shooting bad guys for no reason, but me personally i would definitely think twice before confronting someone if it was a pro 2A state especially confronting someone with a weapon and then threatening them with said weapon

      Its illegal to throw net at man made areas, canal, harbors, piers, etc. The canal mouth falls into the catergory, but regardless, the sheriff is wrong period, it isnt that big of a deal to pull a gun. He couldve just educated the guy.

    Native Hawaiians should be able to net fish as it’s their cultural right to do so anywhere on the islands they choose. All others should be held accountable to the no net fishing zones.

    So the guy noticed he was being recorded and started to approach the guy and asked why? Is this really how it went down? He wasn’t being threatening and yelling at the man? There’s more than one way to tell a story. The fisherman’s story may be legit but should be looked at objectively without jerk knee emotional reaction.

    So he got upset because the guy was recording him (in public) and he CONFRONTED him. Maybe he was recording him using a fine mesh throw net, which is illegal in Hawaii, or the location prohibits the use and he was going to give it to DLNR for enforcement. He even told the reporter that the deputy told him "that's illegal". If you are doing something illegal and someone records you, some people's reaction is to get confrontational with threats of violence. Maybe this off-duty deputy pulled out the pepper spray after this guy threatened him and now he playing the victim. Just because he goes on television and sheds some alligator tears doesn't mean he's an angel either. Maybe he's been previously cited for fishing violation or poaching and don't want to catch another case. Remember, this is Waianae, where the locals like to talk with their fists. We are only hearing one side and not the other. People are so quick to pass judgement without hearing the whole story.

    OK just listen to that local boy and the words that he’s using he got mad at the guy for videotaping and started to come at the guy aggressively like he was gonna fight or beat him up. This kind of behaviour needs to stop. It’s called racism and it happens all the time here in Hawaii and all of the local people are OK with it. It’s wrong. It needs to stop. Usually the local people know that whoever it is they’re harassing is going to get on a plane and fly away so they never have to go to court and local boy Hawaiians play that card 100% of the time.       A better question is what right does the off duty cop have to be harassing the fisherman when he's OFF DUTY?
      I can fully support getting involved if he witnessed a violent crime in progress or something. Other than that, if off duty just call it in and/or make yourself a good witness.

    These Brahdah’s look like they just wanted to feed their families. I miss life in the 60’s! We all went family outings to go fishing for our lunch and dinner. My dad even taught me how to make a throw & cross net. Then later taught me how to catch fish with that net. Life was so much better and simple in the olden days.     There are the correct ways to do things, and because you hold a badge, you ought to be held to a higher standard BECAUSE you chose to take the oath to serve and protect, not abuse the privilege. The officer's conduct needs to be addressed, and he needs to be held accountable for his reckless behavior.

    I’m concerned that an off duty officer was not armed with a real gun . I’m not sure where the truth lies in this particular situation. Some bangers try to scare a person to pull a weapon just to call police on them or lie about it.

    It seems there is uncertainty with the "fishing laws" in Hawaii. Need to have licenses with books or just a phone app to explain things. Just a PDF map set on your phone you can pull up even with no cell connection would be nice and very easy to implement.
    Instead of flashing a gun, the undercover Officer needs to flash his badge and give out Officer name and number. -In this situation things got too close for everyone involved. -With everyone fishing there it seems unnecessary and over-the-top.
